AND NOW, to wit, this,;' day of October, 1996, come
the Plaintiffs, A. Wayne Hartzell and Anne Hartzell, his
wife, by their attorney, Allen E. Hench, Esquire, file the
within reply to Defendant's "Objections of Notice of
Deposition in Aid of Execution and for Production of
Documents":
1. Defendants claim in their objection (paragraph 1)
that 1992 was "long before the relationship between
Plaintiff and Defendant ever existed." It is objected that
Defendant claims that 1992 was "long before the relationship
between Plaintiff and Defendant ever existed." The contract
between the Plaintiffs and Defendant was entered into on
April 23, 1992. Negotiations for the transfer of Glass
Reflections from Plaintiffs to Defendant began as early as
March 1992. The earliest date for the requested information
and the request for production of documents is January 1,
1992. The period of January 1 through April 22, the period
of time prior to the sale of Glass Reflections from
Plaintiffs to Defendant, is requested because it has a
bearing on Defendant's representations of his assets to
Plaintiffs which encouragod Plaintiffs to enter into the
aforementionE'd agreolllont "lith Dcf"ndants. Furthermor.e,
since Defendant initially represented himself orally and
through written documellta tion as having significant assets,
over a quarter of a million dollars in net worth, Plaintiffs
have the right to inquire as to how Defendant disposed of
his wealth.
2. In swoJ:'n testimony taken at his deposition of
SeptembeJ:' II, 1996, whon asked about a statement of his net
worth that he prepaJ:'ed for Plaintiffs prior to purchasing
Glass Reflections, Defendant admitted that the method that
he used to BJ:'J:'ive at UHJ nlJmben; for his net worth was,

'thar-afore, never had on admisoion from the Defendant that
Plaintiffs did not hove all of Defendant' fl financial
information, Plaintiffs are requesting information
regarding Defendant's net worth at the time of the sale of
G1IIss Reflections to help determine how Defendant disposed
of his assets since that time.
3. "he l'e'~uested infor/llution to \'Ihirh Defendant
objects in his poraur,Jph ~ is Lnfor/lliltion regarding
Defendant's financial hual th for' thu untiro period
requested: January 1, 199~ to present. The financial
disclosure provided undor Court Order te which Defendant
referred only provides thu financial health of the Dafendant
on the particular day that the docu/llent was signed, August
2, 1996. Plaintiffs requost information covering all
transactions for tho time period f rO/ll January 1, 1992 to
August 1, 1996, and from August 3, 1996 to present.
Further, Defendant continually changes, al ters, or corrects
Defendant's prior information and this instant request gives
Defendant another opportunity to ratify (or correct)
previously suppl.ied infonnatlon.
4. Much of the ruquested docu/llentation is
documentation which tho Dofendunt .should have readily
available. Defendant tihould, therefore, /IIake a good faith
effort to at least partially comply with the Req~est for
Production of Documents by providing copies of those
documents which are in foct readily available to Defendant.
5. Plaintiffs acknowledge that the dote of the
Agreement for the sale cf Glass Reflections was April 23,
1992, but Plaintiffs ilre ilskin(J for- information back to
January 1, 1992 becautie Plaintiffs believe that much of the
requested information may be on year-end documents ending
December 31, 1991 or [J('lcember 31, 1992 and would be easier
for Defendant to fLnd "n<l produce.
6. One of the obj ect ions (paragraph 3) was that there
was only sill (6) daYE; notice to produce the documentation.
As of the date of this reply, the request was made over
thirty (30) days ago, more than ample time for Defendant to
produce the requested documents. Defendant has yet to
produce any of the documents I'oquested. Surely Defendant
has ready access to bill\k statements, financial records, tax

beth B. Stone, Esquire, who motions the Court for a continuanoe of the
Sheriff's sale scheduled for November 25, 1996, and in support thereof
relates as followsl
1. The parties above-captioned herein are involved in litigation
involving a business venture.
2. The petitioner herein is a named co-defendant in a separate
action docketed to 96-5343 Equity Term.
3. The plaintiff in this action confessed judgment against the
defendant above-named and filed a writ of execution and/or attachment
on September 13, 1996.
4. The de fondant resided at 3604 Golfview Drive where the
plaintiff also has placed a lien to stall the sale of his home.
5. The plaintiff provided false information to the sheriff and
allowed him to enter the home of someone who is not connected to this
lawsuit. The defendant does not own 2331 Chestnut Street, reside

there, or store any of his personal belongings there. Separate
tenants rent both the first floor, and the seoond floor apartments.
5. The plaintiff hae erroneously attaohed property belonging to
petitioner herein at her home looated at 2331 Chestnut Street, Camp
Hill, Pennsylvania. Nothing in 2331 Chestnut Street belongs to
defendant.
6. The petitioner is ourrently out of the oountry in her home.

8. It is averred that petitioner may not have adequate time with

possessions looated at 2331 Chestnut street if the sale goes forward
as scheduled.

not a named party in this matter, by and through her attorney, Eliza-
beth B. Stone, Esquire, who motions the Court to quash the Sheriff's
Levy and Sale scheduled for November 25, 1996, and in oupport thereof
averB ae folloWBI
1. The parties above-captioned herein are involved in litigation
involving a businesB venture.
2. The petitioner herein iB a named co-defendant in a separate
action docketed to 96-5343 Equity Term.
3. The plaintiff in this action confeBBed judgment against the
defendant above-named and filed a writ of execution and/or attachment
011 September 13, 1996, liBting two addreBsesl 3604 Golfview Drive,
Mechanicsburg, PA, and 2331 CheBtnut Street, Camp Hill, PA, and any
other location. Please Bee copy of Writ of Execution and/or Attach-
ment attached hereto and made a part hereof and marked Exhibit "A".

4. The defendant currently receivel mail at 3604 Golfview Drive
which il currently on the market to be lold. The plaintiff allo has
placed a lien on that property to stall a prospective Bale and refuses
to allow the sale to go forward even though the money could be placed
in escrow.
5. It is alleged that the plaintiff improperly uBed his
realtor's lock box key, illegally entered the premiseB located at 3604
Golfview Drive sometime prior to September, 1996, and made his own
list of items that he wished to attach. The plaintiff was never an
invitee into the home of the defendant and therefore could not have
obtained the attached list any other way than through Bubterfuge and
deceit. Please see list attached hereto and made a part hereof and
marked Exhibit "B".
6. It is alleged that the plaintiff provided false information
to the sheriff by listing petitioner'S address at 2331 Chestnut Stroet
as the defendant's second address, thus enabling the sheriff to enter
the home in which the deed is in the petitioner'S name, the home of
someone who is not connected to this lawsuit.
7. The petitioner rents the first and second floor apartments to
separate tenants. It is their belongings as well as the petitioner'S
that the sheriff has illegally attached and scheduled to sell based on
the false and misleading representations provided by plaintiff.
8. The tenanta who live at 2331 Chestnut Street neither expected
nor invited the Sheriff into their home on November 6, 1996, at

2125 p.m. In fact, when the aheriff broke into the home, he aurpria.d
and terrified the petitioner' a daughter who waa naked in the ahower.
9. Bntry by the aheriff is only permitted if the aheriff ia
there to remove the already levied upon property. The eheriff was
there to attach the levy, therefore hie entry is both unlawful and an
abu.e of power. Pa.R.C.P. 3127 specifically states that "the sheriff,
atter baving levied upon or attacbed any personal property, may enter
the place or building in which the goods are contained either peace-
ably or by breaking in by foroe, for the purpose of taking manual
possession of or melling the property levied upon or attached."
10. The defendant doee not own, reside, or store any of his
personal belongings at 2331 Cheotnut Street, Camp Hill, PA,
11. The sheriff has illegally attached property belonging to
petitioner herein at her home located at 2331 Chestnut Street, Camp
Hill, Pennsylvania. Nothing in 2331 Chestnut Street belongs to
defendant.
12. The petitioner ls currently out of the country in her home-
land of Iceland and will not be arriving prior to the scheduled
Sheriff's sale.
13. Counsel for the petitionor ie attempting to secure a timely
~roof of claim and affidavit from petitioner while she is out of the
country.
14. Undersigned counsel has filed a continuance of this matter
in conjunction with this motion.

MOTION FOR CONTINUANCE
AND NOK, this.2.2"d day of November, 1996, comes Gudlaug OlafBson,
not a named party in this matter, by and through her attorney, Eliza-
beth B. stone, Esquire, who motione the Court for a continuance and
requests an exteneion of time in which to file an answer to
Plaintiff's First Amended Complaint, and in support thereof avers as
follows:
1. Petitioner herein is a resident and citizen of Iceland.
2. The parties above-captioned herein are involved in litigation
involving a failed business venture.
3. Petitioner has been named as a co-defendant because she was
also a holder on a promissory note against the co-defendant.
4. The plaintiff filed a complaint to the above docket and
attempted to serve the petitioner contrary to the Pennsylvania Rules
of Civil Procadure via regular United States mail.

5. Plaintiff then filed a First Amended Complaint at the request
of the co-defendant's counsel becaulle of the confusing and convoluted
nature of the first complaint.
6. Plain~iff, once again, attempted to serve the petitioner via
United states mail at her daughter's residence by regular postal
delivery contrary to the Pa.R.C.P. 402.
7. Undersigned counsel became aware of the existence of the
First Amended Complaint when it was hand delivered to her office by
one of her client's children.
8. Plaintiff apparently served co-defendant's counsel with a
ten-day notice to enter default judgment for failure to timely answer
the First Amended Complaint even in light of agreed upon continuances.
9. It is averred that neither undersigned counsel nor her client
ever received this notice. The petitioner has never been properly
served with notices pursuant to and in accordance with tha Pennsylva-
nia Rules of Civil Procedure.
10. Plaintiff filed for and received a Default Judgment against
both named co-defendants on November 19, 1996 entered by the
Prothonotary, jUDt 13 minutes after the ten day notice period had run.
11. Counsel for both defendants joined in a Petition to Open
Def~ult Judgment filed in conjunction with this motion for continu-
ance.
12. It is averred that undersigned counsel has spoken with Anna
Marie Sossong, Esquire and she is not opposed to this request for an
extension of time with which to file an answer.

AND NOW, this 26th day of November, 1996, comes Elizabeth B. Stone,
Esquire, attorney for Gudlaug B. Olafsson/movant and moves this Court to
make the rule entered on November 12, 1996, absolute as against the
plaintiffs and to enter an order quashing the Sheriff's Levy and Sale in
the above-captioned matter and further order that Sheriff of Cumberland
County therefore be permitted to discontinue the sale that was scheduled
for November 25, 1996, and stayed pursuant to the movant filing a Proof
of Claim on November 22, 1996. The ru1a was returnable within five days
of service. Servic~ was mads on the plaintiffs by the Court with a
certified copy of the petition and rule to the plaintiffs by First Class
Mail, November 13, 1996. Movant certifies that no party has returned
the rule or otherwise answered movant's petition within the required
five day period. The plaintiff filed and the Prothonotary docketed said
answer on November 25, 1996, at 3122 p.m., seven days after the
specified time in the Rule.

5. Thereafter, in accordance with the bankruptcy
order, Glass Reflections, Inc. turned over oertain secured
property and equipment to the Hartzells.
6. Defendant in the above-captioned case, Gudjon
Olafsson, is the principal and owner of Glass Reflections, Inc.
7. Gudjon olafsson is personally liable for the debt
of Glass Reflections, Inc. to the Hartzells and accordingly, a
judgment was entered ngainst him in the above-captioned case in
the amount of $155,504.44.
e. Gudjon Olafsson is now seeking discovery from the
Hartzell's bankruptcy attorney, Dino A. Ross, concerning the
secured property and equipment which was turned over to the
Hartzells pursuant to bankruptcy order.
9. Specifically, Gudjon Olafsson, through his
attorneys Skarlatos & Zonarich, served a subpoena on Dino A. Ross,
a true and correct copy of which is attached hereto as Exhibit
"A", requesting that he bring/send the following documents to
Skarlatos & Zonarich, 204 State Street, on March 24, 1997 at 5tOO
p.m. t
a. All documents relating to all inventory taken by A.
Wayne Hartzell from Glass Reflections and Gudjon Olafsson pursuant
to the terms of the Security Agreement.
b. List of the proceeds received from the sale of any
or all of the items in number 2(a) above.
c. Copies of any information relating to the
application of money received either from Glass Reflections,

Gudjon Olafsson or the sale of items in number 2(a) above on the
principal balance remaining outstanding.
d. Valuations given to any items received under
item number 2(a) above whether the items were sold to another or
were retained by the secured party.
10. The discovery sought by Defendant is unreasonably
annoying, embarrassing, oppressive, burdensome and expensive
because the discovery that Defendant now seeks from Dino A. Ross,
the Hartzells' attorney, has already been provided by the
Hartzells in the above-captioned matter. Attached hereto and
incorporated by this reference as Exhibit "B", are the true and
correct copies of the Hartzell's Answers to Defendant's
Interrogatories and documents provided pursuant to those Answers.
11. If Defendant was not satisfied with the
aforementioned answers to interrogatories, his remedy was to file
a motion to compel the Hartzells to answer the interrogatories and
not to seek discovery from the Hartzell's attorney. ~ Pa,
R.C.P. No. 4019.
12. The discovery sought by Defendant from Dino A.
Ross, the Hartzell's attorney, seeks information and documents
which are subject to the attorney-client privilege and therefore,
such discovery should be prohibited.
13. The discovery sought by Defendant from Dino A.
Rosa, the Hartzell's attorney, seeks information and documents
which are the work product of an attorney and therefor, such
discovery should be prohibited.
