AND NOW, comes Petitioner, Deborah Lynn Baker, by her
attorney,
Michelle R, calvert, Esquire,
and
respectfully
petitions the Court for review of an Order of the Department of
Transportation
suspending Petitioner's vehicle
registration
privilege, and in support thereof represents as follows:
1, Petitioner, Deborah Lynn Baker, is an adult individual
residing at 29 Betty Nelson court, Carlisle, Cumberland County,
Pennsylvania 17013,
2. Petitioner currently holds a valid Pennsylvania driver's
license, driver's number 21066007,
3. petitioner is the owner of a 1985 Plymouth mini van,
VIN '2P4FH41G8FR192820, Title #47059323, Registration #ANE3686,
4, By correspondence dated May 13, 1996, Petitioner was
notified by the Department of Transportation that her vehicle
registration privilege was being suspended for a period of three
months for failure to provide proof of financial responsibility
covering the above-referenced vehicle, A copy cf the notice is
attached hereto and incorporated by reference as Exhibit "A",
5. The correspondence from the Department of Transportation
indicated that Petitioner had been previously requested by the
Bureau of Motor Vehicles to provide proof of financial
responsibility covering the operation of the vehicle, and that
either no response was received or the information provided
indicated a lapse of insurance coverage,
6, Petitioner never received the prsvious notice referred
to in the May 13, 1996 correspondence, and was therefore unaware
of the request ~o provide proof of financial responsibility, or
that a violation of section 17B6 of the Vehicle Code would result
from a lapse in that coverage,
7, Petitioner did discontinue her insurance coverage on the
above vehicle with Motcrists Mutual Insu~ance Company on or about
February B, 1996,
B. This insurance coverage was discontinued as a result of
mechanical failuros with the vehicle which ronde red the vehicle
completely inoperable,
9, At the time the vehicle was rendered inoperable,
Petitioner decided to purchase a neW vehicle instead of repairing
the above vehicle,
10, petitioner did not drive or operate the vehicle, or
allow the same to be driven or operated, from the date when she
discontinued her insurance coverage, until early April 1996, when
the vehicle was repaired, and she re-established insurance
coverago,
11. Petitioner currently maintains financial responsibility
on this vehicle through Nationwide Insurance Company, A copy of
Petitioner's insurance identification card, indicating coverage
effective April 3 , 1996 is attached hereto and incorporated by
reference as Exhibit "B",
12, Petitioner did not operate her car or allow it to be
operated during the period in which she had no insurance on the
vehicle,
13, Petitioner has submitted a request for reconsideration
of the Order suspending her vehicle registration privilege to the
Department of Transportation. A copy of this request is attached
hereto and incorporated by reference as Exhibit "e",
WHEREFORE, Petitioner respectfully requests this Honorable
Court to enter an Order setting this matter for de novo hearing
and setting aside the Order of the Department of Transportation
suspending Petitioner's vehicle registration privilege,

Dear Sir or Madam:
This correspondence is in response to a notice mailed to my
client on May 13, 1996 regarding the maintenance of financial
re.ponsibility on the above-referenced vehicle. Deborah Lynn
Baker has recently retainod this office regarding this matter,
By this correspondence, we are requesting a reconsideration
of the final order of suspension of Hs, Baker's vehicle
registration, which will become effective on June 17, 1996 at
12:01 a.m, There are two baGes for this request for
reconsideration. First, Ms, Baker indicates that contrary to the
assertions set forth in the May 13 correspondence, she had never
been requested by the Bureau of Motor Vehicles to provide proof
of financial responsibility on this vehicle, Ms, Baker reports
that the May 13, 1996 correspondence is the only correspondence
she had received regarding this matter. She also reports that
had she been notified within 31 days after terminatinq her
insurance on the vehicle, February B, 1996, she would have acted
to reinstate the insurance if that was required by the law,
However, since she had no notice of the potential suspension, she
was not afforded an opportunity to take these actions,
Second, Ms, Baker indicates that she had discontinued her
insurance coveraqe on the above vehicle on February 8, 1996
because the vehicle was inoperable effective on that date. She
indicates that she oriqinally had no intentions to repair the
vehicle, as the transmission was completely removed, The vehicle
apparently sat idle for approximately eight weeks, until the
beginning of April 1996, at which time Ms, Baker had the vehicle
