Defendancs, Kreider's Mill, Inc., Mark D. Kreider nnd Maureen C. Kreider (hereinafter
collectively referred to as "the Kreiders") respond to the Writ of Revival filed by plaintiff, First
Bank of Loysville (hereinafter referred to as "Loysville") as follows:
I. Admitted in part and denied in part. It is admitted that this is a proceeding to
revive the lien of the judgment entered to 87-1025. It is denied that this is nn action to continue
the lien of the jUdgmenc entered to 87-1025 as that lien expired on April8t 1992 without being
revived by Loysville.
Agreement attached as Exhibit A by making timely monthly payments since the date of the
Agreement, December 14, 1990. Therefore, as of December 31, 1995, five-twelfths of the
accrued interest ($22,365.57) on this judgment has been forgiven by Loysville and satisfied by
the Kreid.ers.
8. The Kreiders have made timely payments through the first seven months of this
year (1996) and as of December 31, 1996, one-half of the accrued interest will be forgiven, or
satisfied, under the terms of paragraph 2(b) of Exhibit A.
9. The Kreiders' timely payments, pursuant to the Agreement aUached as Exhibit A,
have also resulted in a substantial satisfaction of the balance of principal with interest still due
and owing. Presently, the amount of the judgment due and owing is substantially less than the
amount of the original judgment docketed at 87-268.
10. Based upon figures provided by PNC Bank, the Kreiders have satisfied the
judgment to the extent that only $110,417.10 is owed as of July 31, 1996.

WHEREFORE defendants request that the Writ of Revival be dismissed and stricken
from the judgment index.
In the alternative, to the extent a revived judgment exists, the revived judgment should
Indicate the partial satisfaction ofthejudllrnent and the revivedjudllrnent should be entered in
the amount of only $110,417.10.

Plaintiff, by and throuqh its attorneys, Weir , Partners,
responds to Defendants' new matter as follows:
4. Denied. It is denied that the Defendants have satisfied,
partially or otherwise, the jUdqment.
To the contrary, the
Defendants have made only certain monthly payments toward their
obliqations for the jUdgment to the Plaintiff.
5. Denied. It is denied that this judgment was incorporated
into the De;cember 14, 1990 Aqreement (the "Aqreement"). To the
contrary, the note executed by the Defendants and evidencinq loan
number 3900005866 was recorded as a judgment on April 8, 1987. The
loan, and not the jUdgment, is the subject of the Aqreement. By
way of further answer, this averment is denied in that the
Agreement attached to Defendants' New Matter as Exhibit "A" is a
written document which speaks for itself.
6. Denied as stated. The Agreement dated December 14, 1990
and attached as Exhibit "A" to the Plaintiff's Answer and New
Matter states:
The Bank agrees that for every twelve (12) monthly
payments made by the Kreiders and Kreider's Mill as set
forth above that the Bank shall forgive one-twelfth
(1/12) the accrued interest owed to the Bank by Kreiders
and Kreider's Millon the three aforesaid loans set forth
above and the notes dated 3anuary 29, 1987 for accrued
interest.
By way of further answer, this averment is denied in that the
Agreement is a written documents which speaks for itself.
7. Admitted in part, denied in part. It is admitted that
the Defendants have made certain monthly paymentG pursuant to the
Agreement.
It is denied that Defendants have performed their
obligations under the Agreement by making such payments. It is
denied that any part of the judgment has been forgiven by Plaintiff
or that any part of the jUdgment has been satisfied.
To the
contrary, payments made by the Defendants on their obligations to
Plaintiff have been credited toward the total amount due and owing
to the Plaintiff.
8. Admitted in part, denied in part. It is admitted that
the Defendants have made payments this year pursuant to the
Agreement. It is denied that, as of December 31, 1996, one half of
this judgment or "accrued interest" will be forgiven or satisfied
in that the conditions necessary for forgiveness or satisfaction of
the judgment have not yet occurred, that is, payment by the
Defendants of all amounts due and owing to Plaintiff. By way of
further answer, this averment is denied in that the Agreement is a
written document which speaks for itself.
9. Denied as stated. It is denied that the Defendants have
substantially satisfied the principal balance of their obligations
to the Plaintiff. It is denied that the amount of the jUdgment
currently due is sUbstantially less than the original jUdgment
amount or that the jUdgment subject to this revival was docketed at
87-268. By way of further answer, all payments made by Defendants
under the terms of the Agreement have been credited to the
Defendants' outstanding obligations due and owing to Plaintiff.
10. Denied. It is denied that Defendants have satisfied the
jUdgment and that, based upon the figures and schedules provided to
the Defendants by Plaintiff, the balance of the judgment is
$110,417.10. To the contrary, as of July 26, 1996, the amount due
and owing by Defendants to Plaintiff on this obligation is
$138,806.67. By way of further answer, after reasonable
investigation, Plaintiff lacks knowledge or information sufficient
to form a belief as to the truth or falsity of the balance of this
averment and, therefore, denies the same.
WHEREFORE, Plaintiff requests that the jUdgment entered
against the Defendants be revived in the full amount thereof and
indexed on the record.
