1995. At the time of her death and at all times relevant to this
Complaint, catherine M. Williams was the wife of Ronald A.
Williams.

At all relevant times, the Defendants have been the real
owners of a tract or parcel of land with buildings and other
improvements thereon located at 10 Cabin Lane, Southampton
Township, Shippensburg, Cumberland County, Pennsylvania, (the
"Premises"). The Premises are more specifically described
hereafter.

On or about October 18, 1991, in consideration of a loan of
$62,343.52, made by Plaintiff to Defendants, which funds were
received by the Defendants, they, as Borrowers, executed and
delivered to the Plaintiff, as Lender, a Promissory Note dated
october 18, 1991, (the "Note"), in the principal amount of
$62,343.52 (the "principal"), and requiring the payment of
interest on the Principal at the rate of 15.5% per year, (the
"Interest"). A true and correct copy of the Note is attached
hereto as Exhibit "A" and incorporated herein.

The Note obligates the Defendants to pay to Plaintiff the
Principal and Interest in consecutive installment payments set at
$894.00 each, (the "Installment Payments"), on the 23rd day of
each month beginning November 23, 1991, for a total of 180
payments, until the Principal and Interest are paid in full.

The payment to Plaintiff by the Defendants of, inter al~a,
the Installment Payments due under the Not~ is sQoured by a
Mortgage on the oubject Premises dated Ootober 18, 1991, (the
"Mortgage"), executed, conveyed and delivered by Defendants, as
Mortgagors, to Plaintiff, as Mortgagae. A true and oorreot oopy
of the Mortgage is attached hereto as Exhibit "B" and
inoorporated herein.

The Mortgage was duly recorded in the Office of the Recorder
of Deeds in and for Cumberland County, Pennsylvania, on Ootober
23, 1991, in Book 1032, Page 673.

The Defendants have failed or refused to pay an Installment
Payment of $688.00 due and payable on August 23, 1995 and full
Installment Payments of $894.00 due and payable on the 23rd day
of September, October, Novemeber 19951 January, February, March,
April and May, 1996, constituting defaults under the terms of the
Mortgage. The sum of these amounts is $8,734.00.

The Premises subject to the lien of the Mortgage are
described in Exhibit "C", attached hereto and incorporated
herein.

The terms of the Mortgage provide that upon the occurrence
of a default by the Defendants, the Plaintiff may accelerate and
demand immediate payment of all sums secured by the Mortgage.

Plaintitt has duly complied with the provisions of the
Emerqency Mortgage Assistance Act of 1983 ("Act 91") in that the
prescribed notice of eligibility was sent to the Defendants by
tirst-class mail on February 1, 1996. ~he temporary stay of
enforcement of the Mortgage by reason of Act 91 has expired in
that Defendant, Ronald A. Williams, was denied assistance on or
about May 9, 1996 by the Pennsylvania Housing Finance Agency.
14.
Written Notica of Intention to Foreclose, dated February 1,
1996, was sent to the Defendants pursuant to 5403(a) ot the Act
of January 30, 1974, P.L. 13, No.6, as amended, 41 P.S. 5403(a).
The appropriate time period has elapsed since the Notice of
Intention to Foreclose was served upon the Defendants. The
Defendants have nevertheless failed to cure the said defaults.
True and correct copies of the Notices which were sent by first-
class mail, as well as certified mail, are attached hereto as
Exhibit "D" and incorporated herein. A copy of the denial from

Willaims by making to Sally Williams adult Daughter of Ronald W.
Williams at 10 Cabin Lane, Shipponsburg, Cumberland County, Pennsylvania
its cotents and at the same time handing to her porsonally the said
true and attested copies of the samo.
R. Thomas Kline, Sheriff, who being duly sworn according to law,
says that he served the above REal Estate Writ Notice Poster and
Description in the fOllowing mannerl The Sheriff mailed the within
named defendants, to wit. Ron(lld W. WillIams, indivdually and as
Executor for the Estate of Catherine M. Williams a notice of the
pendency of the action by regular mail to his la6t known address at 10
Cabin Lane, Shippensburg, P<lnnsylvania 17257. This letter was mailed
under. the date of October 10, 1996 and was never returned to the
Sheriff's Office.
R. Thomas Kline, Sheriff, who being duly sworn according to
law, soys that after due and legal notice had been given according
to law, exposed the within described premises at public venue or
outcry at the Court House, Carlisle, Cumberland County, Pennsylvania
on December 4,1996 at 10.00 o'clock A.M., E.D.S.T., and sold the
same for the sum of $1.00 to At.torney Countess for Transamerican
Financial Services at B577 Haven Avenue Suite 310 Rancho Cucamonga
CA 91730, Its successors and assigns. It being highest bid and the
best price received for the same Transamerican Financial Services
at 8577 Haven Avenue Suite 310 Rancho Cucamonga CA 91730, being the
buyer in this Execution paid Sheriff R. Thomas Kline the sum of
$1,318.31 it being poundage stamps etc. Sheriff's Costs listed
