It is specifically denied that Defendant drove at an excessive rate of speed for traffic conditione. B. It is specifically denied that Defendant failed to keep watch of the road so that Defendant could avoid other vehicles in his lane of traffic. C. It is ~pecifically denied that Defendant failed to control his truck to prevent it fronl colliding with the Plaintiff's vehicle and with another vehicle at a location just north of the Plaintiff's location on Route 11. D, It is ~pecifically denied that Defendant drifted, wove, or crossed into opposite lane of travel. It is also specifically denied that Defendant failed to apply brakes prior to collision, 7. Defendant is without information or belief as to the truth of the averments contained in Paragraph 7, hence they are denied and proof thereof is demanded at time of trial. WHEREFORE, Defendant, Raymond D. Scott, demands judgment in his favor and against Plaintiff. NEW MATTBR 8. Paragraphs 1 through 7 of this Answer are incorporated herein by reference, 9. Plaintiff's action may be barred by the applicable statute of limitations. -2- 10. Plaintiff fails to state a claim upon which relief can be granted. 11. Plaintiff's claim may be barred by Pennsylvania's Comparative Negligence Act and/or Plaintiff's own contributory negligence. 12. Plaintiff's injuries and/or damages, if any, were caused by the negligence, carelessness and/or recklessness of a party other than named Defendant herein. 13. Plaintiff's claims are barred or limited by virtue of the provisions of the Motor Vehicle Financial Responsibility Law, 75 Pa.C.S.A. S 1701 et seq" and particularly the provision and effect at the time of the above-mentioned accident precluding the pleading, proving and recovering of required benefits pursuant to former 75 Pa.C.S.A.
