6. On July 1, 1994, Defendant Fatzinger was operating a
1985 Dodge Van, License Plate No. AKB7723 Pennsylvania in a
southerly direction on Middlesex Road (T-590),
7, On July 1, 1994, William C, Fromm was operating a 1992
GMC Sierra in a westerly direction on Trindle Road (SR 641),
8, At approximately noon on July 1, 1994, Defendant
Fatzinger drove the vehicle she was operating into the path of
the vehicle driven by William Fromm,
9, The negligence, carelessness and recklessness of
Defendant Fatzinger consisted of the following:
(a) Failing to keep proper lookout for other vehicles;
(b) Failing to be attentive;
(c) Failing to operate her vehicle with proper and adequate
control;
(d) Operating her vehicle in such a manner as to cause a
collision between her vehicle and the vehicle operated by
William C. Fromm;
(e) Operating her vehicle without due regard for the
rights, safety, well-being and position of the vehicle
operated by William C, Fromm under the aforesaid
circumstances;
(f) Failing to notice the vehicle driven by William C.
Fromm;
(g) Failing to come to a complete stop at a stop sign;
(h) Failing to yield the right-of-way to oncoming traffic;

(i) Operating her vehicle in disregard of the rules of the
road, ordinances and the laws of the Commonwealth of
Pennsylvania.
10. Defendant York Union Rescue Mission,
Inc,
is
vicariously liable for the actions, including the negligent
conduct, of Defendant Fatzinger.
11, As a result of the actions or inactions of all
Defe~dants, jointly and severally, Plaintiff sustained the
following injuries some or all of which may be permanent:
(a) Injury to the neck;
(b) Injury to the lower back;
(c) Left cervical sprain;
(d) Lumbosacral sprain;
(e) Multiple abrasions;
(f) General pain, suffering and discomfort,
12, Plaintiff has been and will be deprived of his ability
to enjoy the pleasures of life.
13. Plaintiff has sustained serious and permanent injury,
for the treatment of which he has incurred medical bills and
expenses and may require further medical treatment and surgery in
the future,
14, Plaintiff has suffered an interruption of his daily
habits and pursuits to his great and permanent detriment and
loss,
