AND NOW, this _ day of

representation of the attached Petition, and upon Motion of
David Mason Biggs on behalf of himself, a hearing de novo is
granted to determine whether the action of the Department of
Transportation in revoking the driver's license of Petitioner
should be set aside. Moreover, it is hereby ordered and decreed
that no revocation shall OCcur until a hearing has been held and
this court makes a final determination of the Petition contained
herein. The within matter is scheduled for

LICENSE SUSPENSION APPEAL
AND NOW, comes David Mason Biggs presenting the following
Petition for Appeal from Suspension of his driving privileges:
I. Your Petitioner is an adult individual who resides at 14
Brandy Lane, Mechanicsburg, Cumberland County, PA 17055.
2. Your Petitioner is licensed as a motor vehicle operator
by the Commonwealth of Pennsylvania, Department of Transportation,
Bureau of Driver Licensing.
3. By official notice dated May 15, 1996, your Petitioner
received notification from the Commonwealth of Pennsylvania,
Depsrtment of Transportation, Bureau of Driver Licensing, that
his driving privileges were to be suspended for a period of 30
days as a result of his departmental hearing.
(Attached as
Exhibit "A" and incorporated herein by reference thereto is a
copy of the Official Notice provided your Petitioner.>
4. This appeal is pursuant to Section 1550 of the Motor
Vehicle Code which authorizes your Petitioner to appeal from
suspension of his driviog privilege.
COUNT ONE
5. Correspondence (Exhibit A) notifying your Petitioner of
suspension of his driving privileged exceedes the mandated six
month period for such action, pursuant to Section 1551 of the
Motor Vehicle Code which states in part ("failure of the
Department to give prompt notice of suspension 8S required by
this Section shall prohibit the Department from suspending the
license or permit of such person.")

WHEREFORE, for the foregoing reason, your Petltlone. would
requeet that this Honorable Court grant his appeal and reinstate
his driving privileges.
COUNT TWO
6. Paragraph a one through five are incorporated herein by
reference thereto.
7. Attending a Departmentol Hearing which was scheduled for
Iste 1995 wss not possible by your Petitioner due to inclement
weather.
8. After telephoning the Department of Transportation and
writing to note the reason for not attending. part of the
Oepartment's response was a Form entitled "Information concerning
waivers for rescheduled or postponed Departmental Hearings and/or
written special Point Examination" (Attached as Exhibit "B" and
incorporated herein by reference thereto is a copy of this form
provided your Petitioner).
9. Exhibit "B" point 3 states "A Departmental Hearing will only
be R88CHEDULED ONE TIME.
10. Pursuant to SECTION 1532 of the Motor Vehicle Code: "If
motorist was unable to attend (a Departmental hearing) for good
and sufficient cause, his failure to appear should not have
subjected him to disciplinary or punitive actloo".

action in and of itself.
12. By official notice dated December 29th, 1995 your Petitioner
received notification of his requirement to attend a departmental
hearing on January 22nd, 1996 which was the rescheduled henring
referred to by Exhibit "B" (Attached as Exhibit "c" and incorporated
herein by reference thereto is a copy of this notice provided
your Pet it ioner>.
13. As the hearing was to be rescheduled only once, your Petitioner
was availbble for the hearing 00 Jsnuary 22nd, 1996 at great peril
due to inclement weather, snd the Department of Transportation
was not.
14. By virtue of your Petitioner's receipt of Exhibit "B" and
the Department's fsilure to appear at the rescheduled hearing,
the Department in effect waived its right to further act in this
matter. your Petitioner pleads.
WHEREFORE, for the foregoing reasons, your Petitioner
respectfully requests that this Honorable Court grant hia appeal
and reinstate his driving privileges.

16. The next day on January 23rd, 1996 your Petitioner telephoned
the Department of Transportation, Bureau of Traffic Safety -

18. Your Petitioner further questioned,,_ regarding the
attitude in the Hearing Office as stated by -

than a day of inconvenience" for the motorists required to
atteod; and fu.ther that 30 days suspensions were mundatory.

20. Your Petitioner immediately telephoned the office of Chief
Counsel for the Department of Transportation and recounted the
information related in the foregoing paragraphs seven through
nineteen to Barbara Oarkus, Esquire, an employee of that office.
21. Petitioner believes, and therefore svers, that the Department

maximum authorized license suspension for motorists' speeding
violations.

22. Further, your Petitioner cites LEWIS V. PENNDOT, 9 PA. D. &
C. 4th 565 (1990) which held that a hearing in cases in which a
license may be suspended for a period not to exceed thirty days. ...
.. does not comport with due process of law where it consisted
only of a lecture by a member of PENNDOT with no opportunity for
the motorist to state extenuating or mitlgatiog factors.
WHEREFORE, for the foregoing reasons, your Petitioner
respectfully requests that this Honorable Court grant his appe~l
and reinstate his driving privileges.

Dear Motorist.
As a result of your departmental hearing, a suspension
of 30 DAV(S) is imposed under Section 1538 of the Ve~icle
Code.

In order to comply with this sanction you are required to
return any current driver's license, learner's permit and/or
temporary driver's license (camera card) in your possession
no later than the effentive date listed. If you cannot com-
ply with the requirements stated above, you are required to
submit a DL16LC Form or a sworn affidavit stating that you
are aware of the sanction against your driving privilege.
Failure to comply with this notice shall result in this Bu-
reau referring this matter to the Pennsylvania State police
for prosecution under SECTION I571(a)(4) of the Vehicle Code.
Although the law mandates that your driving privilege is un-
der suspension even if you do not surronder your license,
credit w111 not begin until all current driver's license
product(sl, the DL16LC Form, or a letter acknowledging your
sanction is re~e1ved in this Bur3au.
WHEN THE DEPARTMENT RECEIVES YOUR LICENSE OR ACKNOWLEDGEMF.NT,
WE WILL SEND YOU A RECEIPT. IF YOU DO NOT RECEIVE THIS RECEIPT
WITHIN 15 DAYS CONTACT THE DEPARTMENT IMMEDIATELY. OTHERWISE,
YOU WILL NOT BE GIVEN CREDIT TOWARO SERVING THIS SANCTION.
The effective date of suspension is 06/19/1996, 12101 a.m.

~ RESCHEDULED OR POSTPONED DEPARTMENTAL HEARINGS
'" - -V AND/OR WRITTEN SPECIAL POINT EXAMINATION
The enclosed waiver fonn has been sent In response to your correspondence for either a postponement
of your Special Point Exam, or for a postponement or rescheduling of your Departmental hearing.
Please be aware of the following:
. Please keep all correspondence and this letter for your records,
· The Department Is unable to accommodate requests for specific dates and times for
rescheduled hearings.
. A Departmental hearing will only be rescheduled ONE time.
. II you are residing out of state, are In active military status out of state, attending school
out of state (and are not wllhln reasonable driving distance to a written Special Point Exam
and/or Departmental hearing location), or Incarcerated, your Special Point Exam and/or
Departmental hearing will be postponed Indellnltely until your rsturn to Pennsylvania, or
your release from Incarceration. Upon your return to the Commonwealth or release from
Incarceration, you are required to contact the Bureau In writing within 15 days at the address
below.
. II you are attending school In Pennsylvania and have been scheduled for your Departmental
hearing at a location near your permanent residence, let us know If we can reschedule you
near your school or after Ihls school semester at your permanent residence.
. II you miss your Departmental hearing for any other reason, you will automatically be rescheduled
after the waiver Is received and processed by the Bureau.
. lithe waiver form was sent to you by facsimile (FAX), you must return the complsted original
waiver form by regular or express mall, The Bureau will not accept a completed waiver
form by facsimile.
. All waivers must be signed by the named person and notarized. A Power of Attorney Is not
acceptable.
. When the waiver Is placed on your driving record, you will NOT be able to renew your license
until you take your Special Point Exam or hava your Departmental Hearing.
. Within 15 days of change of name or address, you are required by law to notify the Bureau
of Driver Licensing In writing.
NOTE: During the Interim period until your waiver form Is processed you might recelvo a suspension
notice, Please altow us two (2) to three (:::) weeks to process your waiver from the date
you mailed it. When your waiver form has been processed, you will receive a rescind
letter stating that the suspension Imposed on your license for this Exam or Hearing
(only), has been removed from your license record. Please be advised that II you are
under suspension, you cannot drive until you are notified by the Department that your
driving privilege has been restored,

As a result of your departmental hearing, a suspension
of 30 DAV(S) is imposed under Section 153B of the Vehicle
Code.

NOTE: During the Interim period until your waiver lorm Is processed you might receive a suspension
notice. Please allow us two (2) to three (3) weeks to process your waiver from the date
you mailed It. When your waiver form has been processed, you will receive a rescind
letter stating that the suspension Imposed on your license for this Exam or Hearing
(only), has been removed from your license record. Please be advised that If you are
under suspension, you cannot drive until you are noUlled by the Department that your

coneideration of the Plaintiff's appeal from the suspension of
his driving privileges, and following a hearing at which the
Court reviewed the matter de novo and exercised its own
discretion with respect to tha penalty, if any, to be imposed,
the action of the Department of Transportation in suspending
Plaintiff's driving privileges for a period of 30 days under
Section 1538 of the Vehicle Code is AFFIRMED.
