FACTS SHOWING LIABILITY Defendants Barbara Trinde! and John Trindel. operating as agents of Defendant Shippensburg Developers Builders, Inc,. a general contractor, contractcd with Plaintiff Kenneth G, Burry in October. 1994 to have Plaintiff install clcctrical wiring and fixtures at the "Peters" home in Chambersburg, Pennsylvania. Defendants have made only partial payment to Plaintiff for his work at this site. They further offered payment in the form of two checks that were not honored by their bank, The dishonoring of the first check caused Plaintiff to incur overdraft fees in his own bank account. In addition, Defendants Barbara Trinde! and John Trindel contracted with Plaintiff in October, 1994 and November, 1995, to have Plaintiff install electrical wiring and fixtures in their residence and barn at 470 McCulloch Road, Shippensburg, Pennsylvania. Defendants have failed to pay anything for Plaintiffs work on these items. II. FACTS SHOWING DAMAGES Defendants contracted to pay Plaintiff a total of$3800,OO for all electrical work at the "Peters" home. They paid Plaintiff a total of $1500,00 and received a $260.00 credit for contributing parts for Plaintitl's work. On the other hand, Plaintiff incurred overdraft fees in the amount of $240.00. Plaintiff is therefore claiming $2280,00 for damages related to thc "Peters" home, Plaintifl'is further claiming a total of $1 050.00 for unpaid work upon the Trindel residence and barn. III. Burry, by his attorney, John Wesley Weigel III, to file this Complaint, alleging as follows: 1. The Plaintiff, Kenneth G. Burry, is an adult individual residing at 401 Pine Road, Mount Holly Springs, Cumberland County, Pennsylvania. 2. Defendant Shippensburg Developers Builders, Inc. is a business enterprise incorporated and doing business at P.O. Box 304, Shippensburg, Cumberland County Pennsylvania. 3. Defendants Barbara Trindel and John Trindel are adult individuals residing at 470 McCulloch Road, Shippensburg, Cumberland County, Pennsylvania. 4. Defendant Shippensburg Developers Builders, Inc. acts as a general building contractor, and is owned and operated by Defendants John and Barbara Trindel. COUNT I - BREACH OF CONTRACT 5. Paragraphs 1 through 4 are incorporated herein as if fully alleged throughout. 6. In October, 1994, Plaintiff Kenneth G. Burry entered into an oral contract with Defendants to install electrical wiring and fixtures at a home that Defendants had contracted to build on Rocky Springs Road in Chambersburg, Franklin County, Pennsylvania. Defendants agreed to pay Plaintiff on a time and materials basis, and in accordance with past practice between the parties. 7. Plaintiff performed all work requested in a good and workmanlike manner. 8. Plaintiff charged Defendants $2200.00 to perform the initial wiring prior to installation of dry-wall in the home, and $1600.00 to perform finishing electrical work after installation of dry-wall. 9. Defendants have paid Plaintiff a total of $1500.00, and contributed $260.00 worth of parts for Plaintiff's work, but have refused to pay the rest of the agreed contract price, leaving an unpaid balance of $2040.00. 10. On January 3, 1996, Defendants gave Plaintiff a check for $1700.00 as payment toward the initial $2200.00 owed to Plaintiff Lut then stopped the check. Because Plaintiff had already written checks from his own account against the check given him by Defendants, Plaintiff incurred overdraft fees in the amount of $240.00. WHEREFORE, Plaintiff Kenneth G. Burry requests judgement in his favor and against Defendants Shippensburg Developers Builders, Inc., Barbara Trindel and John Trindel in the amount of $2280.00. Plaintiff has operated on a verbal, contractual, house-by- house basis with the Defendant Shlppensburg Developers Builders, Inc., to install electrical wiring at various properties., including one located on Rocky Springs Road in Chambers burg, Franklin County, Pennsylvanla.(also known as the "Peters" house). The jobs have never been on a time and material basis, but rather on a flexible estimated contractual cost basis, For further clarification regarding the Peters contract, see New Matter below, 7, Denied. To the contrary, all work was not performed in a good workmanlike manner. See New matter below. 8, Denied as stated. Defendants are unsure of the exact amount charged for this particuiar job claimed by the Plaintiff, for the reasons set forth in New Matter below. 9, Denied. To the contrary, the Defendant Shlppensburg Developers Builders, Inc. has paid Plaintiff, or on behalf of Plaintiff's contract, more than Plaintiff is entitled to. See New Matter Below. 10. Denied as stated, Defendant Shlppensburg Developers Builders, Inc. gave the Plalntiff a check for $1,700,00 upon request by the Plaintiff, It was oniy after the check had been delivered did the Defendant Shlppensburg Developers Builders, Inc, c. $479.00 credit for material pa}'IIlent to Plalntiff consisting of a 30" Cultured Marble Top, 30" Vanity Baso and a 42" Double Bowl Cultured marble top. d. $300.00 check to Plalntlff e, $1166,74 pald to electrical suppliers for materials not provided by Plalntlff. 20. The total pald by Defendant Shippensburg Developers Bullders, Inc on the Peters job was $3,444.74 which exceeds the amount agreed to by the Plaintiff by $419.74. 21. In addition to the above, Plaintiff has not performed all the work on the Peters job in a good and workmanlike manner, requiring the Defendant Shippensburg Developers Builders, Inc to have the work completed or redone, at an additional cost of $130.00. 22. With regard to the Trindel's home and barn, the parties did not have any precise agreement as to the cost to perform the work, however It was understood, based on the past dealings of the parties, that the amount would not exceed what the Plaintiff charged for comparable work performed on other jobs of the Defendant Shippensburg Developers Builders, Inc, 23. It is denied, however, that Plaintiff's charges would include the cost of all electrical materials. Plaintiff has received only $1~00.00 from Defendants for work on the Peters home. 21. Denied. On the contrary, Plaintiff performod all work on the Peters home in a good and workmanlike manner. After reasonable investigation, Plaintiff is without knowledge or information sufficient to form a belief as to the truth of the allegation that Defendants paid $130.00 to have someone else complete work on the Peters home. 22. Denied. Plaintiff informed Defendants John and Barbara Trindel that work on their home itself would cost $2100.00. 23. a. Denied. Plaintiff has received only $1300.00 toward compensation his work on the Trindel home. b. Denied. After reasonable investigation, Plaintiff is without knowledge or information sufficient to form a belief as to the truth of this allegation. 24. Denied. Plaintiff completed the work in accordance with the inetructions and plans of Defendants Barbara and John Trindel.
