Cumberland Avenue, Chamberaburg, Franklin County, Pennsylvnnia. since Jnnuary, 1996.
2. Defendant, !leverly I.. Gilbert, in An adult individual residing at S2 East
Main Street, Newville, Cumberland County, pennsylvanill. since FebruAry, 1991.
3. The Plaintiff and the DefendAnt nre nationala and citizeno of the United
Stntca of Amer1~a, and both bAve been bonn fide rea idnnts of the CommonweAL th of
Pennaylvanin, for at least aix (6) months immediately previous to the filing of this

record, Anne M, Shepard, Esquire, to amend his complaint in divorce and in support
thereof avers the following:
I. Petitioner/Plaintin: William C Gilbert, Jr" tiled a Complaint In Divorce by and
through his counsel at that time, David Perkins, Esquire, on or about July 1996. A copy
of said Divorce Complaint is all ached hereto and incorporated herein by reference as
Exhibit "A",
2. The Plaintilf and Defendant in the above-captioned mailer allempced to enter
Into meaningful negotiations regarding equitable distribucion; however, despite these
efforts, no agreement has been reached.
3. The parties are joint owners of real propercy located at 52 E. Main SI.,
Newville, Cumberland County, Pennsylvania.
4. The parties have accumulated debts and obligations since their marriage on
May 27, 1962.
5. The Petitioner/Plaintill' is prepared to request a Master's hearing so that the
Court may decide how the panies' assets and debts will be distributed.

parties stipulate and agree as ~ollowSI
1. ThQY are the joint owners of real e6tate locsted at 52
East Main street, Newville, Cumberland County, Pennsylvania.
Counsel for wire shall prepare a deed to convey sll of ,
husband's right, title, and interest in that real estate to
wife. The deed will be executed by husband and held in
escrow by counsel for husband until such time as husband's
name ia removed on the mortgage obli~ation on the home,
whether that be through a refinancing, a payment of the
mortgage in full, or a sale of the property. At the time
husband's namo is removed as an obligor on the mortgage, the
deed shall be provided to counsel for wife.
From the time of execution of this agreement forward, wife
shall be solely and exclusively obligated to make payment on
the aforesaid mortgage as well as any other costs of
maintaining the home. Furthermore, wife ahall have
exclusive possession of the property from this date forward.
2. The parties' 1993 Taurus and 19U7 Escort bre and shall
remain wife's sole possession. Wife shall be responsible
for any indebtedness on those vehicles and shall indemnify
husband and hold him harmless from and against any demands
for payment or collection activity relative to any
indebtedness. In the event it is nec~ssary for husband to
execute any documents to convey his intetest in the
aforesaid vehicles, he will dQ 50 within 15 days of being
requested to do so by wife or her legal representative.
3. In addition, the parties are owners of a 1993 Ford
Ranger. Wife waives, relinquishes, and transfers any and
all right, title, or interest she has to that vehicle. It
is acknowledged that that vehicle haa already been traded in
and, therefore, ia no longer in tho possession or ownership
of either party but wife shall make no claim against husband
for any inter~st in that vehicle.
4. All personal property, tangible and intangible, that
the parties accrued during their marriage, shall remain with
the party presently in possession.
5. More specifically with respect to intangible personal
prdperty, the parties agree that husband's Member's 1st
Foderal Credit Union account, Account No. 119969 is and
shall remain his sole possession. Wife's Member's 1st
account, Account No. 59685 is and shall r.emain her sole and
exclusive possession. The bank accounts at Dauphin Deposit
Bank and Trust Company, now known as Allfirst, docketed to

account Nos. 75029944 and 67353274 are and <<hall remain
husband's solo and excluslve posseasion.
With respect to all such financial accounts, neither party
ahall make ,any claim or demand of any nature reLative to
contribution from the other concerning the accounts that
have been distributed above.
6. Any and E111 assets accrued by the parties since the
date of their separation shall remain each parties' aole
poasession and neither party shall make any claim against
the other tor post-separation asset~.
7. It is acknowledged that in the time frame of the
parties' separation there were certain United States Series
E savings bonds which were cashed, the funds of which were
retained and used by husbsnd. Wife shall make no claim of
any nature whatsoever relative to any contribution relative
to those bonds.
8. It is acknowledged that husband has secured a certain
thrift stlvingB plan through his employment with the United
states government at the Letterkenny Depot. This thrift
saVings plan i~ and shall remain husband's sole possession.
Wife shall make no claim of any nature whatsoever relative
to any interest in the thrift savings ,plan.
~. Through his employment at the Letterkenny Depot,
husband has accrued a Federal Employees' Retirement System
plan (FERS). At the time of husband's reti rement, he shall
select the survivor benefit plan on his FERS r.tirement.
After the survivor benefit plan costs have been deducted
from husband's monthly beneflt, the parties shall apply the
coverture fraetlon to the benefit to determine the marital
portion of the monthly benefit. Wife shall then receive 50~
of the coverture portion of the benefit via a Domestic
Relations Order that Bhall be prepared by counsel for
husband. Wife shall receive a portion of the survivor
benefit based upon the coverture ~raotion in the ev~nt
husband predeceases wife. Provided that law allows for the
survivor benefit to be allocated to more than one
individual, husband may designate the survivor to whom the
remaining portion of the benefit shall be received.
10. With respect to husband's United Stat~s military
pension, which is in pay status at this time, wife shall be
entitled to receive 45~of 80~ of the military pension along
, wf th any future C;OLAs. Counsel for ~,ife shall prepare a
ODRO to provide for this distribution. Until such time as
the distribution goes into effect, beginning in April 2000,

husband shall be responsible for paying the amount that
would otherwise be removed from his pay under the CORO
directly to wife. Pending implementation of the CORa, when
husband makes a monthly payment to wifA of this portion of
the pension, it Is agreed that the sum of $400.00 per month
shall be his total obligation. The paymenta of, $400.00 per
month shall be made directly from husband to wife and shall
be made no later than the lOth of each month until the CORa
takes effect.
11. It is understood that there was a Member's 1st Federal
Credit Union Visa credit curd account that wife has paid
since the parties' separation. Wife shall assume all future
responsibility for repayment of this debt and shall
indemnify husband and hold him harmless from and against any
demands for payment of any nature on account of that debt.
12. It is acknowledged that since the date of separation
husband has been responsible for paying the Dauphin Deposit
Bank and Trust Company Visa account, Sears credit card
account, Montgomery Wards credit card accour,t, Memher's 1st
Federal Credit Union personal loan, and two Member's 1st
Federal Credit Union automobile loans that were due at the
time of the parties' separation. In the event that there
remains any balances on any of these accounts, husband shall
be responsible for paying those debts. Husband will
indemnify wife and hold her harmless from and against any
demands for payment or any collection activity of any nature
relative to any of those debts.
13. The parties waive any rights or claims to alimony,
alimony pendente lite, counsel fees and expenses. Each
party shall be responsible for their own attorney fees
associated with these proceedings.
14. The parties further agreu that they will execute an
affidavit of consent and a waiver of notice of intention to
reque~t entry of divorce decree contemporaneously with
signing this stipulation; thus, allowing the Master to have
his appointment vacated and allowing the parties to finalize
a divorce as a Section 330l(c) divorce.
15. It is also acknowledged that since the date of
separation, wife has established and maintained a Member's
1st Employees' Saving plan through her employment with
Member's 1st Federal Credit Union. Husband waives any
interest in that plan. In the event it is necessary for him
to execute any documents to so waive his interest, he will
do so within 15 days.

V. EXPENSES
At the time of the parties' separation, the expenses associated with the jointly owned
marital residence were belllg borne by the Plallltitl: Including the mortgage payment,
Plaintitl'bore the total expenses associAted with the maintenance of the former marital residence
with the exception of the monthly utility payments Incurred by the Defendanc and the Defendant's
pcrsonal expenses From November 1995 until October 1998, PlalntltTpaid $20,452.44 toward
principal and Interest on the parties mortgage and toward real cscate taxes. In addition. Plaintiff
paid the loan in tull for Wife's 1993 Taurus, and has continued paying the parties' personatloan
and the joint debt for the Ford Ranger
VI. PENSION
Plaintitl'ls not convinced that Defendant has no retirement benefits and demands proof of
this allegation at the time of the hearing, At the time PlaintltTmarried Plaintiff, Plaintitl'had
already been In the U S Marine Corps for four (4) years. Therefore Defendant only has a marital
intcrl!st in l6 of the 20 years ofPlaintitl's military retirement Furthermore. PlalntltTbegan
\~orkin!! at Letterkl!nny on December 17. 1984. The date of the parties' separation was
November 1995 Therefore. Defendant only has a 39 pl!r cent interest In Plalntltl's Federal
Employees Retirement and his Thrill Savings Plan accounts,
VII. COUNSEL FEES
Plaintltf submits that the pal11es should be responsible for their own counsel fees In this
case. Ie is noted that it was only with the tiling of the Motion for Appointment of Master that

THE parties were married on May 28, 1962 and have two grown chlldrl!n. In November,
1995, Plalnllff advised Defendant that he was not happy, and that he wanted to separate. In
February, 1996, the parties reconciled. However, on April 11, 1996, Plaintiff left the marital home
once again. At least during the period prior to separallon and during the reconclllallon period,
Plaintiff maintained a relationship with Sharon Group, and after April 11, 1996, r.ommenced living
with her.
Plaintiff was bom on July 19, 1939, and Defendant was born on April 5, 1943. During the
course of their marriage, Plalnllff served In the Marine Corps, He rellred In Marchi 1978 after 20
years of service, during 16 of which the parties were married. Husband did not elect the survivors
benefit plan for his Military pension which Is presently In pay status.
Defendant worked at various Jobs after raising the parties' children. She was employed at the
Army's War College from 1986 to 1994, and by Members' First from 1994 until the present. She Is a
teller at Member's First. Her prior experience was as a temp for ADIA Temp where she earned
$6.50 per hour, work on an Air Force Base In Georgla, and other experience In clerical poslllons.

Now comes BEVERLY L. GILBERT, by and through her counsel, FLOWER,
MORGENTHAL, FLOWER & LINDSAY, P.C., and petitions tl1is Honorable Court as follows:
1. The parties hereto are husband and wife, having been Joined In marriage on May 28,
1962.
2. At the time of the parties' separation, on or about April 11, 1996, Respondent's life
was covered by a life Insurance polley through the Federal Employees GI'OUP L1fa Insurance
Program, and Petitioner was listed as the beneficiary of Utat polley, Seld polley Is the only polley
Insuring Respondent's life.
3. Respondent Is a retiree from the United States Marines and a recipient of a Marine
pension I but upon retirement, Respondent did not elect the survivor benefit plan whictl, in the
event of his death, would provide pension payments to Petitioner.
4. Petitioner earns approximately one-third of the income of Respondent and is
supported, in part, by Respondent's payments for certain household expenses.
5. Petitioner believes and therefore avers that in the event of Respondent's denth prior
to the entry of a Decree In Divorce, she would be severely economically disadvantaged by the loss
of a pension benefit and Respondent's other income.

come to your office In hopes of providing some stipulations for the Master. Because there
Is not a lot of time before the hearing, I enclose a Notice to Produce directed to your client.
Of course, It wOIJld be better to have this Information In advance of the hearing In the
hopes of seltlng some matters to rest.
I enclose an asset list which I prepared for the Pre-trial conference. Perhaps you
will review It to let me know If you can stipulate to the values.
I can easily get both of your r.llent's pensions appraised. although I continue to
wonder why. As you may recall, there are not enough assets to offset these two plans.
Please let me know if your client has changed his mind and Is \'/lIl1ng to divide the
pensions. Please provide me the date of your client's commencement of military service
and the date of his retirement.
In the Pre-hearing Memorandum, your client 15 to have provided an Income and
Expense Statement. Your client 15 also supposed to provide a list of payments for which
believes he should receive credit In equitable distribution, Finally, I was to receive any
medical reports from any doctors treating Mr. Gilbert for conditions which you will claim are

dated September 2, 1998, the full-time Master has been appointed
in the above referenced divorce proceedings.
A divorce complaint was filed on July 18, 1996, raising
grounds for divorce of irretrievanle breakdown of the marriage.
No economic claims have been raised in the complaint.
The Defendant filed a request for economic relief with
respect to maintaining the status quo on a Federal Employees
Group life insurance plan. However, no economic claims have
been raised in the action and I am, therefore, not going to
issue a directive for the filing of pre-trial statements until
economic claims, if any are to be raised, have been properly
pleaded.
I will give counsel two weeks to raise economic claims
and if none are raised of record, then I will ask the Court to
vacate my appointment. If claims are raised, I will then issue
a directive for the filing of pre-trial statements. Inasmuch as

A divorce complaint was filed on July 1B, 1996,
raiBing grounds for divorce of irretrievable breakdown of the
marriage. No economic claims were raised in the complaint.
Counsel have advised that the parties will sign and file
affidavits of consent and waivers of notice of intention to
request entry of a divorce decree so the divorce can be
concluded under Section 3301(c) of the Domestic Relations Code.
On september 2, 199B, the Plaintiff filed a
petition raising the economic claim of equitable distributionr
on October 12, 199B, the Defendant filed a counterclaim ~aising
the economic claims of alimony, alimony pendente lite, and
counsel fees and costs.
The parties were married on May 27, 1962, and
separated by stipulation of counsel April 11, 1996. They are
the natural parents of two emancipated children.
There is an issue with respect to the factor of
marital misconduct as that factor may affect wife's alimony
claim. The question arises out of the circumstances surrounding
husband's relationship with one Sharon Group. Depending on how
one views the separation and subsequent reconciliation of the
parties, the time period when Ms. Group was involved with the
husband will have bearing on whether or not the alleged
relationship involving the claim of marital misconduct occurred
post separation or before the aeparation. In any event, in
order to try to resolve this issue attorney Lindsay is going to
take the deposition Qf Sharon Group, and then report to the
Master whether or not she needs to proceed with hearing on the
marital misconduct factor.
Husband is 59 years of age and resides at 712
Cumberland Avenue, Chambersburg, Pennsylvania, with Sharon
Group. He is a high school graduate and currently works at
Letterkenny. According to attorney Griffie, he is going to be
terminated in July 1999. He is also retired from the Marine
Corps and receives $993.00 net monthly income from his

retirement. He ia directed to file an incomu and expense
statement showing the income from his current position and also
to provide information regarding expenses that he haa paid to
the marital relationship since separation so that any credit
that he might be entitled to could be applied. In considering
what credit husband might be entitled to, a review has to be
made of what support he may have been obligated to pay, since
according to counsel ho was making payments relating to the
parties debts in lieu of paying alimony pendente lite or spousal
support. Consequently, counsel need to do a summary of the
payments that he was makin9 as that relates to the obligation
which he may have been required to make vis-a-vis alimony
pendente lite or spouEal support. Husband has a problem with
hia hands inVOlving calcium deposits. Mr. Griffie is going to
provide a medical report to attorney Lindsay. He is receiving
medical insurance benefits through his prior service with the
military.
Wife resides at 52 East Main Street, Newville,
Pennsylvania, where she lives alone. she is 55 years of age and
is a high school graduate. She is a teller at Members 1st and
shows a ret monthly income of $1,107.25. She is directed to
file an income and expense statement as no income and expense
statement has been previously filed on her behalf. Wife has not
raised any health issues. Her counsel believes that she can get
medical insurance benefits through her employment.
The parties own real estate at 52 East Main
street, Newville, Pennsylvania, where wife is residing. Wife
would like to retain the property as part of her equitable
distribution. counsel have stipulated that the value of the
property is $65,000.00. We will need an updated mQrtgage payoff
statement in order to determine the equity in the property.
There are three vehicles involved as marital
assets, namely, a 1993 Taurus, a 1987 Escort, and a 1993 Ranger.
Counsel are going to have the vehicles appraised and then get
the current payoff on loans in order to determine the net equity
in the vehicles as of the time of the hearing. The Escort is
not encumbered and counsel will si~ply use the appraised value
for that vehicle.
TherE are a number of checking and savings
accounts with Dauphin Deposit and Members 1st. Counsel are
going to get the date of separation balances on those accounts
and provide a stipulation as to what those balances were at
separation and how that money was Ultimately distributed between
the parties.
Listed on the pretrial statements are series E
savings bonds. Attorney Lindsay has valued those bonds at
$4,500.00 on her inventory. Counsel have indicated that they
will stipulate that the value of $4,500.00 as listed on the
inventory is the value to use in the equitable distribution
computation.
