STIPULATION ~NST LIENS
THIS AGREEMENT made this 16 day of January
between HAUBERT B~S, INC., of Camp Hill,
hereinafter referred to as Contractor,
2007, by and

AND
ANDREW D. BARNER AND BRANDY J. BARNER, hereinafter referred to as
Owners, whereby the contractor undertook and agreed to erected and
construct a dwelling on the certain lot of ground situate in upper
Allen Township, Cumberland County, Commonwealth of Pennsylvania, and
more fully described in Exhibit "A" which is attached hereto and
made a part hereof known as Lot 62 Creekstone Manor, Mechanicsburg,
PA.
NOW THEREFORE, THIS AGREEMENT WITNESSETH: That the said
Contractor, for an in consideration of the sum of ($1.00) Dollar to
Contractor in hand paid by Owner, the receipt whereof is hereby
acknowledged, and the further consideration mentioned in the
agreement aforesaid, for itself, himself or themselves and its, his
or their subcontractors, and all parties acting through or under
them, covenant and agree that no mechanic's liens or claims shall be
filed or maintained by them or any of them against the said
buildings and the lot of ground appurtenant thereto for or on
account of any work done or materials furnished by them or any of
them under said contract or otherwise, for, towards, in, or about
the erection and construction of the said buildings on the lot above
described, and the said Contractor, for itself, himself or
themselves, its, his or their subcontractors and others under them,
hereby expressly waive and relinquish the right to have, file, and
maintain any mechanic's liens or claims against the said buildings
or any of them, and agree that this instrument, waiving the right of
lien, shall be an independent covenant.

Exhibit A
ALL that certain lot of land situate in the Township of Upper Allen, County of Cumberland
and Commonwealth of Pennsylvania, bounded and described as follows, in accordance to
the Final Subdivision Plan for Creekstone Manor (formerly known as Trout Run) , Phases
n & m, dated January 1, 1996, prepared by Hartman & Associates, Inc., and recorded in
Plan Book 76, page 133, to wit:
BEGINNING at a point on the northern right of way line of Merrimac Avenue (50 foot
right of way) and the southwestern corner of Lot No. 61 on the above mentioned Plan of
Lots; thence along the western line of Lot 61, North 47 degrees 16 minutes 20 seconds East, a
distance of 125.00 feet to a point at the northwestern corner of Lot No. 61 and a point along
the southern line of Lot No. 67; thence along the southern line of Lot Nos. 67 and 66, North
42 degrees 43 minutes 40 seconds West, a distance of 85.00 feet to a point at the
northeastern corner of Lot No. 63; thence along the eastern line of Lot No. 63, South 47
degrees 16 minutes 20 seconds West, a distance of 125.00 feet to a point at the southeastern
corner of Lot No. 62 and the northern right of way line of Merrimac Avenue; thence along
Merrimac A venue, South 42 degrees 43 minutes 40 seconds East, a distance of 85.00 feet to
a point, the point and place of BEGINNING.
