WHEREAS, Brian Dang Pham and Nhien N. Nguyen of 280 Ri~
Mechanicsburg, Pennsylvania 17050 is about to execute contemporaneously herewith, a
contract, with Iacono Company/Ralph J. Iacono of Boiling Springs, Pennsylvania 17007,
for the erection of a upon tract of land
situate in Silver Spring Township, Cumberland County, Pennsylvania and known as Lot
#26, Rich Valley Manor, Silver Spring Township, Cumberland County, Pennsylvania,
being more particularly described in Exhibit A attached hereto.
NOW, September '~ ¢ ,2002, at the time of and immediately before the
execution of the principal contract, and before any authority has been given by the said
Brian Dang Pham and Nhien N. Nguyen to the said Iacono Company/Ralph J. Iacono to
commence work on the said building, or purchase materials for the same in consideration
of the making of the said contract with Brian Dang Pham and Nhien N. Nguyen and the
further consideration of One ($1.00) Dollar, to Iacono Company/Ralph J. Iacono, paid
by Brian Dang Pram and Nhien N. Nguyen it is agreed that no lien shall be filed against
the building by the contractor, or any subcontractor, nor by any of the material men or
workmen or any other person for any labor, or materials purchased, or extra labor or
materials purchased for the erection of said building, the right to file such liens being
expressly waived.

LEGAL DESCRIPTION
ALL THAT CERTAIN lot or piece of ground, situate in Silver Spring Township,
Cumberland County, Pennsylvania, more particularly bounded and described in the Final
Subdivision Plan of Rich Valley Manor prepared by Whittock-Hartman and recorded in
the Office of the Recorder of Deeds in and for Cumberland County, Pennsylvania in Plan
Book 56, Page 36, as follows:
BEGINNING at a point located on the Northern right-of-way line of Penns Way
Road (50 feet right-of-way), and referenced in an Easterly direction a distance of 239.48
feet to the right-of-way intersection of Penns Way Road and Northwatch Lane; thence
along a radial line along Lot #27, North 15 degrees 24 minutes 52 seconds East, a
distance of 446.42 feet to an iron pin; thence along Lots #20 and #21, South 43 degrees
50 minutes 32 seconds East, a distance of 442.32 feet to an iron pin; thence along Lot
#25, South 24 degrees, 37 minutes 23 seconds West, a distance of 352.96 feet to an iron
pin; thence along the right-of-way of Penns Way Road, North 44 degrees 49 minutes 30
seconds West, a distance of 158.43 feet to an iron pin; thence still along the right-of-way
line, on a curve to the left having a radius of 375.00 feet and an arc length of 194.78 feet
to a point, said point being the place of BEGINNING.
ALL of that land situate in Silver Spring Township being shown as Lot #26 on the
Final Plan of Lots of Rich Valley Manor prepared by Whittock-Hartman Engineers on
November 15, 1998, Drawing No. S-87-15.
MORTGAGE RECITAL:
BEING the same premises which Amit Agarwal, by deed dated April 18, 2002
and recorded April 24, 2002 in the Recorder of Deeds Office in and for Cumberland
County in Deed Book 251, Page 1896, granted and conveyed unto Brian Dang Pham and
Nhien N. Nguyen, Mortgagors herein.
