HomeMy WebLinkAbout02-4794STIPULATION AGAINST LIENS WHEREAS, Eichelber.qer Construction Inc., with offices at 124 West Church Street, Dillsburq, PA 17019 hereinafter called "Contractor", entered into a contract with the Mt. Zion United Methodist Church, located at 420 Park Drive, Carlisle, Pennsylvania, 17065, hereinafter called "Owner", to provide materials and perform labor necessary for the sanctuary addition located at 420 Park Drive, Carlisle, Pennsylvania, Contract No. 00109-A - General Construction in the County of Cumberland and Commonwealth of Pennsylvania, being the same premises whichTrustees of Mount Zion Evangelical United Brethren Church and Trustees of Mount Zion United Methodist Church by Deed dated the 27th of December, 1971, and Deed Book Vol. K24, Page 932, granted and conveyed unto the Mount Zion United Methodist Church located at 420 Park Drive, Carlisle, Pennsylvania, being the same premises which Joel E. Heller and Evel_~y_n I. Heller by Deed dated the 30th of December, 1985, and Deed Book Vol. Z31, Page 729, granted and conveyed unto Jack Cohill, William Heffelbower, James Eckart, Dorothy Euling, Paul Weigle, Wayne Herr, Otho Shields, Samuel Baker, Jr., Albert Thomas, Betty Goodhart, Charles Good Hart, and Russell McNaughton (being all of the Board of Trustees of Mount Zion United Methodist Church) located at 420 Park Drive, Carlisle, Pennsylvania, being the same premises which PPG Industries, Inc.by Deed dated the 6th of Au.qust, 1987 and Deed Book Vol. W32, Page 95, granted and conveyed unto William Heff~"bower, ~orothy M. Euling, Betty J. Goodhart, Clair L. Shearer, Paul Weigle, Glenn j. Minnich, Marie E. Baker, Charles D. Goodhart and Russell McNaughton (being all of the Board of Trustees of Mount Zion United Methodist Church) located at 420 Park Drive, Carlisle, Pennsylvania, being the same premises which Mount Zion United Methodist Church by Deed dated the 16~h of December, 1994, and Deed Book Vol. 116, Page 663, granted and conveyed unto Trustees of Mount Zion United Methodist Church located at 420 Park Drive, Carlisle, Pennsylvania. NOW, THEREFORE, it is hereby stipulated and agreed by and between the said parties, as part of the said Contract and for the consideration therein set forth, that neither the undersigned Contractor, any Subcontractor or material supplier, nor any other person furnishing labor or materials to the said Contractor under this Contract shall file a lien, commonly called a mechanic's lien, for work done or materials furnished to the said building or any part thereof. This stipulation is made and intended to be filed with the County Prothonotary in accordance with the requirements of Section 1402 of the Mechanics Lien Law of 1963 of the Commonwealth of Pennsylvania in such case provided.
