CIVIL ACTION -- COMPLAINT
1. Plaintiffs, Julie and Patrick Egolf, are husband
and wife residing at the above-stated address.
2. The defendant, Erika S. Huggler, is an individual
maintaining a place of residence at the above address.
3. On July 21, 1994, at approximately 8125 A.M., on
Center Street near Creekside Drive, in cumberland County, PA,
defendant struck the back of another vehicle, which was then
propelled into the vehicle plaintiff was driving.
4. At the time of the collision, plaintiff was
proceeding east on Center Street near the intersection with
Creekside Drive in Cumberland County, and was stopped for a red
light when the defendant, who was also traveling east on Center
Street, failed r.o stop her vehicle, colliding with another
vehicle, which was then propelled into the vehicle plaintiff was

driving.
5. The collision which is the subject matter of this
action was caused by the negligent, careless and/or willful and
wanton maintenance and/or operation of the motor vehicle of
defendant. The negligence of defendant fuvther consisted ofl
(a) operating the motor vehicle without due
regard for the rights, safety and position of automobiles on the
highway in front of said motor vehicle,
(b) Failing to have the motor vehicle under
proper and adequate control,
(c) Failing to stop her motor vehicle within the
assured clear distance of plaintiff's motor vehicle,
(d) Failing to maintain a proper and careful
lookout for vehicles on the highway,
(e) Failing to operate her vehicle at a safe and
reasonable speed under the circumstances,
(~) Violating the various ordinances of
Cumberland County and the statutes of the Commonwealth of
Pennsylvania pertaining to the operation and maintenance of motor
vehicles, and
(g) Otherwise failing to act in a careful and
prudent manner.
6. By reason of the aforesaid negligence, plaintiff
sustained or may have sustained injuries to the bones and/or
discs, joints, organs, nerves, muscles, ligaments and/or soft
tissues of the neck and back, including but not limited to

bulging discs at L3-4, L4-5 and L5-S11 plaintiff further
sustained or may have sustained psychological and emotional
injuries. all of which have caused and/or may in the future
cause, physical pain, emotional distress, loss of enjoyment of
life activities and impairment of earning capacity.
7. Plaintiff has incurred medical expenses and wage
loss as a result of this accident, and claims reimbursement from
defendant.
8. As a result of the aforesaid injuries, plaintiff
has been and may in the future become prevented from or limited
in attending to her usual daily duties and occupation, to her
damage and loss.
9. As a result of the aforesaid accident, plaintiff's
vehicle sustained damage in and about its body and frame, and
claims reimbursement from defendant.
10. As a result of the aforesaid injuries, husband-
plaintiff has been damaged due to a loss of assistance and

society, and joins in this action to claim damages for loss of
consortium.
WHEREFORE, plaintiffs seek judgment against defendant
in an amount in excess of the jurisdictional limits of compulsory
arbitration.

with Great Amerioan Insurance companies. It is also admitted
that plaintiffs signed a document dated December 21, 1992
allegedly choosing the limited tort option. It is denied that
plaintiffs made a valid limited tort option choice. 75 Pa.
e.S.A, seotion 1705(a) (4) establishes that for the first issuance
of every auto insurance policy, on and after July 1, 1990, that
the insured have the opportunity to select his tort option by
signing the form set forth in section 1705(a) (1) ("1705 Notice").
The 1705 Notice requires that the insured be informed, in
writing, of the amount of the premium, for comparison, of both
the limited and full tort options. Plaintiffs' insurance
carrier's form is missing this premium comparison requirement.
The form signed by the plaintiffs is defective. Signing a
defective form is tantamount to signing no form at all.
Therefore, pursuant to 75 Pa. C.S.A. section 1705(a) (3),
plaintiffs are conclusively presumed to have chosen the full tort
alternative and thus have full tort coverage.
17. Denied. It is denied that plaintiffs' election of
limited tort option is in complete conformance with the Motor
Vehicle Financial Responsibility Law as codified by 75 Pa. C.S.A.
Section 1701 ~ ~., specifically the notice provisions as set
forth in 75 Pa. C.S.A. Section 1791.1(b). To the contrary,
plaintiffs alleged election of the limited tort option was not in
complete conformance with the Motor Vehicle Financial
Responsibility Law. Plaintiffs' insurance carrier failed to
provide the required annual premium amounts for the limited and

full tort options as set forth in 75 Pa. C.S.A. section
1705(a) (1). The form signed by the plaintiffs is defective.
Signing a defective form is tantamount to signing no form at all.
Therefore, pursuant to 75 Pa. C.S.A. soction 1705(a) (3),
plaintiffs are conclusively presumed to have chosen the full tort
alternative and thus have full tort coverage.
lB. Denied. It is denied that the injuries sustained
by the plaintiffs do not meet the definition of "serious
injuries" as set forth at 75 Pa. C.S.A. section 1702. It is
denied that plaintiffs' claim or cause of action is barred by
plaintiffs' election of the limited tort option and the Motor
Vehicle Financial Responsibility Law, specifically 75 Pa. C.S.A.
section 1705(d). To the contrary, the injuries sustained by
plaintiffs do meet the definition of serious injury as set forth
at 75 Pa. C.S.A. section 1702. By way of further answer,
plaintiffs claim or cause of action is not barred by plaintiffs'
alleged election of the limited tort option as the form signed by
plaintiffs was not in complete conformance with 75 Pa. C.S.A.
section 1705(a) (1). Plaintiffs' insurance carrier did not

DEFINITIONS AND INSTRUCTIONS
(A) Whomever the tenn "document" Is used herein. It Includes (whether or not
specifically called tor) all printed. typewritten. hllndwrillen. graphic or recorded matter, however

(B) Whenever you are usked to "IdentitY" a document, the tollowlng Intonnation
