Amy attended grades kindergarten through 12 and graduated from publio sohools in the Meohanio.burg Area Sohool District, 7. Kelly has attended grades kindergarten through 11 and plans to complete her high school education in the Meohaniosburg Area School system. B. Megan will be attending kindergarten this Fall beginning in August, 1996. 9. Defendant has unilaterally announced that Megan will not be attending kindergarten in the public schools as her sisters have done. but rather would be enrolled in the Bible Baptist School, 201 W. Main street, Shir.emanstown, Pennsylvania beginning August 2B, 1996. 10. Plaintiff believes it is in Megan's best interest to attend kindergarten at Upper Allen Elementary School, 1790 South Market street, Upper Allen Township, Cumberland county, Pennsylvania beginning August 27, 1996. 11. Amy attendud grades kindergarten through 12 and graduated from public schools in the Mechaniosburg Area School Distriot. 6. Kelly has attended g~ades kindergarten through 11 and plans to complpte her high school education in the Mechanicsburg Area School System. 7. Megan will be attending kindergarten this Fall beginning in August, 1996. 8. Defendant has unilaterally announced that Megan will not be attending kindorgarten in the public schools as her sisters have done, but rather would be enrolled in the Bible Baptist School, 201 W. Main street, Shiremanctown, Pennsylvania beginning August 28, 1996. 9. Plaintiff believes it is in Megan's best interest to attend kindergarten at Upper Allen Elementary School, 1790 South Market street, Upper Allen Township, cumberland county, pennsylvania beginning August 27, 1996. 10. Both parents are entitled to make major decisions affecting the best interests of a minor child inclUding religious and educational decisions. 11. Despite attempts, Plaintiff and Defendant have been -2- unable to resolve the dispute as to which school Megan should attend thereby pre~enting an actUal controversy for adjudication. 12. No custody older currently exists between the parties hereto. 13. It is in the best interest ot the parties and their daughter to have this Court eXQrcise its discretion and resolve this issue. 14. As the date for the first day of classes (Auguat 27, 1996) is rapidly approaching, Plaintiff requests the scheduling of an expedited hearing to resolve this controversy. WHEREFORE, Plaintiff, Pat~i s. Hartman requests your Honorable Court to: (1) exercise discretion in favor of hearing this matter; (2) schedule an expedited hearing to re&olve this matter prior to the beginning of school on August 27, 1996; (3) declare that it is in the Megan's best interest to attend kindergarten at Upper Allen Elementary School beginning August 27, 1996; and (4) order other relief as deemed just and appropriate.
