~ND NOW, this 23rd day of August, 1996, following
the hearing on the petition of Susan Weller to hold Gregory
Anderson in contempt, the rule entered on August 13, 1996 is
made absolute. Final adjudication shall be held in Courtroom
Number 2, Cumberland county courthouse, Carlisle, Pennsylvania
at 9100 a.m., Friday, August 30, 1996. Defendant is ordered and
directed to appear at said hearing. Failure to appear will
result in a bench warranl to be issued for his production in
court.
The Sheriff shall serve a copy of this order
against Defendant whose home address is 4191 Gettysburg Road
122, Camp Hill, PA, and whose work shift is 11 a.m. to 6 p.m. at
National Rx Services, in Lower Allen Township.

PETITION FOR ADDITIONAL SUPPLEMENTAL RELIEF
IN AID OF EXECUTION PURSUANT TO
RULE 3118
AND NOW COMES, the Plaintitt, Susan Weller, by and through
her attorney, Gregory J. Katshir, Esquire, with the tollowing
Petition tor Supplemental Reliet in Aid ot Execution and avers as
foLlows I
1. Plaintitt is an adult individual who resides in Adams
County, Pennsylvania.
2. Detendant is an adult individual who resides at 4191
Gettysburg Road, #22, Camp /lill, Cumberland County, Pennsylvania.
3. On July 12, 1996 a Judgment was entered in the Court of
Common Pleas ot Cumberland County in tavor ot Plaintitf and
against Detendant in the amount ot $8,088.50.
4. On July 25, 1996, this Honorable Court issued an Order of
Court that ordered that:
1) Detendant is enjoined trom transferring, discarding or
destroying plaintitt's personalty in his possession as is listed
in Exhibit A.
2) Detendant is directed to return such personalty to
plaintiff within three (3) days after service of this order or
file a petition within that time frame tor a hearing. (See
attached copy ot Order ot Court).
5. Pursuant to Cumberland County local Rules of civil
Procedure, envelopes were provided to the Prothonotary for
service of the Order and said Order was served upon Defendant and
counsel tor Plaintitt. Said Orders are believed to have been
served on July 26, 1996. Counsel tor Plaintitt received the
Order on July 29, 1996 from the Prothonotary.
6. As of August 8, 1996, Defendant has refused to return the
personalty or file a petition for a hearing as was ordered by
this Honorable Court. Defendant has violated the July 25, 1996
Order Of Court by refusing to take any action.
10. The actions of Defendant will materially pr.ejudice the
Plaintiff and the Plaintiff's rights to enforce her judgment
against Defendant.
11. Defendant would not be prejudiced if this Honorable
Court were to Order the return of such property in that Defendant
has no possessory interest in said property.
12. Defendant's actions amount to obdurate, vexatious, and
dilatory and contemptuous conduct to which counsel fees are
warranted for the preparation and prosecution of this matter.
13. Time is of the essence in this matter as it is b~lieved
that Defendant may destroy or discard Plaintiff's personalty to
avoid the debt. Defendant has already refused Plaintiff access
to her personalty. It is believed that Defendant does not have
any other assets within which to satisfy the judgment.
WHEREFORE, Plaintiff respectfully requests this Honorable
Court to issue an Order of Court pursuant to Pennsylvania RUles
of civil Procedure 3118:
1. Adjudicating Defendant to be in contempt of the July 25,
1996 Order of Court,
2. Directing the Sheriff of Cumberland county to obtain such
personalty,
3. Directing Defendant to pay reasonable counsel fees and
any and all costs of attachment,
4. To grant such other relief as may be deemed necessary and
appropriate under the circumstances.

PETITION FOR SUPPLEMENTAL RELIEF
IN AID OF EXECUTION PURSUANT TO
RULI.-: 3118
AND NOW COMES, the Pla1nt1ff, SUBan Weller, by and through
her attorney, Gregory J. Katsh1r, Esqu1re, w1th the following
Petition for Supplemental Relief 1n Aid of Execution and avers as
follows:
1. Plaintiff 1S an adult ind1vidual who resides in Adams
County, Pennsylvania.
2. Defendant is an adult ind1v1dual who resides at 4191
Gettysburg Road, '22, Camp Hill, Cumberland County, Pennsylvania.
3. On July 12, 1996 a Judgment was entered in the Court of
Common Pleas of Cumberland County in favor of Plaintiff and
against Defendant in the amount of $8,088.50.
4. On July 17, 1996, Plaintiff caused the Prothonotary to
issue Writs of Execution addressed to the Sheriff of Cumberland
County and Harris Savings Bank as garnishee.
5. It is believed that any amount of monies held by Harris
Savings Bank will not enough to satisfy the full amount of the
judgment.
6. This action arose out of a problem after the parties
ceased cohabiting. The parties were never married.
7. Defendant has retained many items of personalty of
Plaintiff and has refused to return such items. It is believed
that Defendant may attempt to either d1scard of or destroy such
items. Defendant has no possessory interest in Plaintiff's
personalty. (See attached list of personalty identified as
"Exhibit A"). The judgmellt is, in part, based upon the value of
Plaintiff's personalty in Defendant's possession. The value
placed upon the items is $5,678.21.
8. Defendant had indlcated to Plaintiff that she could ccme
to his home to obtain her personalty. However, when Plaintiff
arrived on the scheduled date, Defendant refused to permit h.r to
enter the home.
9. Defendant has indlcated to counsel for Plalntiff that he
will dispose of all of hl,S possessions and fHe a Peti'ClOn for
Bankruptcy in an attempt to avold paYlng the Plalntiff the amount
of the jUdgment.
10. 'l'he actlons of Defendant wlll matenaUy preJudlce the
Plaintiff and the Plaintiff's rights to enforce her JUdgment
against DefenQant.
11. Defendant would not be preJudlced lf thiS Honorable
Court were to Order the return of such property in that Defendant
has no possessory lnterest in sald property.
12. Defendant's actlons amount to obdurate, vexatlous, and
dilatory conduct to WhlCh counsel fees are warranted for the
preparation and prosecut1on of thls matter.
13. 'rime 1S of the essence in thls matter as 1 t is believed
that Defendant may destroy or discard Plaint1ff's personalty to
avoid the debt. Defendant has already refused Pla1ntlff access
to her personalty. It lS belleved that Defendant does not have
any other assets w1thin WhlCh to sat1sfy the Judgment.
WHEREFORE, Plaintiff respectfully requests this Honorable
Court to lssue an Order of Court pursuant to Pennsylvanla RUles
of CiVil Procedure 3118:
1. Enjoining Defendant from transferr1ng, dlscardlng or
destroying Plaintlff's personalty ln hiS possess1on, as is llsted
in Exhibit AI
2. Directing Defendant to immed1ately return such
personalty, or in the alternatlve d1recting the Sherlff of
Cumberland county to obtain such personalty;
3. Directlng Defendant to pay reasonable counsel fees and
any and all CQsts of attachment;
4. To grant such other relief as may be deemed necessary and
appropriate under the circumstances.
