COMPLAINT
AND NOW comes the Plaintiff, EAGLE FREIGHT-LINES, INC., by and
through his attorney, Jeanne B. Wigbels, Esquire, and respectfully
represents as follows in support of this Complaint I
1. The Plaintiff, Eagle Freight Lines, Inc., is a corporation
whose principle place of business is located at B35 Wynnewood Road,
Camp Hill, Pennsylvania, 17011.
2. The Defendant, All American Plazas, Inc., is a corporation
which provides services relating to tractor trailer maintenance and
repair from the All American Truck Plaza - Location Code 1, whose
principle place of business is located at 11Bl Harrisburg Pike,
Carlisle, Pennsylvania, 17013.
J. On or about April 29, 1996, Plaintiff's president, Earl
John Mumma, Jr., entered into a service contract with Defendant
wheceby Defendant was to check and repair as needed Plaintiff's
. tractor trailer.
4. According to the work order, attached as Exhibit A,
Defendant greased tractor, adjusted tractor and trailer brakes, and
replaced air filter.
5. The bill for services were paid in full on April 30, 1996,
and the tractor was released to Plaintiff.
6. Defendant was negligent in that it failed to properly
check Plaintiff's transmission fluid.
7. On May 21, 1996, the transmission of Plaintiff's tractor
heated up and dried out and Plaintiff's tractor and trailer were
" stranded on I-78 near Exit 17.
8. The transmission would not hav~ heated up and dried out
but for Defendant's failure to properly check and fill transmission
fluid.
9. As a direct and proximate result of Defendant's
negligence, Plaintiff's transmission was ruined and the tractor and
trailer required towing from Exit 17 of I -7 8 to C. Earl Brown,
Inc., located at 4400 Chambers Hill Road, Harrisburg, Pennsylvania,
17111, by Highspire Auto & Truck Repair Corporation. The cost of
said towing was paid by Plaintiff. A claim is made therefore.
10. As a direct and proximate result of Defendant's
negligence, Plaintiff was required to pay costs for parts and labor
for the replacement of the transmission and clutch. A claim is
made therefore.
11. As a direct and proximate result of Defendant's
negligence, Plaintiff lost revenue which would have been gained had
Plaintiff's transmission not been ruined.

5. Admitted.
6. Denied. This allegation represents a conclusion of law
to which no response is required. By way of further answer,
Plaintiff's transmission fluid level was checked aud it was at an
acceptable level.
7. Denied. After reasonable investigation, Defendant is
without knowledge or information sufficient to form a belief as to
the truth of the allegations and proof thereof is demanded.
B, Denied. The transmission fluid levels were adequate when
the vehicle was worked on on April 29, 1996.
9-11. Denied, This allegation represents a conclusion of law
to which no response is required. As to the facts alleged, after
reasonable investigation, Defendant is without knowledge or
information sufficient to form a belief as to the truth of the
allegations and proof thereof is demanded.
WHEREFORE, Defendant respectfully requests that Plaintiff's
Complaint be dismissed without cost to it.
NEW MATTER
12. The damages alleged in Plaintiff's Complaint were caused
in whole or in part by Plaintiff's own negligence, said negligence
consisting of Plaintiff's failure to inspect and/or maintain its
vehicle at regular intervals.
