DIVORCE
II. Upon payment of such sum stated in paragraph 2, wife will Immediately execute
the Affidavit of Consent and Waiver of Notice so that a divorce can be timely finalized.
12. Husband and wife represent 10 each other that neither of them has created any
debt, or obligations that would bind the olher and that each will indemnify and hold the other
harmless from all debts and obligations incurred by the other prior to or after this date except
as otherwise specified in this agreement.
13. The parties intend for this Agreement to CQnstitute a binding contract and this
Agreement will not merge with the Divorce Decree. This Agreement constitutes the entire
understanding between the parties and supersedes any and all prior agreements and negotiations
between them,
14. Each party discharges the other party from any and all civil claims, demands,
damages, actions, or suits at law or in equity, of whatsoever kind of nature, for any malter done
or omitted by said party prior to and including the dale hereof; except that this release shall in
no way discharge the other party from the obligations made and imposed by reason of this
Agreement.
REMEDIES
IS. In the event that either party breaches any provision of this agreement, the other
party shall have the right, at his or her election, to sue for damages for such breach, and seek

Kindly transmit the record, together with the following
information, to the Court for entry of a divorce decree I
1. The ground for divorce is irretrievahle hreakdown under
Section 3301 (c) of the Divorce Code.
2. The Complaint was filed on July 11, 1996.
3. Date and manner of Service of the Complaint' July 24,
1996 hy Acceptance of Service of Marcus A. McKnight, III, counsel
for Defendant, Cynthia D. Johnson,
4. The Plaintiff's Affidavit of Consent was executed by
the Plaintiff on March 1, 1997, and filed on March 3, 1997, The
Defendant's Affidavit of Consent was executed on March 1, 1997,
and filed on March 3, 1997.
5. Plaintiff executed a Waiver of Notice of Intention to
Request Entry of a Divorce Decree under 3301 (c) of the Divorce
Code on March 1, 1997, and said waiver was filed on March 3,
1997. Defendant executed a Waiver of Notice of Intention to

Plaintiff is Donald C. Johnson, an adult

2. Defendant is cynthia D. Johnson, an adult individual
carlisle,
currently residing at 165 East High street, Apartment 1,
Carlisle, Cumberland County, Pennsylvania.
3. Plaintiff is a bona fide resident of the commonwealth of
Pennsylvania and has heen so for at least six months immediately
previous to the filing of this complaint.
4. Plaintiff and Defendant were married on August 21,
1992, in Hagerstown, Washington county, Maryland.
5. There have been no prior actions for divoroe or
annulment between the parties.
6. The Defendant is not a member of the Armed Forces of
the United States of America or its Allies.
7. Plaintiff has been advised of the availab~lity of
