26. Plaintiff has performed in a poor, improper, and
unworkmanlike manner oertain other things which were expressly or
be necessary implication required by the agreement to bo done and
performed in a proper and workmanlike manner, as followst
a. The siding which was installed was installed too
loosely;
b. The coloring of the fascia which was installed did not
match;
c. siding blew off;
d. Shingles were not installed straight;
e. Shingles blew off;
f. The aluminum work not bent and installed properly;
g. The cornerposts not installed square and plumb;
h. Siding hung too loosely and not properly interlocked;
i. Soffet not vented and installed properly;
j. Porch ceilings not correctly installed; and
k. Recessed lights installed incorrectly.
27. Plaintiff has failed and refused, and still refuses, to cure
the aforesaid breaches, despite Defendants' repeated demands.
28. The reasonable cost of remedying the aforesaid breaches is in
excess of Twenty-five Thousand Dollars ($25,000.00).

DEFENDANT'S NEW MATTER AND ANSWER TO COUNTERCLAIM
AND NOW, comes the Plaintiff, Gregory L. Whary t/d/b/a
Gregory L. Whary Roofing and Siding, by and through his
attorneys, Hanft & Vohs, to Reply to Defendant's New Matter and
Answer to Counterclaim as follows:
12. No response is required.
13. Denied. The averments in paragraph thirteen (13) are
conclusions of law to which no responsive pleading is required
and strict proof thereof is demanded at trial.
14. Denied. Plaintiff specifically denies that he has
failed and refused to complete the jobs for which he was hired.
To the contrary, Plaintiff has completed said jobs and demanded
payment from the Defendant, which Defendant has failed to pay.
15. Denied. The averments in paragraph fifteen (15) are
conclusions of law to which no responsive pleading is required
and strict proof thereof is demanded at trial.

18. Denied. On the outset, Plaintiff specifically denies
any defects. Moreover, Plaintiff specifically denies that he
refused to complete the work on the contract. To the contrary,
Plaintiff completed all of the work requested by Defendants and
even some additional work. Defendants have continued to refuse
to pay Plaintiff for the balance due for the work done at
Defendants' request.
19. Oenied. The averments in paragraph nineteen (19) are
conclusions of law to which no responsive pleading is required
and strict proof thereof is demanded at trial.
20. Denied. The averments in paragraph twenty (20) are
conclusions of law to which no responsive pleading is required

25. Denied. Plaintiff denies that he has neglected to
perform the various items listed in this Paragraph, as follows!
a. Plaintiff specifically denies that when he
completed the job, that there was wood still
exposed and left unsided;
b. As is the usual and standard custom in the
industry, as the siding contractor, it is not the
Plaintiff's duty or part of his job performance to
install trim rings. To the contrary, upon the
electricians return to do their follow-up work,
the electrician would be responsible for
installing the trim rings around the recessed
lighting, much like they would be responsible for
installing the outlet covers and switches inside
the hOUse. In this case, the electrician was
Defendant, James E. Kreitzer;
c. Denied. Plaintiff specifically denies that the
incorrect fascia was installed. To the contrary,
Plaintiff custom-bent the fascia for this house
and Defendants have never indicated any
dissatisfaction to his work relative to the
fascia;
d. Denied. Plaintiff denies that the roof fan was
never installed. To the contrary, Plaintiff did
install the roof vent fan;

a. Denied. The allegations contained in Paragraph
"e" refer to a writing not in the possession of
Plaintiff but in the possession of Defendants.
Without said writing, Plaintiff is unable to
respond to the allegations in Paragraph "e".
26. Denied. The averments in paragraph twenty-six (26) are
conclusions of law to which no responsive pleading is required
and strict proof thereof is demanded at trial. Specifically,
Plaintiff denies the following subparagraphs as follows:
a. Denied. Plaintiff specifically denies that the
siding was installed too loosely. To the
contrary, the siding Was installed in a proper
manner, as in a usual and ordinary course of
business;
b. Denied. The fascia, soffit and gutter was all
white and did match;
c. Plaintiff is without knowledge or information to
respond to the allegations in subparagraph 26(c);
d. Denied. Plaintiff installed the shingles
according to manufacturers soecifications;
e. Plaintiff is without knowledge or information to
respond to the allegations in subparagraph 26(e);
f. The allegations contained in subparagraph 26(f)
are not specific enough for the Plaintiff to
respond t.o;
g. Denied. The corner posts were installed square

and plumb;
h. Denied. 'rhe siding was properly hung and properly
interlocked;
i. Denied. The soffit was installed properly. Due
to the nature of the conatruction of the house,
the gables were vented, and therefore, this soffit
Was not to be vented;
j. Plaintiff is without knowledge or information to
respond to the allegations in subparagraph 26(j)
to the effeot that Plaintiff did not install or
build the porch ceilings for the house;
k. Plaintiff is without knowledge or information to
respond to the allegations in subparagraph 26(k)
to the effect that Plaintiff did not install the
recessed lightings and has no knowledge about the
installation of recessed lightings because he did
the siding work, not the electrician work.
27. Denied. The averments in paragraph twenty-seven (27)
are conclusions of law to which no responsive pleading is
required and strict proof thereof is demanded at trial.
28. Denied. The total contract price for the installation
of the siding did not exceed Eight Thousand Dollars ($8,000.00).
For Defendants to verify under oath that the reasonable cost of
remedying the allegations in their Counterclaim is in excess of
Twenty-five Thousand Dollars ($25,000.00) is without merit.

30. Denied. Plaintiff denies thftt he dumped garbagm and
roofing materials from other work sites on Defendants' real
property.
31. Denied. Plaintiff denies that he burned garbage and
other materials from other work sites on Defendant's real
property.
32. Denied. The averments in paragraph thirty-two (32) are

Plaintiff's house was Seven 'rhousand ($7,000.00) Dollars.
6. Oefendants accepted this bid and made payments to
Plaintiff totaling Threo Thousand Nino Hundred Forty-two and
03/100 ($3,942.03) Dollars.
7. Plaintiff purchased the siding and materials, and
completed the installation.
8. In order to correctly install the siding, Plaintiff
performed additional work at the listed cost, to wit:
a. Purchased and installed additional siding and
materials to temporarily cover two chimneys ($324.00);
b. Installed three gable louvers; and
c. Provided carpentry work to shim a portion of the
foundation at the master bedroom.
9. Upon completion of the siding, Plaintiff demanded
payment for the services provided as follows:
Total Bid $7,000.00
Payment 3,942.03
Balance on Bid 3,057.97
Additional Work 744.00
Total Due $3,801.97
10. Defendants have refuaed to pay the balance owed to the
Plaintiff for the completed work.
11. Oefendants acknowledge that the work was completed in a
satisfacto~y manner.
WHEREFORE, Plaintiff respectfully requests judgment against
