Defendant Gregory S. Hall is to deliver to Plaintiff Dorothy E.
Hall those items of personal property as set forth on the attached
Exhibit "A". Mrs. Hall may pick these items up outside of the
marital residence between 9:00 a.m. and 12 :00 p.m. on Saturday,
July 13, 1996. Defendant Gregory S. Hall shall maintain possession
of all other items of personal property located in the parties
marital home at 126 South West Street, Carlisle, Pennsylvania. The
distribution of personal property pursuant to this paragraph shall
be a final disposition of personal property subject to the parties
having their personal property appraised and the relative values of
the property as maintained by each party to be appropriately
considered in the ul timate distribution of the property between the
parties in the divorce action.

residence looated at 126 South West Street, Carlisle, Pennsylvania,
whioh exolusive possession was oondi tioned upon Mr. Hall
maintaining the mortgage payment, taxes and insuranoe on the
property.

Sinoe the 'Jntry of the July 16, 1996 Order, the following
airoumstanoes have ohangedl
A. Mr. Hall was hospitalized on an in patient basis at the
Hershey Medical Center Psychiatric Unit for treatment of
depression. This hospitalization was for a period of
approximately one week.
B. Upon release from Hershey Medical Center, Mr. Hall was
physically unable to return to work and ultimately moved
in with his parents in Somers, New York and Mr. Hall has
oontinued to reside in Somers, New York since that time.
C. Mr. Hall is currently under the care of Dr. Marc Waldman
with the current diagnosis of Major Depression,
recurrent, severe with psychotic features.
D. Mr. Hall's employer went out of business and he was
advised chat he no longer has any full-time employment.
E. Mr. Hall is not physically able at this time to maintain
any type of emp.loyment.
F. Mr. Hall is not living in the marital home and does not
request exclusive possession.
G. Mr. Hall has no financ.ial wherewithall to maintain the
mortgage payment, taxes and insurance on the marital
residence.

Thereafter, the parties, through counsel, entered Into an Agraement which was entered as
a Court Order on July 16, 1996, granting exclusive possession 01 the marital home to husband and
requiring him to make the mortgage payment and pay the taxes and Insurance on the property.
Wile signed a lease lor en apsrtment In reliance upon the Agreement. Thereafter, husband
alleges that he had psychological dlfficullles requiring him to obtain a leave 01 absence Irom his
employment. Upon husband's representation that he had no Income, wile generally continued her
Petition lor Alimony Pendente LIIe, Husband stopped making payments on the marital home In
July, 1996 and has not made any payments since then, The parties have received a notice ot
loreclosure, As soon as wile learned that husband alleged he could not make the mortgage
payments, she proposed listing the house for sale, Two months later, husband accepted her offer
and in mid-November, the marital home was listed for sale,
Wife 15 a clerk at Sprint United and has monthly earnings of approximately $1,300,00.

TO MODI1i'Y EXISTING ORDER
I. BACKGROUND
The parties to this divorce action separated in June of 1996.
Defendant Gregory Hall had filed a Petition for Protection from
Abuse and had obtained a Temporary Order giving him exclusive
possession of the mari tal home at 126 West South Street. Plaintiff
Dorothy E. Hall had filed a Petition for Special Relief requesting
return of various items of personal property.
By stipulation filed with the Court, the parties agreed that
the Temporary Protection Order entered at 96 - 3460 would be
dismi/IBed, that the wife's PetitJ,on for Special Relief would be
dismissed, that certain items of personal property would be
exchanged between the parties, and that Defendant Gragory Hall
would obtain exclusive possession of the marital property. The
Court Order which was entered by stipulation stated at Paragraph 5
as follows I
The granting of exclusive possession of the marital to
Defendant Gregory S. Hall is conditioned upon Gregory S. Hall
maintaining the mortgage payment, taxes and insurance on the
property.
After the entry of said Order, Defendant Gregory S. Hall lost
his employment and underwent severe emotional and psychological
distress in conjunction with his divorce and employment situation.
He was hospitalized in the psychiatric unit of Hershey Medical
Center. For financial and heal th reasons, he moved out of the home
at 126 South West Street, Carlisle, PA. and moved in with his
parents in New York State. He is currently under the care of Dr.
Marc Waldmann, M.D. of New York, with a diagnosis of Major
Depression. Mr. Hall was again recently hospitalized in New York
for his psychological condition.
The husband's counsel indicated to wife's counsel that husband
was unable to maintain the mortgage payments and has surrendered
the exclusive possession of the marital. home. Wife's counsel
suggested that there was an obligation pursuant to the July 16,
1996 Order that the husband maintain the mortgage payments.
Husband's position is that his exclusive possession was conditioned
upon husband maintaining the mortgage payments and, upon husband's
failure or inability to maintain the mortgage payments, husband's
right of exclusive possession would be eliminated.
Before the Cour.t is husband's Petition to Modify the July 16,
1996 Order to eliminate husband's right to exclusive possession of
the marital home in light of the fact that husband has not and
cannot maintain the mortgage payments. Wife has filed a Petition
for Enforcement of a Separat.ion Agreement. That Peti tion has also

been listed for the hearing which is aohedu.led on January 15.
II. DISCUSSION
Clearly, the Court Order which waa entered by atipulat10n did
not specify that husband was required to maintain the mortgage
payments. At Paragrllph 5 of the Order, the Order specified that
the granting of exclusive possession of the marital home to the
husband was oondi tioned upon husband mair,taining the mortgage
payments, taxes and insurance. The husband is unable to meet that
condition and, therefore, the exclusive possession provision of the
Order should be eliminated. There was no l~nguage in the Order
requiring by Court Order or by agreement of the parties that the
husband was required pursuant to agreement and Order of Court to
pay all mortgage payments.
Furthermore, circumstances from July have drastically ohanged.
The husband is out of work and husband suffered a severe
psyohological breakdown which required inpatient treatment and has
subjected the husband to ongoing treatment and counselling aince
that time. Husband is financially and emotionally unable to
maintain the home and does not have any need for exclusive
possession. The Court's equity powers pursuant to 23 P.S. S3323(f)
authorizes the elimination of the Exclusive Possession Order.
Wife auggests in her Petition to Enforce Separation Agreement
that there was some specific agreement between the parties and that
such agreement is not subj ect to modification pursuant to 23 P. S.

The parties owned a home at 126 West South Street in Carlisle. The
home was sold after separation. The proceeds of the sale of the
home remain in an escrow account with Bl'oujos & Gilroy, PC with a
current balance of approximately $6,500.00. These funds are
marital assets.

Wife has investment accounts with Amoap and a Growth Fund with
balances on theses funds as of September, 1997 being $13,753.00 and
$14,933.00 respectivoly. Husband claims these are marital
property. Wife suggests that these are pre-marital assets.
Husband has requested copies of statements from the accounts d:Jring
the marriage.

Husband has three separate mutual funds with American Funds that
have a valuo of $46,294.00 and an SEP Fund with American Funds that
has a value of $3,142.00. Husband claims that these monies wer.e
pre-marital and wife requested copies of the account statements
during the term of the marriage. Husband is obtaining that
information.

Husband owned a bank account at time of separation in the amount of
$4,284.00 with Financial Trust.

Wife has a Sprint pension plan and husband has requested
information on that plan which wife has yet to furnish.

Wife had a GS Savings and Security Plan that wife caehed in. Wife
suggests the value was $2,000.00 and suggests it was a pre-marital
fund. Husband requests verification on this information and also
statements of the plan during the courae of the marriage.

Wife has a Note payable to her in the amount of $217.96 per month.

Husband suggests that he took a large portion of pre-martial assets
and used it as a downpayment on the purchase of the real estate in
Carlisle. Husband is obtaining a Hud-l for that real estate
purchase and other documentation to support this claim. Husband
believes that the amount of money involved was $20,000.00.

Husband does not anticipate any expert witnesses except,
possibility, to deal with wife's pension once that information is
provided. Husband expects the hearing in this case to last no more
than one day and, most likely, will take no more than one half day.

Husband's health is an issue in cvnnection with this case. He is
still under the care of a psychiatrist. He incurs medical bills
