We have found It ever more difficult to schedule arbitration hearings by attempllng to
telephone the offices of the attomeys and arbltratof5 to obtain advance clearance of dates, Most
recently, such efforts have been extremely time consuming and gollen to the point of futile,
Accordingly, we have developed a scheduling procedure similar to that followed by the American
Arbitration Associallon.
I am enclosing for each of you calendaf5 for the months of July and August. Kindly mark
on those calendars with an "X" lhose momlngs or aftemoons when you will be unavailable to
attend the arbitration In the above referenced matter, Then, please retum the marked up
calendars to me via the enclosed preaddressed envelope, 50 that I have them by May 1, 1998.
In the event that I do not receive your calendar by that date, I will conclusively presume
that any date wfll be acceptable to you, and 5chedule the arbitration accordingly, I will attempt to

Insurance Group (See enclosed letter from The Maryland Insurance
Group dated August 30,1995. See paragraph four (4) which states,
per plllintiff 's SUbrogation specialist, Lisa A. cherry, ~Please lat
me change that, our vehicle was illegally parked.~) the word
~LEGALL'i" is a blatllnt misrepresentation of the part of the
plaintiff's attorney, Brian J. Walker, Esq. The Galli Beer truck
operator was ticketed for II I 11 egal parking. ~

again when he uses the term ~Extensi ve property damages. ~ According
to the PA State Police report, section 87, the damages to the

dent on the front of unit 1/2~.) PJAX contends that they are not
responsible for the cause of minimal, moderate, extensive or any
other damage to Plaintiff's illegally parked vehicle.

owning a 1974 tractor/trailer during September 1994, and since
there is no record of a PJAX vehicle being at the stated location,
it is therefore impossible for PJAX, its agent, servant, employee
and/or a person under their care, custody and/or control, to be
responsible for section a, b, c, d, or e under complaint section
number five (5).

located in Hopewell Township on the Pennsylvania Turnpike, did
strike and damage Plaintiff's unoccupied/legally parked vehicle

Dear Ms. Walkllr,
PlllafOe be advised that I have taken over the handling of this
subrogation claim against your company for damages to Galli Beer
Distributing Company.
As you know, our insured's truck was parked when struck by your
insured's truck, Our investigation reveals that your insured back
into our parked or standing vehicle and then left the Beene.
Please note that we have an eye witness who identifies your
vehicle, not only that it was a "Blue Mack" but that it was a PJAX
tractor as well.
Therefore, regarding item ~3 on your letter of May 1, 1995, yes we
concur that you are not the only company that owns Blue Mack's but
are the only compan~' that owns Blue Mack with the identification of
PJAX on saJ.d ~lacJ-..
With respect to item ~2, you took issue with my colleagues wording
that our insured's vehicle was legally parked. Please let me
change that, our vehicle was illegally parked. The key word is
parked, Your insured struck a parked vehicle, therefore you are
negligent for the damages to this automobile.
With respect to item ~4, wherein you indicated that the police
officer indicated that the damages to our insured's vehicle was a
"slight dent", This is from a police officer for whom I do not
know personally, I will not assume to know what a "slight dent" and
a not "slight dent" to this officer could mean. In my opinion, the
damages sustained to this tractor trailer is a slight dent as
compared the same dent on a Geo Metro. ~
