STIPULATION A~AINST LIENS
THIS A~F~ENT made this \~%h day of
between NAUBE~T HOMES, iNC., a Pennsylvania
hereina£ter referred to as Contractor,
2002, by and
Corporation.,
RYAN B. CABOOT AND BARBARA L. CABOOT, husband and wife,
hereinafter referred to as Owners, whereby the contractor
undertook and agreed to erected and construct a dwelling on the
certain lot of ground situate in C%umberland Cowry, Commonwealth
of Pennsylvania, and more fully described in Exhibit "A" which is
attached hereto and made a par~ hereof known as Lot #45 Cobble
Court, New C%zm~erland, PA 17007.
NOW THEREFORE, THIS A~REEMENT WITNESSETH: That the said
Contractor, for an in consideration of the sum of ($1.00) Dollar
to Contractor in hand paid by Owner, the receipt whereof is hereby
acknowledged, and the further consideration mentioned ~n the
agreement aforesaid, for itself, himself or themselves and its,
his or their subcontractors, and all parties acting through or
under them, covenant and agree that no mechanic's liens or claims
shall be filed or maintained by them or any of them again.at the
said buildi~&Js and the lot of ground appurtenant thereto for or on
account of any work done or materials furnished by them or any of
them ~der said contract or otherwise, for, towards, in, or about
the erection and construction of the said buildings on t.he lot
above described, and the said Contractor, for itself, himself or
themselves, its, his or their subcontractors and others under
them, hereby expressly waive and relinquish the right to have,
file, and maintain any mechanic's liens or claims against the said
buildings or a~y of them, and agree that this instrument, waiving
the right of lien, shall be an independent covenant.

ALL that certain tract or parcel of land being situate in Lower Allen Township,
Cumberland Count3', Pennsylvania, more particularly bounded and described as
follows, to wit:

BEGINNING at a point on the western right of way line of Cobble Court, a 40 foot
wide street, said point being the southern corner of Lot No. 44; thence along said
right of way line along a curve to the left having a radius of 50.00 and an arc len~h
of 39.27 feet, said arc being subtended by a chord of South 21 degrees 09 minutes 24
seconds West, a distance of 38.27 feet to a point, said point being the northeastern
corner of Lot No.. 46; thence along the northern line of Lot No. 46, South 88 degrees
39 minutes 24 seconds W'est, a distance of 167.49 feet to a point, said point being the
northwestern corner of Lot No. 46; thence along the southeastern line of Lot No. 63,
Open Space, North 43 degrees 39 minutes 24 seconds East, a distance of 153.79 feet
to a point, said point being the western corner of Lot No. 44; thence along the
southwestern line of Lot No.. 44, South 46 degrees 20 minutes 36 seconds East, a
distance of 103.79 feet to the point and place of BEGINNING.
BEING Lot No. 45 on the Final Subdivision Plan of the Heights of Beacon Hill,
Phase I, prepared by Melham Associates, P.C. and recorded in the Office of the
Recorder of Deeds in and for Cumberland County., Pennsylvania in Plan Book 75,
page 3.
