doing business as Dice Proper'ies, hy and through their attorneys, Frey and Tiley. Attorneys III
Law, and respec'fully stllles as follows:
1. Plaintiffs are Barry A. Loudon, Jeffrey L. Scott and John J, Ha'ch. all adult
individuals residing in Cumberland County, Pennsylvania, trading and doing business ss Dice
Properties, having their office and principal place of business at 25 West POl11frct Street, Carlisle.
Cumberland County, Pennsylvania.
2, Defendant is Robert Conklin, an uduh individuul of 62 West North Street, Apartment
6, Carlisle. Cumberland County, Pennsylvania.
3, Plaintiffs ure the owners of up.lrlment building und lot of ground having a mailing
address of 62 West North Street, Curlisle, Cumberland County, Pennsylvania, by virtue of a deed
from Anderson Brooks and Josephine Brooks, his wife, dated March I, 1991, and recorded
March I. 1991 in the Oflice of the Recorder of Deeds for Cumberland County,
4, On or about August 5, 1992, Pluintiffs and Defendant entered into u written lease for
a portion of the premises, being designated as Apartment number 6, owned by Plaintiffs us Slated
in paragraph 3 above. A copy of this lease is anached hereto and marked Exhibit "A" and is
incorporated herein by reference.
S. The lease provided in relevant part that Defendant was to keep the apartment in a clean
and sani'ary condilion, that ull ashes and gurbage wus 10 be removed, and that Defendant should
