HomeMy WebLinkAbout01-17-07 IN THE MATTER OF THE PERSON AND ESTATE OF: IN THE COURT OF COMMON PLEAS OF CUMBERLAND COUNTY, PENNSYLVANIA NANCY STUCK, AN ALLEGED INCAPACITATED PERSON 21-06-1107 ORPHANS' COURT ORDER OF COURT AND NOW, this ,rtday of January, 2007, following a hearing, and making a final finding that Nancy Stuck: (1) suffers from dementia that impairs her capacity to make and communicate decisions, (2) the impairment is such that she is not capable of making and communicating decisions on her own, (3) because of that inability she needs a guardian of her person and estate, (4) the type of guardianship needed is plenary, and (5) her incapacity will not decrease and it is likely to increase, IT IS ORDERED: (1) Donald Stuck, the son of Nancy Stuck, is appointed plenary guardian of the person and plenary guardian of the estate of Nancy Stuck. (2) The guardian is not required to post bond. (3) The guardian shall ensure that Nancy Stuck has 24 hour, 7 day a week supervision. (4) The guardian shall allow no one else to handle any of the financial affairs of Nancy Stuck. (5) The guardian or any person who with the consent of the guardian provides supervision for Nancy Stuck shall allow access and monitoring in that person's residence by a representative of Office for the Aging, both announced and 'v unannounced. Section 5521 (c) as follows: (1) The guardian shall file with the Register of Wills appointing him a report, at least once within the first 12 months of his appointment and a at least annually thereafter, attesting to the following: (i) Guardian of the estate: (A) current principal and how it is invested; (B) current income; (C) expenditures of principal and income since the last report; and (D) needs of the incapacitated person for which the guardian has provided since the last report. (ii) Guardian of the person: (A) current address and type of placement of the incapacitated person; (B) major medical or mental problems of the incapacitated person; / (C) a brief description of the incapacitated person's living arrangements and the social, medical, psychological and other support services she is receiving; (D) the opinion of the guardian as to whether the guardianship should continue or be terminated or modified and the reasons therefore; and (E) number and length of times the guardian visited the incapacitated person in the past year.
