1. The Plaintiff is Alice A. stancavage, residing at 2290

2. The Defendant is William Stancavage, Jr., residing at

The children are presently in the custody of Motherl
Plaintiff, who resides at 2295 Lambs Gap Road, Bnols, PA 17025.

Plaintiff does not know of a person not a party to the

7. The best interest and permanent welfare of the ohildren
will be served by granting the relief requested, that being
confirmation of majority custody in Plaintiff beoause the
Plaintiff/Mother was the primary care taker of the children from
their birth.
8. Each parent whose parental rights to the children have
not been terminated and the person who has physical custody of
the ohildren have been named as parties to this action. hll
other persons, named below, who are known to have or olaim a
right to custody or visitation of the children will be given
notice of the pendency of this action and the right to intervene I

3, The Chrlstmes holiday will ba dlvldad as follows:
A. Father will have the children from after work on Christmas
Eve until 8:00 p,m.;
B. Mother will have the children from Chrlstmes Eve et 8:00
p.m, until Christmas Day et 2:00 p.m,
C. Father will have the children on Christmas Day et 2:00 p.m.
until Christmas Day ot 9:00 p.m. If he has to return to work on the
26th end, If not, until the following morning at 9:00 a.m,
4. Mother shall have the children on Mother's Day end fether shall have the
children on Fether's Day.
5. Father shall be entitled to four (4) uninterrupted non-consecutive weeks
ot vacation with the children over the summar. He must provide mother with the
dates when he Intends to exercise this period of custody no later than May 1 st of
each year. Mother shall be entitled to two (2) uninterrupted non-consecutlva weeks
of vecatlon with the children over the summer, and she must provide father with
thirty (30) days notice as to when she Intends to exercise those periods of
uninterrupted custody,
6. Father agrees to ensure that the children are taken to mother's Sunday
School of another Sunday School that Is approved by mother at least 50% of the
time when he has the children in his custody,
7. Both parties agree that the other party shall be their first option If they
need babysitting for the children for extendad periods.
8. The parties shall provide each other with reasonable telephone access

children, such as for school activities or parties, allowed under

conflict wieh the Order, and deducts or threatens to deduct the
same amount of time from the Petitioner's Court ordered weekend

Dissinger, files this response to Plaintiff's petition;
1. Denied. A custody trial was never set in this matter. By
Order of Court dated May 18, 2000, the parties were ordered to
reconvene for another custody Conciliation before Michael L. Bangs
Esquire, on Thursday, August 31, 2000, at 9100 a.m.

Procedure does not "call for such an examination," as Plaintiff's
petition suggests. Rather, Rule 1915.8 is discretionary in that
the Court may order the child or a party to submit to an
evaluation.

d. When the children have scheduled days off school during
the school year and they happen to coincide with a day
off for Father, Father shall be entitled to pick the
children up from school the day before their day off and
keep them overnight and for the duration of their day off
which coincides wi th his day off, and return them to
Mother at 7130 o'clock P,M, on their day off school.
e. In the sununer time when the children are not in school,
Father shall get the children at noon or after work every
Wednesday and every Thursday until 9:00 o'clock P.N" In
the sununer, if Father has only one (1) day off work at a
time, he shall ei ther pick the children up or Mother wi 11
drop the chi,ldren off to Fathe~' before 9:00 o'clock P,M.
the night preceding' his day off, The children will then
be returned to Mother by 7: 30 0' clock p, M. at the
conclusion of Father's one (1) day off work during the
sununer, In the summer time if Father's two (2) days off
work are sequential, he will pick up the children the
night before his day off and have them the two (2) days
in a row, returning them Mother at 9:00 o'clock P,M. at
the end of his second day off.
5. 'rhe children shall be wi th Mother on Mother's Day and her
birthday.
6. 'l'hll children shall bG wi tll Father on Father's Day and on his
birthday,
7, Father shan havG four (4) uninterrupted, non-consecutive
weeks of vacation with the children during the summer. He
shall inform Mother of his schedule by May 1"' of that year,
Mother shall have two (2) uninterrupted, non-consecutive weeks
of vacation with the children over the summer, Mother will
inform Father of her schedule at least (30) days in advance of
her vacation, The week shall consist of seven (7) days, the
seven (7) days to be taken over the respective parent's
weekend and not to infringe upon the weekend of the other
parent, In the event that one parent wishes to extend their
time into the other parent's weekend, the parent wishing to
extend their vacation into the normal, alternating weekend of
the other parent shall exchange with that parent their
alternating weekend with the children the week preceding the
week that they intend to take thp. children and then extend
into the other parent's time if the other parent consents. Any
time that would extend into the other parent's normal
alternating weekend shall be arranged at least (30) days in
advance by mutual agreement. For the year 2001 Father's
vacation schedule shall take priority over Mother's vacation
schedule because Mother is a student and Father is a full time
employee,
8. Should ei ther party be away from the children for four (4)
hours or more du.dng the academic school year, they shall
notify the other party as far in advance as possible of their
intentions to be away from the children for that four (4)
hours and provide the other parent with the opportunity to
babysit for those extended periods of time, Should either
party be away from the children for two (2) hours or more,
during their summer break from school, they shall noti fy the
other party as far in advance as possible of their intentions
to be away from the children for that two (2) hours and
provide the other parent wi th the opportuni ty to babysi t for
those extended periods of time, Regardless of the length or
shortness of notice, whether during the academia school year
or summer break from school, each parent is obligated to call
the other one immediately upon learning that they wi 11 be away
from the children for four (4) or two (2) hours or more and
permit the other parent the option of spending that time with
the children,
9. Both parents shall be entitled to rea~onable daily telephone
access wi th the children while they are in the physical
custody of the other parent,
10, Neither parent shall enroll the children nor either child in
any program or ,activity that may infringe upon the time of the
other parent unless the other parent gives their prior
consent, Neither parent shall withhold their consent
unreasonably,
11, The parties shall rotate the holidays of New Years Eve, New
Years Day, Easter, Memorial Day, July 4th, Labor Day, and
Thanksgiving, In odd numbered years Mother shall have the
holidays of New years Eve, Easter, July 4th and Thanksgiving,
Father shall have those holidays in the even numbered years,
In even numbered years Mother shall have News Yeal"s Day,
Memorial Day, and Labor Day. Father shall have those holidays
in odd numbered years,
12, In the event that Father's alternating weekend immediately
follows Thanksgiving, and Thanksgiving is his holiday, he need
not return the children to Mother on Thursday if he is off
work the Friday after Thanksgiving but instead shall keep them
from the Thanksgiving Holiday through Friday and the end of
his alternating weekend, If Father has to work the Friday
after Thanksgiving the children will return to Mother
Thanksgiving evening until Father is off work.
P.M. the day of their half day of school, The'parties
