This is an action in assumpsit on an oral contract settl~ng a dram shop claim. Defendant has allegedly failed to comply with one of its obligations under the settlement - i.e., transfer of a beer license to Plaintiffs. The license allegedly cannot be transferred to Plaintiffs because it was committed to someone else; consequently, Plaintiffs request $50,000.00, the alleged value of the license. Defendant's defense is that the Plaintiffs have suffered no damage inasmuch as they had no location for the license, as required by law. This will be a nonjury trial of an estimated duration of one-half day.
