and b.tween EARL R. FEARNBAUGH, 1808 south York street,
Mechancisburg, cumberland County, Pennsylvania 17055, hareinafter
referred to as contractor, AND THOMAS W. COOK and COLLEEN B.
COOK, his wite, at 151 Lost Ballow Road, Dillsburg, York county,
Pennsylvania 17019, hereinatter referren to as owner, whereby the
former undertook and agreed to erect and construct certain
improvements and additions to an existing building on that
certain 10t at ground situate at 300 North Walnut street,
Mechanicsburg, Cumberland county, Pennsylvania 17055.
BEING the same premises which Charles J. Grams and Rhoda C.
Grams, his wite, by deed dated March 1, 1993 and recorded March
5, 1993 in the Cumberland county Recorder at Deeda ottice in Deed
Book "D", Volume 36, Page 1122, granted and conveyed unto Thomas
W. Cook and Colleen B. Cook, his wite.
NOW THEREFOR!, THIS AGREEMENT WITNESSETH I That the said
Contractor, tor and in consideration of the sum of One ($1.00)
Dollar to him in hand paid by Owner, the receipt whereof is
hereby acknowledged, and the further consideration mentioned in
the agreement aforesaid, for themselves and their subcontractors,
and all parties acting through or under them, covenant and agree
that no mechanic's liens or claims shall be filed or maintained
by them or any of them against the said buildings and the 10t of
ground appurtenant thereto for or on account of any work done or
materials furnished by them or any of them under said contract or
