The Plaintiffs are Mary Ann Vandulek and Paul Vandulek, adult individuals residing at 190 Lisbon Avenue, S.E., Rio Rancho, NY 87124. 2. The Defendant is Interstate Motor Lodge, Inc., trading as Howard Johnson's Motor Lodge, 1255 Harrisburg Pike, Carlisle, Cumberland county, PA 17013. 3. Over the night of August 18, 1995 the Plaintiff, Mary Ann Vandulek, was a guest at the Defendant's motel. 4. As she was leaving the motel on August 19, 1995 through the rear door marked "E" to the parking lot, she fell and sustained the injuries hereinafter set forth. 5. The Plaintiff's fall was caused by the negligence and carelessness of the Defendant in: A. Maintaining the exit with a step down at the door. B. Failing to adequately warn or alert invitees of this unusual and dangerous condition. COUNT I MARY ANN VANDULEK v. DEFENDANT 6. Due to the negligence and carolessness of the Defendant, the Plaintiff sustained 4 contusion of her back, and a sprain and strain of her back, which caused her to develop pneumonia which resulted in her hospitalization from September 1 through September 3, 1995 in Olean, New York. 7. The Plaintiff continues to receive medical and chiropractic care as a result of her injuries and will need said care in the future. 8. The Plal.ntiff was unable to work and absent from her employment from September 4 to september 25, 1995 reSUlting in a 10S8 of wages in the amount of $533.55. 9. The Plaintiff sustained severe mental and physical pain and SUffering and will continue to undergo same in the future. WHEREFORE, the Plaintiff demands judgment against the Defendant for an amount in excess of $25,000 plus interest and costs of Buit. COUNT II PAUL VANDULEK v. DEFENDANT 10.
