FRIES, Owner ROTHMAN, SCHUBERT & REED, Contractor : IN THE COURT OF COMMON PLEAS : CUMBERLAND COUNTY, PENNSYLVANIA :NO. WHEREAS, MATTHEW E. FRIES and TRICIA A. FRIES of 3 West Lawn Circle, Lemoyne, Pennsylvania, is about to execute contemporaneously herewith, a contract, with Rothman, Schubert & Reed of Enola, Pennsylvania, tbr the erection of a building upon premises commonly known as LOT 0-7 FLORIBUNDA HEIGHTS, Township EAST PENNSBORO, CUMBERLAND County, Pennsylvania, as set forth in the deed dated E] _ I q- C31 , recorded at Deed Book , Page , in the Recorder's Office for CUMBERLAND County, Pennsylvania, as more specifically described in Exhibit "A" which is incorporated herein and attached hereto. NOW, September 21, 2001, at the time of and immediately before the execution of the principal contract, and before any authority has been given by the said Owner to the said Contractor to commence work on the said building, or purchase materials for the same in consideration of the making of the said contract with Contractor and the lhrther consideration of One Dollar ($1.00), to Contractor paid by Owner, it is agreed that no lien shall be filed against the building by the Contractor, or any subcontractor, nor by any of the materialmen or workmen or any other person for any labor, or materials purchased, or extra labor or materials purchased for the erection of said building, the right to file such liens being expressly waived. FRIES ALL THAT CERTAIN piece or parcel of land sit~ate in East Pennsboro Township, Cumberland County, Pennsylvania, more particularly bounded and d{scribed as follows, to wit: BEGINNING at a point on the western side of Country Club Road at the southeastern corner of Lot No. 0-8 on the hereinafter mentioned Plan of Lots; thence along the southern side of Lot No. 0-8, North 79 degrees 10 minutes 00 seconds West, a distance of 132.66 feet to a point at the eastern line of lands now or formerly of Floribunda Associates; thence along the said eastern line of said lands, South 10 degrees 50 minutes 00 seconds West, a distance of 105.00 feet to a point at the northwest corner of Lot No. 0-6 on the hereinafter mentioned Plan of Lots; thence along the northern side of LOt No. 0-6, South 79 degrees 10 minutes 00 seconds East, a distance of 132.66 feet to a point at the northeastern comer of LOt O-6 and Country Club Road; ~hence along !the western side of Country Club Road, North 10 degrees 50 minutes 00 seconds East, a distance of 105.00 feet to a point, the point and place of BEGINNING. CONTAINING 13,929.78 square feet. ~ BEING Lot No. 0-7, on the Final Subdivision Plan of Floribunda Heights, Phase HI, Section A and Phase 1, dated March 22, 1996, prepared by Melham Associates, P.C., and recorded in the Office of the Recorder of Deeds, Cumberland County, Pennsylvania, in Plan Book 72, Page 36.
