II. DEMURRER PURSUANT TO Pa.R.C.P. 10Ulalltl 6. The allegations of paragraphs 1 - 5 are incorporated herein by reference. 7. Plaintiffs' Complaint fails to state facts constituting a cause of action against Defendants in that the alleged facts do not aver any fraudulent conduct on behalf of the Defendants. 8. Plaintiffs' complaint fails to state facts constituting a cause of action against Defendants in that the alleged facts fail to set forth any actual wrongdoing, fr.aud or arbitrary conduct on behalf of the Defendants. WHEREFORE, Defendants, respectfully requests this Honorable Court dismiss the above-captioned action as to th~m with prejud- ine, or in the alternative, require Plaintiffs to amend the pleading in accor.dance with the applicable Rules of civil Procedure. Scudder, by and through their counsel, Richard J, Marusak, Esquire, who make Complaint, the following of which is a statement thereof: 1. The Plaintiffs, John C. Scudder and Deidre L. Scuddar, are husband and wife, and are adult individuals residing at 31 West Maple Avenue, Shiremanstown, Cumberland County, Pennsylvania. 2. The Defendant, Gary E, Stambaugh, is an adult individual residing at 6429 Plantation Road, Spring Hill, Florida 34606. 3. The Defendant, Patricia A. Stambaugh, is an adult individual residing at 723 Old Silver Spring Road, Mechanicsburg, Cumberland County, Pennsylvania 17055. 4. The Plaintiffs are the owners of premises located at and known as 31 West Maple Avenue, Shiremanstown, Cumberland County, Pennsylvania, which premises is more particularly described in Cumberland County Deed Book 123, at page 926/ a copy of which is attached hereto, incorporated herein, labelled Exhibit "A". 5, The Plaintiffs purchased the aforedescribed premises from the Defendants, the settlement closing for which transaction took place on June 16, 1995. A copy of the Settlement Statement relative to the aforesaid settlement closing is attach~d hereto and incorporated herein labelled Exhibit "B". 6. That during the negotiationa relative to this transaction, and prior to the signing of the Agreement of Sale relating to same/ and prior to the settlement closing of the real estate transaction, aforedescribed, the Defendants made false and fraudulent misrepresentations and/or concealments as to material facts relating to water leakage problems in the basement of the , house located at and known as 31 West Maple Avenue, Shiremanstown, Pennsylvania, upon which the Plaintiffs relied, thereby inducing Plaintiffs to sign the Agreement of Sale, dated April 1B, 1995/ copy attached, labelled Exhibit "Co. 7. That among the false and fraudulent misrepresentations aforfi!described, were misrepresentat ions contained in paragraph 7 (L) of the Seller's Property Disclosure Statement, attached hereto, labelled Exhibit "0"/ wherein Defendants misrepresented that they were not aware of any water leakage or accumulation \\'ithin the basement of the premises which was the subject matter of this transaction. 8. That in addition to the written misrepresentation contained in Seller's Property Disclosure Statement (Exhibit "B"), Defendant, Gary E. Stambaugh and/or Defendant, Patricia A. 2 Stambaugh, verbally miBrepresented to Plaintiffs that they had not experienced any water leakage problems in the baBement to the premiBes which WaB the Bubject matter of this transaction, 9. That the foregoing repreBentationB made by the , DefendantB were falBe and fraudulent, known to be untrue by the DefendantB at the time Baid repreRentations were made, and were made with the intent to deceive and defraud the Plaintiffs, and , were relied upon by the Plaintiffs in signing the Agreement of Sale, and ultimately closing upon the aforedescribed real estate transaction. 10. That, within ;2-3 weeks of the date of settlement closing aforedescribed, on the first occasion of a significant rainfall, the Plaintiffs experienced a significant amount of water leakage in the basement. 11 . That, upon experiencing the aforedescribed water leakage in the basement, Plaintiffs thereafter learned that said water leakage problem had occurred in the basement during the time that Defendants owned the subject house. 12, That, as a result of the aforedescribed false and fraudulent representations and/or misrepresentations made by Defendants of the aforedescribed material facts, relied upon by the Plaintiffs in the closing of this real estate transaction, the Plaintiffs have been caused to suffer and sustain various damages, including the cost to be incur;:ed in the correction of the water leakage problem. The Plaintiffs purchased th~ aforedasc~ibed pramises from the Pefendants, the settlement closing for which transaction took place on June 16, 1995, 6. That during the negotiations relative to this transaction, and prior to the signing of the Agreement of Sale relating to same, and prior to the settlement closing of the real estate transaction, aforedescribed, the Defendants made false and fraudulent misrepresentations and/or concealments as to material facts relating to flooding problems which occurred at the premises and resulting water leakage problems in the basement of the house located at and known as 31 West Maple Avenue, Shiremanstown, Pennsylvania, upon which the Plaintiffs relied, thereby inducing Plaintiffs to sign the Agreement of Sale, dated April 18, 1995. 7, That among the false, wrongful, arbitrary and f raudu lent m iflrepresentat ions aforedescribed, were wri t ten misrepresentations contained in paragraph 7 (b) ot the Seller's Property Disclosure Statement, provided to Plaintiffs by Defendants' real estate agent, wherein Defendants misrepresented that they were not aware of any water leakage or accumulation within the basement of the premises which was the subject matter of this transaction; and paragraph 11(c) of the said'Seller.'s Property Disclosure Statement, wherein Defendants misrepresented that they Wet'!! not aware of any flooding problems which occurred at the premises. 8. That in addition to the written misrepresentation 2 contained in Seller's Property Disclosure Statement, Defendant, , Gary E. Stambaugh and/or Defendant, Patricia A, St.ambaugh, engaged in fraud, wrongful and/or arbitrary action in that they verbally misrepresented to Plaintiffs that they had not experienced any flooding at the premises and/or any wat~r leakage problems in the basement of the premises which was the subject matter of this transact ion. The verbal misrepresentations which were' made by Defendants included: (a) Defendant, Gary E. Stambaugh, was asked by Plaintiffs on at least 3 occasions prior to the parties' signing the aforesaid Agreement of Sale, whether there was any water problems at the property, including the basement. On each occasion, Defendant, Gary Stambaugh, advised Plaintiffs'that there never were such problems at the premises and that the only probl~m was a "trickle of water" near the window wells. On one of these occasions, the foregoing statements were made in the presence of Defendant, patricia A. Stambaugh, and she gaye no response or information contrary to the response given by Defendant, Gary E. Stambaugh, hereindescribed. (b) Defendant, Gary E. Stambaugh, was asked by Plaintiff, in the presence of Defendants' real estate agent, Tim Clouser, and prior to the parties signing of the aforesaid Agreement of Sale, about some tar on some of the blocks in the basement f,lnd said Defendant responded by stating that tar spilled on the blocks during the construction of the house and that the tar was not there 3 as a result of a water problem, (c) Defendant, Gary E. Stambaugh, was asked by Plaintiffs prior to the parties' signing of the afore~aid Agreement of Sale, about dililcoloration of some of the blocks in the basement and said Defendant responded by stating that the blocks were discolored due to having been left out in the weather during construction of the house, and that the discoloration was not the result of a water problem. (dl Defendant, Gary E. Stambaugh, was asked by plaintiffs, prior to the parties signing of the aforesaid Agreement of Sale, about the painting of a sec:tion of the basement wall and, said Defendant responded by stating that the painting was done in an attempt to cover some of the tar on the block aforedescribed, and not in an attempt to cover any stain resulting crom a water problem. (el The Defendant, Gary E, Stambaugh, was asked by Plaintiffs, prior to the parties' signing of the aforesaid Agreement of Sale, about a storm inlet which existed in the yard of the premises and said Defendant responded by stating that there never was a problem with water or flooding at the premises and that the said storm inlet "took all the water" at the property and that there was never a problem with flooding. 9. That the foregoing representations made by the Defendants were wrongful, arbitrary, false and fraudulent, known to be untrue by the Defendants at the time said representations were 4 made, and were made with the intent to deceive and defraud the Plaintiffs, and were relied upon by the Plaintiffs in signing the Agreement of Sale, and ultimately closing upon the aforedescribed real estate transaction. 10. That the foregoing representations were wrongful, arbitrary, false and fraudulent in that, within 2-3 weeks of the date or settlement closing aforedescribed, on the first occasion of a significant rainfall, the Plaintiffs experienced a significant amount of flooding at the premises and water leakage in the basement. 11. That, upon experiencing the aforedescribed flooding at the premises and water leakage in the basement, Plaintiffs thereafter learned from Township officials, neighbors and/or repairmen, that said flooding at the premises and water leakage problem had occurred at the premises in the basement during the time that Defendants owned the subject house. 12. That, as a result of the aforedescribed wrongful, arbitrary, false and fraudulent written and oral representations and/or misrepresentations made by Defendants of the aforedescribed material facts, relied upon by the Plaintiffs in the closing or this real estate transaction, the Plaintiffs have been caused to suffer and sustain various damages, including the cost to be incurred in the correction of the flOOding and water leakage problem.
