DEFENDANT, Uni.Marts, Inc., by ils undersigned altorney preliminarily
objects to Plaintiffs' complaint as follows:
MOTION FOR MORE SPECIFIC PLEADING
AND CONFORMITY TO RULE OF COURT
1. Paragraph five(5) of Plaintiffs' complaint alleges that" During the
winter months of 1994, Defendant shoveled snow from the roof of the aforesaid store
room causing damage to the roof."
2. Pa. R.C.P. 1019<0 requires that" Averments of time, place. and items
of special damage shall be specifically Slated. "
3. fhe aforementioned paragraph five(5) falls 10 state with sufficient
specificity the time that said damage occurred to the roof, during the winter of 1994.
4. The aforementioned paragraph live(S) falls to Slate with suft1chmt

5. Paragraph nine(9) of Plaintiffs' complaint alh:ges " The Defendant under

7. The aforementioned paragruph of Plaintiffs' complaint fallb to set forth
with sufficient specificity the provis:on in the lease (Exhibit A) upon which the
Plaintiffs base their avennenl.
8. Pa. R.C .P. 1024(c) requires verification shall be made by one or more of
the parties filing the pleading unless (1) the pllrty lacks suftkient knowledge or
information or (2) are out.side the jurisdiction of the court and the verification of none
of them can be obtained within the time allowed for tiling the pleading. In such cases,
the verification may be made by any person having sufficient knowledge or information
and belief and shall set forth the source of his information as to malleI'S not stated upon
his own knowledge and the reason why the verification is not made by a party.
9. The veril1cation allached to Plaintiffs' Complaint was signed by all agent
of the Plaintiffs and fails to set forth a reason as to why verification was not made by a
party.
