CONFESSION OF JUDGMENT
COMPLAINT
AND NOW, come the Plaintiffs, Richard W. Dutrey and
Marjorie B. Dutrey, by and through their attorneys, Fowler,
Addams, Shughart & Rundle, and make the fOllowing Complaint
against Crystal L. Zellner, the Defendant:
1. The Plaintiffs are Richard W. Dutrey and Marjorie B.
Dutrey, adult individuals residing at 504 West South streee,
Carlisle, Cumberland County, Pennsylvania.
2. The Defendant is Crystal L. Zellner, an adult individual
residing at 517 North Pitt Street, Carlisle, Cumberland County,
Pennsylvania.
3. At all times relevant hereto the Plaintiffs have been
the owners of two (2) tracts of land, together with the
improvements thereon erected, situate in the Borough of Carlisle,
Cumberland County, Pennsylvania, (hereinafter referred to as "the
Premises") which Premises are known as 517 North Pitt street and
are fully described in Exhibit "A" attached hereto and made a
part hereof.
4. On July 22, 1992, the Plaintiffs and the Defendant
entered into a written contract (hereinafter referred to as "the
Agreement") for the sale and purchase of the Premises, a true and

correct reproduction of the original of which is attached hereto
os Exhibit "B" and made a part hereof.
5. Said Agreement has not been assigned.
6. No judgment has been entered on said Agreement in this
or any other jurisdiction.
7. The Defendant entered into possession of the Premises on
July 22, 1992, and remains in possession.
8. Paragraph 13 of the Agreement provides as follows:
13. If any defauit in the payment of any monthly
install~ent of or any other obligation under this
Agreement is not made within thirty (30) days after
mailing of written notice of the same from Seller or
their representative, then the Seller may declare this
Agreement to be ended, rotaining all payments made to
that time as liquidated damages, and in such event, the
Prothonotary or any attorney of any court of record in
Cumberland County is h~reby authorized to appear for
and to confess judgment in an amicable action of
ejectment against the Purchaser, their heirs, assigns,
executors, administrators or lessees, and in favor of
the Seller, his heirs, administrators, executors,
assigns or lessees, for the Premises herein described
and to direct the immediate issuing of a writ of
possession with writ of execution for costs, without
notice and without asking leave of court, and with the
greater of five (5%) percent of the outstanding balance
or three hundred fifty ($350.00) Dollars as a reasonable
attorney fee; or at the option of the Sellrr, said
Prothonotary or attorney is authorized to confess
judgment against the purchaser and in favor of the
Seller for the unpaid balance of the purchase price,
and costs, interest, insurance, etc.
9. Said Agreement requires the payment by the Defendant to
the Plaintiffs of the sum of Three Hundred Forty-nine and 34/100
($349.34) Dollars per month on the first day of each month
commencing August 1, 1992, and on the same day of each month
thereafter until the purchase price is fully paid, and requires
the payment of a late charge in an amount equal to five (5')
percent of the overdue principal and interest ($17.47) if any
monthly payment is riot made by the end of ten (10) calendar days
after the day it is due.
10. The Defendant has defaulted in the payment of monthly
payments and other obligations of the Agreement for more than
thirty (30) days as follows:
A. The Defendant has failed to make the monthly
payments for May and June, ],996;
B. The Defendant lias late in makJ.ng the January, 1996
payment (paid in March) the February, 1996 payment (paid
in April), the March, 1996 payment (paid in May), and the
April, 1996 payment (paid in June), and has failed to pay
the late charge for said months;
C. The Defendant has failed to make the late charge
payments for the months of May and June, 1996.
11. Written notice of intention to foreclose was mailed to
the Defendant by certified mail on April 10, 1996, pursuant to
section 403(a) of the Act of January 30, 1974, P.L. 13, No.6, as
amended, 41 P.S. 5403(a), a true and correct copy of which notice
is attached hereto as Exhibit "c" and made a part hereof.
12. The sums due and owing from the Defendant to the
Plaintiffs are as follows:

13. The Defendant illl further obligated for the costs of
8uit, continuing interest on the unpaid balance at a rate of
eight (8') percent per annum, unpmid insurance, taxes and late
charges.
14. The amortization schedule prepared on behalf of the
Plaintiffs demonstrating the unpaid balance of principal and
acorued interest due and owing by the Defendant is attached
hereto ae Exhibit "0" and made a part hereof.
15. Plaintiffs demand judgment against the Defendant as
authorized in the warrant contained in the Agreement in the total
sum of $21,988.21 together wlth costs of suit, continuing
interelllt at the rata of eight (8\) percent per annum on the
unpaid balance, together with unpaid insurance, taxes and late
chargeB.
WHEREFORE, the Plaintitts domand jUdgment be entered against
the Defendant in the total sum of $21,988.21, together with costs
of Buit and oontinuing interost at the rate ?f eight (8\)
percent, unpaid taxeB, insurance and late charges.

(6) After the date of the execution of this Agreement tho
cost of any municipal improvements or assessments shall be the
responsibility of Purchoser.
(7) Purchaser shall receive possession of the premises on
the date of the execution of this Agreement.
(8) Purchaser agrees at their expense to keep the buildings
on the premises insured agoinst fire with extended coverage in a
company agreeable to Seller for a sufficient sum to cover at all
times the unpaid balance of the purchase price, said insurance to
be carried in the nallles of the parties as their interest may
appear and to ~e further endorsed to protect any creditor of
Seller for said premises.
(9) Purchaser agrees to keep the premises in a good state
of repair, and to make no substantial alterations or changes to
said premises without the prior written consent of the Seller
hereto. Purchaser shall pay all utilities due on said premises,
and shall pay the cost of all maintenance and repairs, whether
ordinary or extraordinary, during the term of this Agreement.
(0) It is specifically agreed by the parties hereto that in
the event any mortgage, jUdgment, lien or other encumbrance, is
on the premises or is placed on the premises by Seller, and
default of the same is made by Seller, Purchaser shall have the
right to pay on said obligation and receive credit for the
monthly payments thus made.

(12) If Seller has not received the full amount of any
monthly payment by the end of ten (10) calendar days after the
date it is due, Purchaser agrees to pay Q late charge to Seller
in an amount equal to five (5%) percent of the overdue principal
and interest payment.
(13) J f any default in t.he payment of any monthly
J.nstallment of or any other obligation under this Agreement is
not made within thirty (30) days after mailing of written notice
of the same from Seller or their representative, then the Seller
may declare this Agreement to be ended, retaining all payments
made to that time as liquidated damages, and in such event, the

County is hereby authorizcd to appear for and to confess judgment
in an amicable action of cjcctment against the Purchascr, their
heirs, assigns, executors, administrators or lessees, and in
favor of the Seller, his heirs, administrators, executors,
assigns or lessees, for the premises herein described and to
direct the immediate issuing of a writ of possession with writ of
execution for costs, without notice and without asking leave of
court, and with the greater of five (5%) percent of the
outstanding balance or Three Hundred Fifty ($350.00) Dollars as a

RE: Installment Agreement of Sale dated July 22, 1992,
betweon Richard W. Dutroy and Marjorie B. Dutrey,
his wife, and crystal L. Zellner, single person
NOTICE OF INTENTION TO FORECLOSE
Dear Ms. Zellner:
The above AGREEMEN'r held by my clients, Mr. and Mrs. Richard W.
Dutrey (hereinafter we, us or ours) on your property located at
517 North pitt street, Carlisle, Cumberland County, Pennsylvania,
IS IN DEFAULT because you have not mad.:! the monthly payments of
$349.34 for the months of February and March, 1996. You also
have not made the monthly payment for April which was due
April 1, 1996. Late charges have also accrued to this date in
the amount of $52.41 for the months of January through March,
1996. The total amount now required to cure this default or, in
other words, to get caught up in your payments, as of the date of
this letter is $1,100.43. After today and if the April payment
is not made, an additional late charge of $17.47 will become due.
You may cure this default within thirty (30) days of the date of
this letter, by paying to us the above amount of $1,100.43, plus
any additional monthly payments and late charges which may fall
due during the period. Such payment must be made either by cash,
cashier's check, certified check or money order, and made at the
office of Fowler, Addams, Shughart & Rundle, 28 South pitt
street, Carlisle, PA 17013.
If you do not cure the default within thirty (30) days, we intend
to exercise our right to accelerate the unpaid balance of the
purchase price. This means that whatever is owing on the
original amollnt due under your Agreement will be considered due
immediately and you may lose the chance to payoff the original
Agreement in monthly installments. If full payment of the amount
of default is not made within thirty (JO) days, we also intend to
