Defendant Herman & shenk, Inc. ("Herman & Shenk") is a Pennsylvania business corporation with a prinoipal place of business located at 601 N. Baltimore Avenue, Mount Holly Springs, Cumberland county, Pennsylvania. 6. On or about May 14, 1993, Plaintiffs entered into a written oontract with Defendant Lehman whereby Lehman agreed, inter AliA, to construct a two story residential house with a two car garage for Plaintiffs on a tract of land that became commonly known as 1410 Cranes Gap Road, Carlisle. A true and correct copy of the aforementioned contract is attached hereto and incorporated her~in by reference as "EXhibit AU. 7. In accordance with the terms of the written contract between Plaintiffs and Defendant Lehman, the contract price to be paid by Plaintiffs included an allowance of $3,000.00 for a zero clearance direct vent fireplace. 8. At all times relevant hereto, it was Plaintiffs' belief and understanding that a vented fireplace would be installed in the houee to be constructed by Defendant Lehman. 9. On or about May 25, 1994, Defendant Lehman completed the -2- LIIW 0''''0:11'' SNnllAKIi.R . BA(tjNI[MAf~ .. construotion of Plaintiffs' residential house and garage, at which time Defendant Lehman was paid in full by Plaintiffs for all amounts owed him for material and labor associated with the oonstruotion of the house and garage. 10. On or about May 26, 1994, Defendant Lehman, in oonsideration of the final payment made by Plaintiffs for material and labor associated with the construction of their house and garage, gave PlaJ.ntiffs a one year written warranty pertaining to the house Defendant Lehman constructed. A true and correct copy of the final statement of Defendant Lehman which was paid by Plaintiffs May 25, 1994 ~s well as the aforementioned written warranty are attaohed hereto and incorporated by reference herein as "Exhibit B" and "Exhibit C", respectively. 11. In the Spring of 1994, prior to May 25, 1994, Defendant Lehman installed a fireplace during the course of constructing the house for PlaintLffs. 12. In the Spring of 1994, prior to May 25, 1994, Defendants Lehman and DraWbaugh installed ceramic logs in the fireplace as well as a 3/ R inch gas 1 ine which ran from the fireplaoe into and through the basement of the house. 13. Subsequent to Plaintiffs taking possession of the house constructed by Defendant Lehman and beginning on and atter september 16, 1994, the following defects and deficiencies arose or were discovored by the Plaintiffs in the house constructed for them by Defendant Lehman: a. the gas fireplace installed in the house by Defendant Lehman emitted an offensive odor; b. the gas fireplace whon in oper.ation caused a black sooty residue to form and become deposited on all surfaces and furnishings inside the house; c. the ceramic logs in the fireplace had been installed improperly, causing them to char and/or burn; and d. the gas fireplace was serviced with propane fuel by a 3/8 inch pipe, which pipe was of insufficient diameter to ensure proper combustion of fuel. 23. Subsequent to Plaintiffs taking possession of the house constructed by Defendant Lehman, in the Winter of 1995, Plaintiffs discovered nails attaching shingles to the house, porch end garage roofs were rising out of the roofs, raising the shingles and breaking the seals between the shingles, due to Defendant Lehman's improper installation of shingles when the roofs' decking was wet. 24. Due to the existence of the deficiencies and defects noted in Paragraphs 22 and 23, above, the house constructed by -6- LAW C'J"'IC... SNItLOAKIR . BRENNEMAN .. . Defendant Lehman for Plaintiffs had not been oonstructed in a reasonable workmanlike manner and was not fit for habitation as a residential dwelling. 25. Cost to clean interior of house, inclUding contents I $4,452.93 b. Cost t~ paint walls and ceilings of interior of housel 6,704.00 c. For aesthetic reasons and as they deemed the direct vent would interfere with their use of the wraparound porch, the Plaintiffs requested that the Defendant Lehman construct a house so as to incorporate a vent less gas fireplace. 50. Defendant Lehman presented Plaintiffs with a brochur.e from which they selected a ventless gas fireplace in l1eu of a direct vent fireplace as originally called for in the specifications incorporated into tho parties' agreement. 51. The Plaintiffs informed the Defendants Lehman and Drawbaugh that they would locate the propane tanks to serve the fireplace at a point within 80 feet of the fireplace unit. 52. Defendant Drawbaugh installed the fireplace and gas line in accordance with the National Fuel Gas Code. 53. After the fireplace and gas line had been installed by Defendant Drawbaugh, and before same was connected to the propane tanks which Plaintiff provided, the answering Defendants provided plaintiffs with the installation and operating instructions for ~ unvented fireplace heaters, a copy of which is attached hereto as Exhibit "A". 54. After Defendant Drawbaugh ran the 3/8" gas line from the fireplace unit through the basement to the point in the foundation wall at which Plaintiffs had indicated the propane tanks would be located, the answering Defendants retained Defendant Herman & Shenk, Inc. to run an additional gas line through the foundation wall to two 100"pound propane tanks provided by the Plaintiffs. 55. Defendant Herman & Shenk did hook up the 3/8-inch gas l1ne it had extended through the foundation wall to the two 100- pound propane tanks which Plaintiff lccated next to the air conditioning unit. 56. Plaintiffs changed the location of the propane tanks in excess of 20 feet from the location they had indicated to answering Defendants that such would be situate, after Defendant Drawbaugh had installed the gas line from the unit to the foundation wall and after Defendant Herman & Shenk extended the line to the two 100- pound propane tanks. 57. Plaintiffs notified neither Defendant Lehman nor Defendant Drawbaugh that they had changed the location of the tanks before Defendant Tuckey Mechanical Servicee, Inc. extended the gas line, hooked up the system and operated the fireplace unit. 58. Plaintiffs continued to use the gas fireplace after they discovered such allegedly emitted an odor and discharged soot into the living space of the dwelling. 59. Plaintiffs have failed to mitigate their damages. . 60. At all timos relevant, the Defendants Lehman and Orawbaugh aoted and performed their work in a proper and safe manner. 61. The Defendants Lehman and Drawbaugh did not act in a careless or negligent manner, nor did they fail to exercise due care in their activities. 62. The Defendants Lehman and Drawbaugh performed their duties as instructed and pursuant to their contractual obligations. 63. Any damages Plaintiffs may have sustained were not proximately caused by the Defendants Lehman and Drawbaugh, but were caused in whole or in part by the negligence of parties other than the Defendants Lehman and Drawbaugh, whose conduct the Defendants Lehman and Drawbaugh had no control over or reason to foresee. 64. plaintiffs fail to state a val1d claim against the Defendants Lehman and Drawbaugh upon which reliet can be granted. 65. Defendant Lehman improperly in.talled a vent leas fireplace in Plaintiffs' house contrary to the contract specifications and without any explanation to Plaintiffs as to what a vent leas fireplace was or how it operated. 50. Denied. It is denied that Lehman presented Plaintiffs with a brochure from which Plaintiffs selected a vent less gas fireplace in lieu of a direct vent fireplace. To the contrary, no brochure was ever provided to Plaintiffs and Lehman unilaterally installed a ventless gas fireplace without Plaintiffs knowing what such a fireplace was or how it operated. I 51. Denied. It is denied that Plaintiffs informed Lehman and DraWbaugh that they could locate the propane tanks to serve the fireplace at a location within 80 feet of the fireplace unit. To the contrary, Lehman told Plaintiffs where the tanks would be located, which was originally within ten feet of the heat pump servicing the Plaintiffs' house. Lehman further told Plaintiffs that the concrete pad where the heat pump was located was big enough to accommodate the propane tanks. 52. Denied. After reasonable investigation, Plaintiffs are without sufficient information to form a belief as to the truth of the allegations contained in Paragraph 52 of Defendants' New Matter pertaining to installation in accordance with the National Fuel Gas Code; therefore, same are denied ~nd strict proof -2- LAW O"le.. It is further denied that Defendants Lehman and DraWbaugh provided Plaintiffs with the installation and operating instructions for unvented fireplace heaters as identified as Exhibit A in Defendants' Answer with New Matter. To the contrary, no such instructions were provided Plaintiffs. 54. Admitted in part; denied in part. It is admitted that Plaintiffs provided two 100-pound propane tanks. It is denied, for the reasons set forth in Paragraph 51, which Paragraph is incorporated herein, that Plaintiffs indicated where the tanks would be located. It is denied that Defendants retained Herman & Shenk, Inc. to run the additional gas line and make the hook-up to the tanks. To the contrary, Plaintiffs engaged Herman & Shenk, Inc. for those purposes. 55. Admitted in part; denied in part. It is admitted that Herman & Shenk, Inc. hooked up the gas line to the two propane tanks. It is further denied that DraWbaugh installed the gas line. To the oontrary, the gas line was installed by Lehman with DraWbaugh's assistance. Finally, it is denied that the location of the tanks was changed after Herman & Shenk, Inc. connected the gas line to the tanks. To the contrary, the tanks were moved in excess of twenty feet from the location selacted by Lehman before Herman & Shenk, Inc. made the gas line connection. 57. Admitted in part, denied in part. It is admitted, although not relevant, that Defendants Lehman and Drawbaugh were not notified of the change in the location of the tanks. It is denied that Tuckey Mechanical Services, Inc. extended the gas line, hooked up the system and operated the fireplace unit.
