Wife acknowledges that she has been infor:med of her: r:1ght to be advised by
an ettor:ney of. her: own choosing pr:ior: to enter:1ng into this I\gr:eement and
that she voluntar:ily has decided not to r:etain such counsel, and futhe!:'
acknowledges that she accepts this I\gr:eemellt and that her: acceptance is not
based on any advice or: !:'epr:esentation mede by Husband I s counsel, Pawn S.
Sunday, Esquir:e, nor: has any such advice and/or: r:epr:esentation been given
to Wife by said attor:ney. Both per:ties agr:ee and acknowledge that they
fully under:stand the facts upon which this I\gr:eement is pr:emised and based,
that they believe this I\gr:eement to be fair and equitable, that this
I\gr:eement is being enter:ed into fr:eely and voluntar:ily by each of them, and
that the execution of this I\gr:eement is not the J:'esult of any dur:ess or
undue influence and that it is not the r:esult of any collusion or: impr:oper
or: illegal agr:eement or: agreements.
2. DI~lRE OF ASSETS. 'rhe par:ties war:r:ant that they have
given a full, complete and accur:ate disclosur:e of all Clssets, of any
natur:e, whether: or: not the assets wer:e held jointly or: in one name alone.

engage in any business, occupation, profession or employment which to her:
or: him may seem advisable. Wife and llusbf,lOd shall not molest, har:ass,
distur:b or: malign each other: or: the r:espective families ~f each other:, nor:
compel or: attempt to compel the other: to cohabit or: dwell by any means or:
in any manner: whatsoever: with her: or: him. Neither par:ty will inter:fer:e
with the use, owner:ship, enjoyment or: disposition of any property now owned
by or: hereafter: acquir:ed by the other:.
4. ~ABLE DISTRlBUTlOO.
A, Household and per:sonal Pr:operty. other: than as set for:th
hereunder in the Agr:eement, the par:ties agr:ee that the per:sonal pr:oper:ty of
the par:ties has been divided to their: mutual sati:;faction. The parties
agree that they shall retain all per:sonal proper:ty in their: r:espective
possessions end waive all r:ights to per:sonal pr:oper:ty in the possession of
the other: par:ty as of the date of executi~n of this Agr:eement.
B. Motor: Vehicles.
(l) The par:ties agr:ee that Husband shall r:atain pos.~ession
of and r:eceive as his sole and separate pr:operty the 1986 Dodge Car:avan,
along with all r:ights under: any insur:ance policy ther:eon, and the
r:esponsibility for: payment of any outstanding indebtedness per:taining

mor:tgagor:s.
(3) Upon f1usband'lI obtllining of refinllncing on the Pr:opel:'ty
in hia sole name, Husband agr:ees to pay Wife five-thousand ($5/000,00)
dollar:s, l:'epl:'esenting Wife's shar:e of the equity in the Pr:oper:ty pur:suant
to this Agr:eement,
(4) Wife agrees to execute a deed tr:ansfel:'r:ing the Proper:ty
to f1usband's sole name within ten (10) days aftor the deed is r:eceived by
Wife or: Wife's attor:ney fr:om liusband's attor:ney. The signed deed shall be
held by Husband's attor:ney until settlement on Husband's r:efinancing,
(5) In the event that Husband is unable to obtain
r:efinancing within one-hundred and twenty (l20) days of the execution date
of this Agr.eement, the Proper:ty shall be sold on the open mar:ket at a
r:easonable selling pJ:'ice. If the par:ties ar:e unable to agr:ee upon a pr:ice,
the pr:ice shall be fixed by taking the aver:age of two appr:aisals, with
Husband choosing one appr:aisal ser:vice and Wife Choosing one appr:aisal
ser:vice, the cost of said appr:aisals to be consider:ed as costs of sale.
Upon sale of the Pr:oper:ty/ Wife shall be entitled to five-thousand
($5000.00) dollar:s of the net sales pr:oceeds, exclusive of costs and sales
cOl1l1lislJions, The r:emaining net pr:oceeds fr:om the sale of the r:esidence
shall be distr:ibuted to Husband.
If either: par:ty fails or: r:efuses to
par:ticipate in the sale, the par:ties agr:ee that either: par:ty may institute
an action in equity to specifically enfor:ce the pr:ovisions her:eof or: may
take any action available to enfor:ce this pr:ovision.
D. Vacation Time Shar:e. 'i'he par:ties acknowledge that they
jointly own a one-week per: year: interest in a Split Rock Vacation Time
Share. The par:ties agr:ee to divide their: inter:est so that Wife is entitled

E. other: Assets,
(l) Wife shall r:etain as her: sole and seper:ate pr:oper:ty,
fr:ee from any dght, title, claim or: illter:est of Iluaband, any and E1ll
r:etir:ement plans/ retir:ement accounts or: benefit;s, bank accounts, cr:edit
union accounts, insur:ance policies, ond other: intangible per:eonal pr:operty
held by Wife on the date of execution her:eof.
(2) Ilusband shall r:etain as his sole and seper:ate pr:oper:ty,
fr:ee fr:om any right, title, claim or: interest of Wife, any and all
retir:ement plans, r:etir:ement accounts or: benefits, bank accounts, cr:edit
union accounts, insur:ance policies, and other: intangible per:sonal pr:oper:ty
held by Husband on the date of execution her:eof,
F. Miscellaneous Pr:oper:ty. Any and all pr:oper:ty not
specifically addressed her:ein shall be her:eafter owned by the per:ty to whom
the pr:oper:ty is titled; and if untitled, the per:ty in poasession. This
Agreement shall constitute a sufficient bill of sale to evidence a tr:ansfer:
of any and all r:ights in such pr:oper:ty fr:om each to the other:.
5. PROPERlY TO WIFE. The per:ties agr:ee that Wife shall own,
possess, and enjoy, free fr:om any claim of Ilusband, the pr:oper:ty awar:ded to
her by the ter:ms of this Agr:eement. Husband her:eby quitclaims, assigns and
conveys to Wife oIl such proper:ty, and waives and r:elinquishes any and all
r:ights ther:eto, together: with allY insur:ance policies covedng the pr:oper:ty,
and any escr:ow accounts r:elating to that pr:oper:ty. This Agr:eement shall
constitute a sufficient bill of sale to evidence the tr:ansfer: of any and
all r:ights in such pr:oper:ty fr:om Husband to WHe.
6, PROPERlY TO HUSBAND. The per:ties agr:ee that Ilusband shall
own, posseas, and enjoy, free fr:om any claim of Wife, the pr:oper:ty awar:ded
to him by the ter:ma of this Ag~eement. Wife her:eby quitclaims, assigns and
conveys to Husband all such pr:oper:ty, and waives and r:elinquishes any and
all dghts ther:eto, together: wi th any insurance policies cover:ing that
pr:oper:ty, and any escr:ow accounts r:elating to thst pr:oper:ty, Thi3
Agr:eement shall constitute a sufficient bill of sale to evidence the
tr:ansfer: of any and all r:ights in such pr:oper:ty fr:om Wife to Husband,
7. DIsrIBl1l'IOO OF LIABILITIES. Ilu.~band agr:lles to assume sole
r:esponsibility for: r:epayment of the existing madtal loan (appr:oximate
balance: $8000.00) fr:om Member:s Fir:st.

Unless other:wise pr:ovided her:ein, each par:ty her:eby assumes
the debts, encumbr:ances, taxes and liens on all the pr:oper:ty each will hold
subsequent to the date of this Agr:eement, and each par:ty agr:ees to
indemnify and hold harmless the other: par:ty and her: or: his pr:oper:ty fr:om
any claim or: liability that the other: par:ty will suffer: or: may be r:equir:ed
to pay because of such debts, encumbr:ances or: liens.
8. LIABILITY NOT LISTED. Each par:ty r:epr:esents and war:r:ants to
the other: that she or: he ha.~ not incur:r:ed any debt, obligation or: other:
liability, other: than those descr:ibed in this Agreement, on which the other:
par:ty is or: may be liable. A liability not disclosed in this Agr:eement
will be the sole r:esponsibility of the par:ty who has incur:r:ed or may
her:eafter: incur: it, and such par:ty agr:ees to pay it as the same shall
become due, and to indemnify and hold the other: par:ty and her: or: his
pr:oper:ty harmless fr:om any and all such debts, obligations and liabilities.
9. INDIlMNIFICATIOO OF WIFE. If any claim, action or: pr:oceeding
is her:eafter: initiated seeking to hold Wife liable for: the debts or:
obligations assumed by Husband under: this Agr:eement, Husband will, at his

sole expense, defend Wife againllt any such claim, action ot pr:oceeding,
whether: or: not well-found~, and indemnify her: and her: pr:oper:ty against any
damages or: loss r:osulting ther:efr:om, inclUding, but not limited to, costs
of cour:t and actual attor:neY'1l fees incur:r:ed by Wife in connection
thetewith.
10. J:NIEIlNIFlCATICIl OF HUSBAND. If any claim, action or:
ptoceeding is her.eaftet initiated seeking to hold Husband liable for: the
debts or: obligations assumed by Wife under: this Agr:eement, Wife will, at
her: sole expense, defend Ilusband against any sllch claim, action or:
pr:oceeding, whether: or: not well-founded, and indemnify him and his pr:oper:ty
against any damages or: loss r:esulting ther:eftom, inclUding, but not limited
to, costs of cour:t and actual attol:'ney' s fees incutr:ed by Ilusband in
connection ther:ewith.
11. WARRAN'lY AS TO FUl'URE OOLlGATlrn5. Wife and Husband each
r:epr:esent and war:r:ant to the other: that she or: he will not at any time in
the futur:e incur: any debt, chnr:ge or: liability for: which the other:, the
other:'s legal r:epr:esentatives, pr:oper:ty or: estate may be r:esponsible. Fr:om
the date of execution of thLs Agr:eement, each par:ty shall use only those
cr:edit catds and accounts for: which that par:ty is individually liable and
the par:ties agr:ee to cooper:ate in closing any r:emaining accounts which
pr:ovide for joint liab.i.lity. Each patty heteby agr:ees to indemnify, save
and hold the other: and his or: her: pr:oper.ty har:mless fr:om any liability,
loss, cost Ot expense whatsoever: incur:r:ed in the event of br:each her:eof.
l2. TAXES. The par:ties agr:ee that they will file separ:ate futur:e
tax r:etur:ns for: all tax obligations, and any tax obligation shall be the
r:esponsibility of the individual par:ty. Wife and Ilusband war:r:ant that
they have hetetofor:e paid all taxes on ptior: r:etur:ns including the calendar:
year: ending December.' :;l, 1995 r that they do not owe any inter:est or:
penalties thereon J and that no tax deficiency proceeding or: audit is
pending or: notice ther:oof r:eceived. Husband Ilhall <Jive Wife notice of any
doficiency assessment and Wife shsll give Husband notice of sny doficiency
assossmont of which they individually or: collectivoly become awar:e, The
per:ties agr:ee thst should it ultimstely be doter:mined that sny doficiency
and/or: penalty exIsts with r:espect to any jointly filed r:etul:'l1S, the per:ty
responsible for tho er:r:oneous pr:epar:ation and/or: non-disclosur:e of
infot1Tllltion which hss r:esulted in the deficiency and/or: penalty, shall be
solely responsible for: the payment of the amount ultimately deter:mined to
be due, together: with interest., as well as expenses that may be incur:r:ed to
contest the assessment. Should said sum.~ become due as a r:esult of
individually filed r:etur:ns, the par:ty which filed said r:etur:n shall be
solely r:esponsible for: all sums due, and shall indemnify and hold har:mless
the other: per:ty for: any payment ther:eon.
l3. SUPPCRl', ALIt<<:tff, ALIt<<:tff PENDENTE LITE. The parties agr:ee
and do her:eby waive any right or: claim they may have, both now and in the
futur:e, against the other for: alimony. alimony pendente lite and spousal
suppor:t and maintenance.
l4. MUTUAL lXlOPERATIOO, Each par:ty shall on demand execute and
deliver: to the other: any deeds, bills of sale, assignments, consents to
change of beneficiary designations, tax retur:ns, and other documents, and
shall do or: cause to be done ever:y other: act or: thing that may be necessary
or: desir:able to effectuate the pr:ovisions and pur:poses of this Agr:eement.
If either: par:ty unr:easonably fails on demand to comply with these
pr:ovisions, that per:ty Ilhall pay to the other: par:ty all attor:ney' 8 fees,
costs, and other: expenses actually incur:red as a r:esult of such failur:e.
l5, CXXl'lSEL ~'lo:Jo....q, <mrS AND EXPENS~. Each per:ty shall be
r:eaponBible for: her or his own legal fees, costs and expenses incur:r:ed in
connection with their separ:ation and/or: the dissolution of their: lIlar:dage
and the p~eper:ation and execution of this Agreement.
l6. WAIVER OF lNJlrnITANCE RIGlITS. Unless other:wise specifically
pr:ovided in this Agreement, effective upon t'le execution date, Wife and
Husband each waives all r:ights of inhedtance in the estate of the othe~,
any r:ight to elect to take against the Will or: any tr:ust of the other: o~ in
which the other: has an interest, and each of the par:ties waives any
additional ~ights which said per:ty has or: may have by reason of their:
JI1ar:riage, except the dghts saved o~ cr:eated by the terms of this
Agr:eement. This waiver: shall be constr:ued gener:ally and shall inclUde, but
not be limited to, a waiver of all dghts pr:ovided under: the laws of
Pennsylvania, or: any other: jur:isdiction, and shall include all r:ights under:
the Pennsylvania Divorce Code.
l7. WAIVER OF BmEFICIARY DESIGNATIOO, Unless other:wise
specifically set forth in this Agr:eement, each per:ty her:eto specifi<:ally
waives any and all beneficiar:y r:ights in and to any asset, benefit or: like
pr:ogr:am car:rying a beneficiar:y designation which belongs to the other: par:ty
under: the terms of this Agr:eement, inclUding, but not limited to, pensions
and r:etir:ement plans of any sor:t or: natur:e, deferr:ed compensation plans,
life insur:ance policies, annuities, stock accounts, bank accounts, final
pay checks or: any other: post-death distr:ibution scheme, and each par:ty
expr:essly states that it is her: and his intention to r:evoke by the tel:'ms of
this Agr:eement any beneficiar:y designations naming the other: which ar:e in
effect as of the date of execution of this Agr:eement. If and in the event
the other: par:ty continues to be named as beneficiary and no alter:nate
beneficiar:y iid other:wise designated, the beneUciar:y shall be deemed to 'oe
the estate of thfl c'eceased par:ty, Notwithstanding the for:egoing, however:,
in the event that either: par:ty her:eto specifically designates the other:
party aa a beneficiar:y after: the date of execution of this Agreement, then
this waiver: pr:ovision shall not ber: the party fr:om qualifying as such
beneficiaty.
lB. RELEASE OF CLA~.
A. Wife and Husband acknowledge and agr:ee that the pr:oper:ty
dispositions pr:ovided for: her:l!!in conl!ltitute an equitable distibution of
their: assets and liabilities pur:suOlnt to ~3502 of the Pennsylvania Divor:ce
Code, and Wife and Husband hereby waive any dght to division of their
pr:oper:ty except as pr:ovided for: in this Agr:eement.
B. Each par:ty her:eby absolutely and unconditionally r:eleases
and for:ever: dischar:ges the other and the estate of the other: for: all
pur:poses from any and all r:l.ghts and obligations which either: par:ty may
have or: at any time her:eafter: has for: past, pr:esent or: futur:e suppor:t or:
maintenance, alimony pendente lite, alimony, equitable distribution,
counsel fees, costs, expenses, ~nd any other r:ight or: obligation, economic
or: otherwise, whether: arising out of the mar:ital r:elationship or: otherwise,
including all r:ights and benefits under: the Pennsylvania Divor:ce Code of
19BO, its supplements and amendments, as well as under: any other: law of any
other: judsdiction, except and only except all r:ights and obligations
ar:ising under: this Agr:eement or for: the br:each of any of its pr:ovisions.
Neither: par:ty shall have any obligation to the other: not expr:essly set foth
her:ein.
C. Except as set for:th in this Agreement, each par:ty her:eby
absolutely and unconditionally r:eleases and for:ever: dischar:ges the other
and her: or: his heir:s, executor:s, administr:ator:s, assigns, pr:opcll:ty and
estate fr:om any and all r:ights, claims, demdnds or obligations ar:ising out
of or: by vir:tuEl of the mad tal r:elationship of the par:ties whethel: now
exiating or: hel:eafter: ar:ising. 'rhe above r:elease shall be affective
I:egar:dless of whether: such claims adse out of any fOl:'01er: or: futur:e acts,
contr:lIcts, engagements 01: liabilities of the other: or: by way of dower:,
cur:tesYI widow's or: widower:'s dghts, family exemption or: similal:'
allowance, or: under: the intestate laws or: the dght to take against the
spouse's will, or: the r:ight to tr:eat a lifetime conveyance by the other: aa
testamental')' or: all other: dghts of a sur:viving spouse to par:ticl.pate in a
deceased spouse's estate, whether: adsing under: the laws of Pennsylvania,
any state, ccmnonwealth, or: ter:dtor:y of the United states, or: any othel:'
countr:y.
D. Except for: the obligations of the per:ties contained in
this Agr:eement and such I:'ights as ar:e expr:essly r:eser:ved her:ein, each par:ty
gives to the other: by the execution of this Agr:eement an absolute and
unconditional r:elease and dischar:ge from all causes of action, claims,
dghts or: demands whatsoever: in law or: in equity, which either: par:ty ever:
had or: now has against the other:.
1.9. PRESERVATICN OF RECXlRDS. Each par.ty will keep and pr:esel:'ve
for: a pedod of four: (4) year:s fr:om the date of their: divor:ce decree all
financIal r:ecor:ds r:elating to the mati tal estate, and each plll:'ty will allow
the othel:' par:ty access to those r:ecor:ds in the event of tax audits.
20. CHILD ClJS'roDY.
A. Ilusband and Wife shall have shar:ed legal and physical
custody of their: Childr:en, Monica Ashley Matter: and Natasha Renee MatteI:',
both bor:n Mar:ch 4, 1989.
shall be conl3tr:ued and anforced under: the laws of the Conmonwoalth of
Pennl3ylvania in effect as of the date of oxecution of this Agr:oenlent,
26. DA'l'B OF EXOO1l'IOO. 'rho "date of execution" or: "llxecution
date" of this Agr:eoment shall be dafinod as the data upon which the pertiel3
l3igned the Agr:eement if they do so on the same date, or: if not on the same
date, then the date on which the Agr:eell1ent was l3igned by the lal3t perty to
execute thil3 Agr:eement, 'l'his Agr:eement shall becollle effective and binding
upon both parties on the execution date,
27. EFFIrr OF REXXB::ILIATIOO, OJIIJ\Brl'A'l'IOO 00 DIVORCE, This
Agreement shall r:emain in full for:ce and effect and shall not be abr:ogated
even if the par:ties effect a reconciliation, cohabit as husband and wife or:
attempt to effect a r:econciliation. This Agr:eemenc also shall continue in
