Carpenter vs, Robert E, Carpenter No. 96 - 3497 civil In Divorce Dear Mr. Kayer and Mr. Shughart; By order of Court of President Judge Harold E, Sheely dated July 2, 1997, the fUll-time Master has been appointed in the above referenced divorce proceedings, A divorce complaint was filed on June 21, 1996, raising grounds for divorce of irretrievable breakdown of the marriage. No economic claims were raised in the complaint. On July 1, 1997, a petition for related claims was filed raising on behalf of the Plaintiff the economic issues of equitable distribution and counsel fees and costs. No claim for alimony has been raised. The motion for appointment of Master indicates that attorney Shughart is representing the Defendant and a certificate of service indicates that the petition for related claims was served on attorney Shughart. However, no praecipe has been filed or other documents by Mr. Shughart entering his appearance of record on behalf of the Defendant. Therefore, I request that Mr. Shughart enter his appearance if he is going to continue to represent the Defendant In accordance with P.R.C.P. 1920.33(b) I am directing each counsel to file a pre-trial statement on or before Friday, August 1, 1997. Carpenter vs. Robert E, Carpenter No. 96 - 3497 civil In Divorce Dear Mr. Kayer and Mr, carpenter: I am in receipt of a letter from attorney Dale F, Shughart, Jr. advising that he is not going to enter his appearance on behalf of Mr. carpenter but that he is going to assist him in preparing his case, According to attorney Shughart, the request for. the appointment of Master was somewhat premature and the parties have not yet assembled all of the data necessary to complete pre-trial statements. Apparently there is a great deal of debt with little in the way of assets. Mr. Shughart suggests that the directive to file pre-trial statement by August 1, 1997, will not allow the parties time to assemble the information required. Consequently, I will allow Mr. Kayer and Mr. carpenter some additional time to prepare pre-trial statements. The directive to file pre-trial statements on or before August 1, 1997, is withdrawn. Mr. Kayer, counsel for Heather A. carpenter, and Robert E. Carpenter, who is acting as his own counsel of record, are directed to each file pre-trial statements in accordance with P.R,C.P. 1920.33(b) on or before Monday, September 8, 1997. I also have a copy of Mr. Shughart's letter dated December 29, 1997, indicating that he is no longer advising Mr. Carpenter in any capacity. consequently, I am directing Mr. Kayer, as counsel for Heather A. Carpenter, and Mr. Carpenter, who apparently is still representing himself, to each file a pre-trial statement in accordance with P.R.C.P. 1920.33(b) on or before Friday, February 6, 1998. upon receipt of the pre-trial statements, I will immedately schedule a pre-hearing conference with attorney Kayer and with Mr. carpenter, if he remains unrepresented by counsel, to discuss the issues and, if necessary, schedule a hearing. Very truly yours, E, Robert Elicker, II Divorce Master 7, On or about July 1995, the Respondent separated from the Petitioner leaving many liabilities and failing to account for certain moneys she received in order to pay those liabilities, 8, Because of the excessive indebtedness of the parties which existed at the point of separation, Petitioner has been unable to hire an attorney to represent him in regard to the divorce proceedings, although Dale F, Shughart, Jr" Esquire has been assisting him, 9, Your Petitioner is in the process of pulling together information regarding the indebtedness and assets of the parties, He estimates it will take approximately 60 days until all of this information has been received, As he has accumulated this information since the divorce action was filed, Petitioner has been voluntarily submitting it to the Respondent's attorney. 10. The Respondent has not to date submitted any information to the Petitioner. 11. Unless requested information is voluntarily submitted to the Petitioner by the end of August, the Petitioner intends to submit written Interrogatories to the Respondent and quite possibly to take her deposition. 12. The Petition for Appointment of a Master in this case inaccurately stated that discovery was completed, and that an attorney had entered his appearance for the Defendant. 13. Carpenter va, Robert C, Carpenter No, 96-3497 Civil In Divorce Dear Mr, Elicker: I received your letter of July 9, You are correct, I have deliberately not entered my appearance for Mr, Carpenter in regard to the above matter and shall not do so. I am assisting Mr, carpenter in trying to work matters out with his wife by agreement, The filing of a Motion for your appointment was, in my opinion, legally premature, and certainly counterproductive. From the information I have gathered to date, all of which is being obtained by Mr. Carpenter, these people have a mountain of debts and with the exception of Mr, Carpenter's retirement, may have little in the way of net marital assets. Mr. Carpenter OWp.s me fees which he is paying little by little. I have no intention of locking myself into representing him at a Master's hearing where the only thing to be divided may be liabilities, To my knowledge, I do not believe any of the documents have been served upon Mr, Carpenter. Neither party has filed an Inventory, In fact, just last week I received money from Attorney Kayer and Mr. Carpenter to pay for all agreed upon appraisal of the value of the real eatate, I certainly hope this case will settle, From the best I can determine, neither party has assets to pay counsel fees for a fight. Perhaps you, Attorney Kayer and Mr, Carpenter could agree to postpone proceedings before you until the case is at issue, Perhaps Mr, Carpenter should file a Motion to Vacate your r- " 0 IJ ;:: '0 . ~ " Po ..~ m ,< 'Ill C '0" ! 10 -.
