Dear Mr. Miller:
I have reviewed the report from Frey's expert, Jerry Shaffer.
Though there are several points on which I completely agree with Mr.
Shaffer, there are some very Significant differences In our Interpretation of
the hard data we both have.
I am In agreement that this tree was In decline, and certainly not a prime
specimen. The decline can be easily seen In the photographs of the tree
prior to as well as after the accident.
Though Mr, Shaffer Is correct In his remark that a tree may be look perfectly
sound on the outside but be "completely rotted to the gro'md", It does not
appear that this was the case here. There Is significant uncorrupted wood
In photographs provided by both the plaintiff and the defendant. Had the
tree been rotted to the core, It Is unlikely that It would have survived the
felling Intact.
Further, published research by Bartlett Tree Experts suggests that up to one
third of the tree can be decayed without the tree posing a hazard. I believe
that this tree was well under that threshold. As to the Issue of the roots,
there Is clear evidence of healthy lateral and feeder roots In your
photograph F. Photograph G shows an area where roots have rotted and to
which Mr. Shaffer refers, Though not Insignificant, In relation to the viable
roots, this area Is also below threshold levels for hazard trees,

The size of the root pan separated from the ground has more to with the
velocity of the Impact causing the felling, soli moisture at the tIme, and
mechanical restrictions I,e" curb and sidewalk. Even the root pan of trees
unrestricted by these mechanical devices seem surprisingly small to the lay
person. You might recall walking In the woods and seeing a tree of
enormous size on the ground with a relatively small root pan, Small lateral
roots break away from the buttress roots and confine the pan to the
Immediate area around the base of any tree,
Nevertheless, the condition of the tree at the time of the accident Is
Incidental.
Mr, Schaffer Is also correct In his assert/on that the Borough of
Mechanlcsburg has a tree ordinance which Instructs us:

Idmmlno Near Stree~ b1QlJt~ The Owner of the property shall
trim branches from any shade trees overhanging the streets and
highways of the Borough 50 that they wIll not obstruct the light
from any street light, and 50 that they shall be a clear height of
fourteen (14) feet above the surface of the street and eight (8)
feet Over the sidewalk. If any property owner shall neglect or
refuse to trim any shade tree as required by thIs section, upon
notice In writing by the CommisSion, within the time limits
specified In such notice, the Commission may cause such
trimming to be done at the expense of the owner,
As to the assertion that the tree was In the truck's way, r strongly disagree
with Mr, Shaffer's Interpretation, We have
photographic and anecdotal evidence that Ms. Kelly was In complete
compliance with the borough ordinance,
In Photographs A and B, there are aged scars left from removal of lateral
branches which had grown Into the right of way. These well healed scars
are easily visible on photographs A and B and can be Seen on the trunk In
photograph C, ,
Photograph C provides us with a Indirect measurement of the distance from
grade (top of root pan) to the scar of the removed branch ("'11') and

to the base of the first remaining branch (15'+). The distance between each
upright fence support Is precisely 7'. Add to this the distance or the curb
reveal, This photographic record of distances provides conclusive evidence
that remaining branches on the trees were out.slde the right of way.
In addition, I have redrawn, juxtaposed to Mr, Schaffel's drawing, a
projected outline of the tree which Is technically accurate and roughly to
scale using projections from the photographs, As you will see, there Is no
branch In the right of way,
Anecdotally, Tom Gable, who Is the Chair of the Mechanlcsburg Street Tree
Commission communicated to me that he was familiar with this specific tree
prior to the accident and that It was not a hazard,
It appears from the damage on the trunk of the tree that the Impact was
caused not by a muffler pipe or wind deflector, which would have been too
high, and energy absorbing, respectively, but by a resistant force; the
trailer of the truck Is suspect. Though the Frey expert states In his report
that the trailer hit the tree, photographs of the trailer damage were not
provided. The only photographs I received for review were those of the
residual damage to the cab,
The $2,000 cost to plant a large replacement tree In place of the one
destroyed Is reasonable. It Is certainly not typically done, and should be
performed by an seasoned contractor who has had experience with such
delicate circumstances of mechanical barriers, "ball shaving" and root
prunIng.
