O~t4 -/~ Term, 2002 WHEREAS, Krestu Tsenoff of Cumberland County, Pennsylvania (herein "Owner") is about to execute contemporaneously herewith, a contract, with Paramount Development Company of Cumberland County, Permsylvania (herein "Contractor"), for the construction work on a building upon 1941 Monterey Road, Hamden Township, Cumberland County, Pennsylvania, more particularly set forth on Exhibit "A" attached hereto and made a part hereof. NOW, September 24, 2002, at the time of and immediately before the execution of the principal contract, and before any authority has been given by said Owner to the said Contractor to commence work on the said building, or purchase materials for the same in consideration of the making of the said contract with Owner and the further consideration of One ($1.00) Dollar in hand paid to Contractor by Owner it is agreed that no lien shall be filed against the building by the Contractor, or any sub-contractor, nor by any of the material-men or workmen or any other person for any labor, or materials purchased, or extra labor or materials purchased for the erection of said building, the right to file such liens being expressly waived. CONTRACTOR: Paramount Development Company SCHEDULE C ALLTHAT CERTAIN tract of land situate in Hampden Township, Cumberland County, Pennsylvania, being Lot No. 5 as shown on the Plan entitled Pinehurst Final Subdivision Plan Phase IVB, dated August 22, 1996, and recorded in Cumberland County Plan Book 73, Page 66, more particularly bounded and described as follows: BEGINNING at an iron pin, lying in a westerly right-of-way line of Monterey Drive (50-foot right-of-way) and being a northerly corner of Lot No. 6; thence along Lot No. 6, South 82 degrees 47 minutes 44 seconds West, 199.54 feet to an iron pin, being a westerly corner of Lot No. 6 and lying in an eastedy line of lands now or formerly of Chalmer L. and Mary C. Chamberlin; thence along said lands, North 04 degrees 16 minutes 53 seconds West, 190.89 feet to an iron pin, lying in said line and being a southerly corner of Lot No. 4; thence along Lot No. 4, North 82 degrees 47 minutes 44 seconds East, 189.80 feet to an iron pin, being an easterly corner of Lot No. 4 and lying in a westerly right-of-way line of Monterey Drive; thence along said right-of-way, South 07 degrees 12 minutes 16 seconds East, 190.64 feet to an iron pin, being the place of BEGINNING. BEING known and numbered as 1941 Monterey Drive. Lot No. 5 is subject to a wetland area, being bounded and described as follows: BEGINNING at an iron pin, lying in a westedy corner of Lot No. 6, lying in an easterly line of lands now or formerly of Chamberlin, and being a southerly corner of Lot No. 5; thence along Lot No. 5. North 04 degrees 16 minutes 53 seconds West, 65.41 feet to a concrete monument lying in said line; thence traversing through Lot No. 5, South 20 degrees 13 minutes 41 seconds East, 18.13 feet to a concrete monument; thence South 40 degrees 40 minutes 23 seconds East, 46.89 feet to a concrete monument; thence North 61 degrees 06 minutes 18 seconds East, 86.48 feet to a concrete monument; thence North 66 degrees 02 minutes 47 seconds East, 70.67 feet to a concrete monument; thence South 07 degrees 19 minutes 40 seconds East, 60.88 feet to a concrete monument, lying in a southerly line of Lot No. 5 and lying in a northerly tine of Lot NO. 6; thence along said line, South 82 degrees 47 minutes 44 seconds East, 181.44 feet to an iron pin, being the place of BEGINNING. BEING part of the same premises which Pamay Development Co. inc. by Corrective Deed dated and recorded February 8, 1989, in the Office of the Recorder of Deeds in and for Cumberland County, Pennsylvania, in Deed Book U-33, Page 544, granted and conveyed unto Pamay Development Co., Inc., in fee.
