Pursuant to Pennsylvania Rule of Civil Procedure 1035.2(1),
plaintiffs Paul A. Ginter and Joan S. Ginter, his wife (I/the Ginters") ,
hereby move for summary judgment on their claims against defendant
Blain A. Hardy, Jr. (I/Defendantl/), and in support thereof, state the
following t
1. On Decenmer 29, 1997, the Ginters, by their counsel,
served Plaintiffs' Request for Adnlissions on Defendant, through
Defendant's counsel at the time, Marcus A. McKnight, Esquire.
2. The same day the Gintera served Plaintiffs' Requ~st for
Admissions, December 29, 1997, attorney McKnight filed a motion to
withdraw his appearance as counsel for Defendant.
3. On December 31, 1997, president Judge George E. HOffer,
granted attorney McKnight's motion to withdraw.
4. On January 6, 199B, attorney McKnight withdrew his
appearance as counsel for Defendant.
5. On January 12, 1997, the Ginters, through their counsel,
again served the Plaintiffs' Request for Admissions on Defendant, at
his last known address, 10702 Roxbury Road, Roxbury, PA 17251. This is

the very same address to which attorney McKnight addressed his motion
to withdraw. ~ Certificate of Service to Motion to Withdraw.
6. A true and correct copy of Plainti.ffs' Request for
Admissions, and certificate~ of service, is attached as Bxhibit A
hereto and incorporated by reference herein as though set forth at
length.
7. Also, for the Court's convenience in considering this
motl,on, true and correct copies of the complaint and answer are
attached as Bxhibit B h~reto and incorporated herein by reference as
though set forth at length.
S. To this date, the GJ,nters have not received any response
to Plaintiffs' Request for Admissions.
9. Under Pennsylvania Rule of Civil Procedure 4014(b), if a
party fails to respond to a request for admission within 30 days after
service of the request, the request shall be admitted.
10. Under Pennsylvania Rule of Civil Procedure 4014(d), any
matter admittod under Rule 4014(b) is conclusively established.
11. Because Defendant did not respond to Plaintiffs' Request
for Admissions within 30 days after service thereof, Defendant has
admitted all of the requests and all of the admitted facts are
conclusl.vely established.
12. Accordingly, the facts appearing in paragraphs 13
through 26 below are conclusively established for purposes of this
motion for summary judgment.
13. On November 11, 1990, the Ginters entered into a Timber
Sales Agreement (the "Agreement") with Defendant pursuant to whicl1

Defendant agreed to pay the Ginter. $26,000 in exchange for the right
to harvest timber from the Ginters' land in Doubling Gap. Lower Mifflin
Township, Cumberland County, Pennsylvania. Complaint, . 3, Answer,

14. Bxhibit A to the complaint is a true and correct copy of
the Agreement. Complaint, 1 4, Answer, 1 4.
15. Pursuant to the Agreement, Defendant paid the Ginters
$13,000 in advance of cutting. Complaint, 1 5, Answer, 1 5,
Plaintiffs' Request for Admissions, 1 2.
16. Defendant was to have until November 11, 1991 to cut and
harvest the timber and pay the remaini.ng balance of $13,000.
Complaint, 1 5, Plaintiffs' Request for Admissl.ons, 1 2.
17. Defendant cut and harvested the tin~er, but failed to
pay the remaining balance of $13,000 by November 11, 1991. Complaint,
1 6, Plaintiffs' Request for Admissions, 11 3, 4.
10. In Noven~er of 1991, the Ginters and Defendant agreed
that Defendant's obligation to pay the remaining balance of $13,000
would be deferred until future demand by the Ginters, and that the
unpaid balance of $13,000 would accrue interest at the rate of ot per
annum from November 1, 1991 until the time of repayment. Complaint,

19. In November of 1992, 1993, 1994 and 1995, the Ginters
inquired as t.o Defendant's ability to pay the balance due under the
Agreement. Complaint, 1 0, Plaintiffs' Request for AdmislJions, 1 6.
20. Each time the Defendant made an unconditional and
un3quivocal promise to pay the outstanding balance, and the Ginters did

not demand payment. Complaint, 1 81 Plaintiffs' Request for

21. On July 1, 1996, the Ginters demanded Defendant pay the
outstanding balance of $13,000, and the Defendant has failed to make
such payment. Complaint, 1 91 Answer, 1 9, Plaintiffs' Request for
Admissionm, 1 7.
22. To this date, Defendant still has not paid the
outstanding $13,000 balance or any accrued interest on the outstanding
balance. Complaint, 1 9, Plaintiffs' Request for Admissions, 1 7.
23. Defendant has breached the Agreement by f.ailing to make
payment when due. Complaint, 1 10, Plaintiffs' Request for ~niBBions,
1 8.
24. As a result of Defendant's breach of the Agreement,
Defendant owes the Ginters the outstanding balance due under the
Agreement, the principal amount of which is $13,000, plus accrued
intereet at a rate of 8t per annum from November 1, 1991 to the time of
judgment. Plaintiffs' Request for Admissions, 1 9.
25. As of June 1, 1998, accrued interest will amount to
$6,780.72. Therefore, as of June 1, 1998, the total amount of damages
suffered by the Ginters will be $19,780.72.
26. Interest will continue to accrue at a rate of $2.85 per.
day from June 1, 1998 until judgment is entered. Complaint, 1 121

27. Because the facts in paragraphs 13 through 26 above are
conclusively established, there are no genuine issues of material fact

to be tried in this case, and the Ginters are entitled to judgment as a
n~tter of law.
28. Because there are no genuine issues of material fact to
be tried in this case, and the Ginters are entitled to judgment a~ a
matter of law, the Cour.t should grant the Ginters' motion for slunmary
judgment pursuant to Pennsylvania Rule of Civil Procedure 1035.2(1).
WHEREFORE, the Ginters respectfully requ~st that the Court
grant their motion for summary judgment, and enter judgment in their
favor and against defendant Blain A. Hardy, Jr., ill the principal
amount of $13,000.00, plus interest at 8 percent per annum from
November 1, 1991 until the time of judgment (which will be a total of
$6,780.72 through June 1, 1998 and $2.58 per day thereafter), plus
inter.est accruing at the legal rate of 6 percent per annum from the
date of judgment until the satisfaction of such judgment, and such
other relief as the Court deems just and proper.

Pursuant to RUle 4014 of the Pennsylvania Rules of civil

1. Defendant is an adult individual with a last known

2. Pursuant to the Timber Sales Agreement (the
"Agreement"), a true and correct copy of which was attached as Exhibit
"A" to the complaint, $13/000 was paid in advance of cutting by
Defendant, with the balance of $13/000 being due no later than
November 11, 1991.
3. Defendant cut and harvested the timber pursuant to the
Agreement.
4. Defendant tailed to pay the balance due under the
Agreement by November 11, 1991.

6. In November of 1992, 1993, 1994 and 1995, the Ointers
inquired 8S to the Defendant's ability to pay the balance due under
Aqreement. Each time the Defendant made an unconditional and
unequivocal promise to pay the debt due under the Aqreement, and the
Ginters did not demand payment.
7. On July 1, 1996, the Ginters made demand on the
Defendant to pay the outstandinq debt due under tho Aqreement, and the
Defendant has failed to mmke payment.
8. Defendant has breached the Aqreement by failinq to make
payment when due.
9. As a result ot" the breach ot the Aqreement by the
De'endant, the Ginters have been damaqed in the amount ot $13,000, plus
accrued interest from November 1, 1991 throuqh June 30, 1996 ot
$4,823.91, tor a total ot $17,823.91.
10. Interest continues to accrue atter June 30, 1996 at the
rate of 8' per annum, or $2.85 per day.

COMPLAINT
1. PlaintiffS paul A. Ginter and Joan S. Ginter, his
wife (the "Ginters"), are adult individuals residing at 119 Keats
place, Cherry Hill, NJ 08003.
2. Defendant Blain A. Hardy, Jr. ("Defendant"), is an
adult individual with a last known address of 11040 Roxbury Road,
ROxbury, PA 17251.
3. On or about November 11, 1990, the Ginters and
Defendant entered into a Timber Sales Agreement (the "Agreement")
pursuant to which Defendant agreed to pay to the Ginters the sum
of $26,000 in exchange for the right to harvest certain timber
situate on the Ginters' land located in Doubling Gap, Lower
Mifflin Township, Cumberland County, Pennsylvania.
4. A true and correct copy of the Agreement is
attached hereto, marked Bxhibit "A" and incorporated herein by
reference.

5. Pursuant to the Agreement, $13,000 was paid in
advance ot cutting by Detendant, with the balance ot $13,000
being due no later than November 11, 1991.
6. Detendant cut and harvested the timber pursuant to
the Agreement, but tailed to pay the balance due by November 11,
1991.
7. In November ot 1991, the Ginters and Detendant
agreed that payment ot the Detendant'. obligation under the
Agreement would be deterred until tuture demand by the Gintere,
and that the unpaid balance of $13,000 would accrue inter.est at
the rate of 8t per annum from November 1, 1991 until the time ot
repayment.
8. In November of 1992, 1993, 1994 and 1995, the
Ginters inquired as to the Defendant's ability to pay the balance
due under Agreement. Bach time the Detendant made an
unconditional and unequivocal promise to pay the debt due under
the Agreement, and the Ginters did not demand payment.
9. On July 1, 1996, the Ginters made demand on the
Defendant to pay the outstanding debt due under the Agreement,
and the Detendant has failed to mako payment.

1. Plaintiees Paul A. Ginter and Joan S. Ginter, his
wife (the "Ginters"), are adult individuals residing at 119 Keats
Place, Cherry Hill, NJ 08003.
2. Defendant Blain A. Hardy, Jr. ("Defendant"), is an
adult individual with a last known address of 11040 Roxbury Road,
RoxbUry, PA 17251.
3. On or about November 11, 1990, the Ginters and
Defendant entered into a Timber Sales Agreement (the "Agreement")
pursuant to which Defendant agreed to pay to the Ginters the sum
of $26,000 in exchange for the right to harvest certain timber
situate on the Ginters' land located in Doubling Gap, Lower
Mieflin Township, Cumberland County, pennsylvania.
4. A true and correct copy of the Agreement is
attached hereto, marked Exhibit "A" and incorporated herein by
reference.

6. Pursuant to the Agreement, $13,000 was paid in
advance of cutting by Defendant, with the balance of $13,000
being due no later than November 11, 1991.
6. Defendant cut and harvested the timber pursuant to
the Agreement, but failed to pay the balance due by November 11,
1991.
7. In November of 1991, the Ginters and Defendant
agreed that payment of the nefendant's obligation under the
Agreement would be deferred until future demand by the Ginters,
and that the unpaid balance of $13,000 would accrue interest at
the rate of 8' per annum from November 1, 1991 until the time of
repayment.
8. In November of 1992, 1993, 1994 and 1995, the
Ginters inquired as to the Defendant's ability to pay the balance
due unc\er Agreement. Each time the Defendant made an
unconditional and unequivocal promise to pay the debt due under
the Agreement, and the Ginters did not demand payment.
9. On July 1, 1996, the Ginters made demand on the
Defendant to pay the outstanding debt due under the Agreement,
and the Defendant has failed to make payment.
10. Defendant has breached the Agreement by failing to
make payment when due.
11. As a result of the breach of the Agreement by the
Defendant, the Ginters have been damaged in the amount of

1. Detendant is an adult individual with a last known
address ot Box 45, Roxbury Road, Roxbury, PA 17251.
2. Pursuant to the Timber Sales Agreement (the
"Agreement"), a true and correct copy ot which was attaohed as Exhibit
"A" to the Complaint, $13,000 was paid in advance ot cutting by
Detendant, with the balance ot $13,000 being due no later than
November 11, 1991.
3. Defendant cut and harvested the timber pursuant to the
Agreement.

COMPLAINT
1. plaintiffs Paul A. Ginter and Joan S. Ginter, his
wife (the "Ginters"), are adult individuals x'esiding at 119 Keats
Place, Cherry Hill, NJ 08003,
2. Defendant Blain A. Hardy, Jr. ("Defendant"), is an
adult individual with a last known address of 11040 Roxbury Road,
Roxbury, PA 17251.
3. On or about November 11, 1990, the Ginters and
Detendant entered into a Timber Sales Agroement (the "Agreement")
pursuant to which Defendant agreed to pay to the Ginters the sum
of $26,000 in exchange for the right to harvest certain timber
situate on the Ginters' land located in Doubling Gap, Lower
Mifflin Township, Cumberland County, Pennsylvania.
4. A true and correct copy of the Agreement is
attached hereto, marked Exhibit "A" and incorporated herein by
reference.

6. Pursuant to the Agreement, $13,000 was paid in
advance of cutting by Defondant, with the balance of $13,000
being due no later than November 11, 1991.
6. Defendant cut and harvested the timber pursuant to
the Agreement, but fail~d to pay the balance due by November 11,
1991.
7. In November of 1991, the Ginters and Defendant
agreed that payment of the Defendant's obligatl.on under thtJ
Agreement would be deferred until future demand by the Ginters,
and that the unpaid balance of $13,000 would accrue interest .:it
the rate of 8t per annum from November 1, 1991 until the time of
repayment.
8. In Novenmer of 1992, 1993, 1994 and 1995, the
Ginters inquired as to the Defendant's ability to pay the balance
due under Agreement. Each time the Defendant made an
unconditional and unequivocal promise to pay the debt due under
the Agreement, and the Ginters did not demand payment.
9. On July 1, 1996, the Ginters made demand on the
Defendant to pay the outstanding debt due under the Agreement,
and the Defendant has failed to make payment.
10. Defendant has breached the Agreement by failing to
make payment when due.
11. As a result of the breach of the Agreement by the
Defendant, the Ginters have been damaged in the amount of

upon the Defendant to pay the balance due on July 1, 1996. Defendant failed to
pay the outstanding debt.
Plaintiffs flied their complaint alleging breach of contract and demanding
payment of the outstanding debt, July 17, 1996. The case was cjeslgnated for
arbitration, On June 4, 1997, the Board of Arbitrators heard the case and awarded
the Plaintiffs $13,000 plus Interast. Defendant appealed the arbitration decision to
this Court. DecEmber 31, 1997, before trial was to begin, Defendant's attomeys
were given leave of court to withdraw, The case waB stricken from the February
1998 trial list.
As part of discovery In this case, PlalntlffB Bubmltted, to the Defendant,
requests for admissions on December 29, 1997. The requests covered ten points
of fact concerning the existence of the contract between the parties, the duties
which accompanied the contract and the Defendant's failure to pay the debt owed
under the contract. Defendant failed to respond to the requests for admissions.
Plaintiff's Motion for Summary Judgment was flied May 15, 1998. The
motion was listed for argument May 28, 199B, Oral ~rgument was held before the
Court on June 24, 1998. Defendant has not responded to Plaintiffs' motion.

statements of fact, or opinions of fact, or of the application of law to fact. Pa, A.
Clv. P.4014(a),
The matter Is admllled unless, within thirty days after
service of the request, or within such shorter or longer
time as the court may allow, the party to whom the
request Is directed serves upon the party requesting the
admission an answer verified by the party or an
obJection, signed by the party or by his allomey,
Pa, A. Clv. p, 4014(b),
Parties may move for summary judgment when there Is no genuine Issue of
material fact as to any necessary element of the cause of action or a defense to
the action. Pa, R. Clv. P. 1035,2. The summary Judgment rules, effective July 1,
1996, state that a party adverse to the motion "may not rest upon the mere
allegations or denials of the pleadings but must file a response within thirty days
after service," Pa. A, Clv. P. 1035.3, Summary judgment may be entered against
a party who does not respond to the motion. Pa, A. Clv. P. 1035,3(d).
When a party falls to respond to requests for admissions, that party runs the
risk that the facts sought will be deemed admitted. ~~

Byrnes, plaintiff made an agreement with Buss Automation, Inc, to receive a
commission for sales of Buss.bulll machinery to one of plaintiff's clients. Bvrnes

at 552, 609 A,2d at 1361. Buss Automallon, Ino. was subsequently Bold and the
new owners retained the corporate name. 1.!1 Plalnllff's oommlsslon was not paid
and a lawsuit was filed against Buss' new owners. .l3yrnes at 552, 60 A.2d at
1362, Plalnllff sent to defendant requests for admissions which asked the
defendant to admit or deny (1) that the new owners only defense was that the
agreement was made by the old owners and (2) that the new owners agreed to
Indemnify the old owners In the plalnllff's acllon, I3vmes at 556, 609 A,2d at 1364.
Defendant failed to respond to the plalnllff's request and the facts were deemed
admitted. l3yrnes at 557, 609 A.2d at 1364, In Svrnes, the Superior Court found
the order granting summary Judgment based upon the facts established by
defendant's failure to respond to plalnllff's requests for admissions to be proper.
.Byrnes at 564, 609 A,2d at 1367.
In the case at bar, Defendant's failure to respond to Plaintiffs' requests for
admissions renders the facts therein admitted,' No genuine Issue of material fact
remains to be determined, Defendant harvested timber from the Plalnllffs'
property. Defendant has failed to pay the balance due of $13,000, Based upon the
