COMPLAINT
The Plaintiff, DAL-TILE INTERNATIONAL, by Its attorneys, KNUPP & KODAK, P.C., brings this
action of Assumpsit against the Defendant to recover the sum of FORTY-ONE THOUSAND, SIXTY
DOLLARS AND EIGHT CENTS ($41,060,OIl), along with Interest thereon at Ten (10%) per annum
from April 5, 1996, upon a cause of action of which the foliowlng Is a statement:
1. The Plaintiff, DAL-TILE, INTERNATIONAL, Is a corporation organized and existing under
the laws of the State of Delaware, having Its prinCipal office and place of business at 7834 C,F. Hawn
Freeway, Dallas, Texas 75217, with an office and place of business at 5060 Ritter Road, Rossmoyne
Business Center, Mechanlcsburg, Pennsylvania 17055,
2, The Defendant, PRO-SET TILE, Is a corporation organized and existing under the laws
of the Commonwealth of Pennsylvania, haVing Its principal office and place of business at Marietta
Avenue, Post Office Box 312, Sliver Spring, Lancaster County, Pennsylvania 17575,
3, On the dates, In the amounts, and for the prices set forth In a true and correct copy of
the Plaintiffs Statement of Account hereto attached, made a part hereof and marked Exhibit "A",
Plaintiff, at the special instance and oral request of the Defendant, sold and delivered goods, wares

and merchandise of the kind and description set forth on said Exhibit to the total amount of TWENTY-
EIGHT THOUSAND, TWO HUNDRED SEVENTY-EIGHT DOLLARS AND TWENTY-NINE CENTS
($28,278.29),
4, All orders placed by Defendant were received and filled from Plaintiffs Cumberland
County location at 5060 Rlller Road, Rossmoyne Business Center, Mochanlcsburg, Cumberland
County, Pennsylvania 17055,
5, Due to the voluminous nature of Plaintiffs Invoices, said Invoices are not attached hereto
as an Exhibit, but are available for Defendant's review and copying at Plaintiffs attorney's offices,
6, The prices charged for said goods, wares and merchandise were just and reasonable,
were the legal and market prices therefor and were the prices which the Defendant orally promised
and agreed to pay Plaintiff therefor,
7, Due to Defendant's default In payment of said amount due and owing as aforesaid,
Interest has been added to said account In the total amount of FIVE THOUSAND, NINE HUNDRED
THIRTY-EIGHT DOLLARS AND FORTY-FOUR CENTS ($5,938.44),
8, Due to Defendant's default In payment of said amount due and oWing as aforesaid, and
pursuant to the terms of Plaintiffs Application for Credit, executed by Defendant's agent on or about
the 29th day of August, 1991, Defendant Is further liable to Plaintiff for reasonable attorney's fees in

the total sum of SIX THOUSAND, EIGHT HUNDRED FORTY-THREE DOLLARS AND THIRTY-FIVE
CENTS ($6,843,35), A true and correct copy of said Application for Credit Is attached hereto, made
a part hereof and marked as Exhibit "B",
9, The balance due and owing by Defendant to Plaintiff Is the sum of FORTY-ONE
THOUSAND, SIXTY DOLLARS AND EIGHT CENTS ($41,060,08),
10, Plaintiff has frequently demanded payment from Defendant of said amount due and
owing as aforesaid, but Defendant has refused and neglected and still refuses and neglects to pay
said amount of any part thereof,
WHEREFORE, Plaintiff brings this suit to recover from Defendant the sum of FORTY-ONE
THOUSAND, SIXTY DOLLARS AND EIGHT CENTS ($41,060,08), together with Interest thereon at
the rate of Ten (10%) percent per annum from April 5, 1996,

Complaint heretofore filed against and served upon it in the
above-captioned matter.
2. Defendant consents to the entry of Judgment in favor of
Plaintiff and against Defendant for $35,278.29, plus costs of
suit.

3. Plaintiff, DAL-TILE INTERNATIONAL, agrees not to execute
on said Judgment so long as Defendant pays to Plaintiff
$24,000.00 in monthly installments of $2,000.00 per month,
paYAble on the 15th day of each month.
4. If Defendant should default in payment of the monthly
installment and such default is not cured by Defendant within
thirty (30) days follo~ing receipt of written notice of such
default from Plaintiff, then and in such event, Plaintiff may
proceed with execution on said Judgment.
