YOUNG and ALESHA D, YOUNG, Defendants MORTGAGE FORECLOSURE CIVIL ACTION - LAW COMPLAINT AND NOK, comes the Plaintiff Dauphin Deposit Bank and Trust Company / Successor to Valley Bank and Trust Company / by and through its attorneys Saidis, Guido, Shuff & Hasland and respectfully avers the following: 1. Plaintiff is Dauphin Deposit Bank and Trust Company, Successor to Valley Bank and Trust Company, a Pennsylvania banking corporation organized and existing under the laws of the Commonwealth of Pennsylvania with a principal of.fice at 213 Market Street, Harrisburg, Dauphin County, Pennsylvania 17105, 2, Defendants are David L, Young and Alesha D, Young, adult individuals whose last known address is 1770 Walnut Bottom Road, Newville, Cumberland County, Pennsylvania 17241, 3, The Plaintiff brings this action to foreclose on a Mortgage dated March 23, 1992/ by and between the Plaintiff and Defendants, in the original principal amount of Forty Thousand and 00/100 Dollars ($40,000,00), a copy of which is attached hereto, made a part hereof and marked as Exhibit "A". The Mortgage is recorded in the Office of the Recorder of Deeds for Cumberland 3 County, Pennsylvania, in Record Book 1055, Page 299. There has not been any assignment of the Mortgage. 4. Pursuant to the Mortgage, the Plaintiff advanced to the Defendants the principal ~um of Forty Thousand and 00/100 Dollars ($40,000.00) . 5, The Mortgage secures and is a lien upon that certain tract ot land and the improvements thereto situate at 35 North Earl Street, Borough of Shippensburg, County of Cumberland, Pennsylvania, A copy of the iegal description of the mortgaged premises is attached to the Mortgc.ge as Exhibit "AU. The Defendants are the owners of the mortgaged premises, 6. The Defendants are in default under the terms of said Mortgage for failure to make the required monthly installment of Four Hundred Forty and 43/100 Dollars ($440,43) due on November 1, 1995, and all subsequent monthly installments. 7, Notice of Default was given to the Defendants by the Plaintiff in accordance with the provisions of the Mortgage. Copies of the Notices are attached hereto, marked as Exhibit "B". 6. The following amounts are due under the Mortgage: Principal Interest to and including June 26, 1996 Late Charges TOTAL $ 37,876,22 $ 3,192.37 ~ 123.34 $ 41,191.93 Interest continues to accrue in the amount of $12,62 per day.
