Plaintiff, by and through ita counsel, Martsolf & Bratton,
respectfully requests that this Honorable Court enter an Order of
Sanctions against the Defendant for its repeated failure to make
discovery and, in support thereof, represents as followsl
1. Defendant has failed to comply with prior Orders of this
Court regarding the production of documents and only answered,
partially, Interrogatories which Plaintiff had propounded after
being ordered to do so by this Honorable Court.
2. On or about May 22, 1997, Plaintiff issued Noticea of
Deposition of employees of the Defendant and forwarded such Notices
to Defendant's general counsel advising him to make three

individuals available at specified times on June 12, 1997. Copies
of the Notices of Deposition are attached hereto and marked
collectively as Exhibit "A".
3. Without prior objection as to the date, time or place of
deposition and without any other objection to the proposed
discovery,

COMPLAINT
AND NOW comes Plaintiff, by and through its attorneys,
Martsolf & Bratton, and represents as folloWSI
1. Plaintiff International Products, Inc. is a Pennsylvania
corporation with a principal place of business or registered office
at 512T Shirks Church Road, Palmyra, Lebanon County, Pennsylvania.
2.
Defendant Uni-Mar.ts,
Inc.
is believed to be a
Pennsylvania corporation with a principal or regular place for
conducting business at 477 East Beaver Avenue, State College,
Centre County, Pennsylvania.
3. At all times relevant hereto, Defendant is and/or was the
owner of a certain part or parcel of real estate located at.
1958 Spring Road, Carlisle, Cumberland County, Pennsylvania.
4. On or abcut April 23, 1993, PlaintJ,ff and Defendant
entered into a Lease for approximately 1,000 square feet of. space
at the Defendant's premiaes at 1958 Spring Road, Carlisle,
Cumberland County, Pennsylvania. A true and correct copy of said
Lease is attached hereto and marked Exhibit "A".
5. On or about February 28, 1995, at tne insistence of the
Defendant, Plaintiff was forced to vacate the premises, despite th"
faot that the Lease provided for an initial five-year term, on the
basis that the Defendant intended to undertake improvements at the
property.
6. Plaintiff has never been in default under the terms of
the Lease.
7. Defendant has failed and refused and continues to fail
and refuse to complete promised improvements to the property as
provided in said I,ease and has never offered to the Pldntiff
comparable space at: comparable rates in the promiaed improved
premises nor in any other comparable location despite repeated
promises to do so.
8. Defendant has, therefore, breached the Lease with
Plaintiff.
9. As a result of the willful and intentional breach of the
Lease by Defendant, Plaintiff has suffered and will continue to
Buffer monetary damages and losses, including~
(a) A lOBS of monthly net profit from the operation
of its laundromat facility of approximately $1,500.00 per
month, which loss currently equals approximately
$25,500.00 and which loss will continue to accrue until
Plaintiff can reestablish itself in a new facility in and
aoout the Carlisle area or elsewhere,

(h) $1,060.00 representing the cost of storage of
equipment Defendant forced Plaintiff to remove from the
facility at Defendant's insistence and demand, which said
cost continues to accrue at the rate of $60.00 per month,
(c) An additional amount estimated to be
approximately $31,000.00 for refurbishing, refixturing
and improving an alternative facility when and if
Plaintiff is able to locate a site comparable to that
from which Defendant wrongf.ully tlvicted Plaintiff,
(d) An amount of approximately $630.00 representing
the amount of capital improvements which Plaintiff had
made at Defendant's propertYI and
(e) An amount of approximately $325.00 representing
the cost to insure Plaintiff's equipment while in
storage; and
(f) Such additional lost profits as Plaintiff may
incur if and when Plaintiff is able to locate a similarly
situated and conf igured site in or about the Carlisle
area for reestablishing its laundromat business.
10. As a further direct and proximate result of Defendant's
breach of the Lease, Plaintiff anticipates that it will incur
additional rent obligations over and above that which it would have
been required to pay under the Lease with Defendant, an amount not

MOTION FOR SANCTIONS
1. Plaintiff International Products, Inc. had propounded
Interrogatories and a Request for production of Documents addressed
to Defendant Uni-Marts, Inc. on or about November 15, 1996 and had,
on that date, served those discovery requests upon the Defendant.
2. When the Defendant failed to respond to such discovery
requests, Plaintiff filed a Motion to Compel Discovery and/or for
Sanctions on January 30, 1997. In response, this Honorable Court,
by Judge Kevin A. Hess, entered an Order dated January 31, 1997
issuing a Rule to show Cause why the relief requested should not be
granted and making such Rule returnable in ten days.
3. Said Rule to Show Cause was served upon the Defendant by
mailing of correspondence dated February 10, 1997.
4. On or about March 6, 1997, when the Defendant still
failed and refused to comply with the discovery requests or to file
an answer or response to the Rule, Plaintiff filed a Motion to make
the Rule absolute.
5, On March 7,1997, this Honorable Court, by Judge Kevin A.
Hess, entored an Order directing the Defendant to respond to the
Request for Production of Documents and to the Plaintiff's
Jnterrogstories within twenty days,
6. On April 7, 1997, Defendant, through its General Counsel,
torwarded Answers to Plaintiff's first set of Interrogatories but
has never responded in any fashion to the Plaintiff's Request for
Production of Documents.
WHEREFORE, Plaintiff respectfully requests that this Honorable
Court schedule a hearing in this matter and, thereafter, find the
Defendant to be in contempt of this Court's Order of March 7, 1397,
order the Defendant to pay the reasonable counsel fees incurred by
Plaintiff thus far in attempting to compel the Defendant to respond
to the lawful discovery requests of the Plaintiff which the
Defendant has ignored, and enter such other relief as thi~
Honorable Court deems to be just and appropriate under all of the
circumstances,

Pursuant to Pennsylvania Rule of Civil Procedure. 4019,
Plaintiff respectfully moves for an Order compelling Defendant's
response to certain discovery heretofore propounded by Plaintiff
and, in support of such Motion, represents as follows I
1. Plaint i ff is !nternat ional Products, Inc., a Pennsylvania
cor.poration with a principal place of business or registered office
at 512T Shirks Church Road, Palmyra, Lebanon County, Pennsylvania,

Defendant Uni -Marts,
Inc.
is believed to be a
Pennsylvania corporation with a principal or regular place for
conducting business at 477 East Beaver Avenue, State College,
Centre County, Pennsylvania.
3, On or about November 15, 1996, Plaintiff, by and through
its counsel, propounded a first Request for Production of Documents
directed to the Defendant and served the same upon the Defendant.
A true and correct copy of the Request for Production of Documents
is attached hereto and marked Exhibit "A".

4. On or about November. 2~, 1996, Plaintiff, by and through
its oounsel, propoun4ed and served upon Defendant Interrogatories
for, answer by the Defendant.
A true and cor.rect copy of the
Interrogatories is attached hereto and marked Exhibit "B".
5. Defendant has served no Answer.s, Objections or any other
response to such discovery despite Plaintiff's persistent; and
repeated requests for such discovery.
WHEREFORE, Plaintiff respectfully requests that this Honorable
Court enter an Order compelling Defendant to make discovery by
responding to the Request for Production of. Documents attached
hereto as Exhibit "A" and answering, fully, all of the
Interrogatories propounded upon Defendant by Plaintiff and attached
hereto as Exhibit "B", without further objection, and, upon failure
of the Pefendant to do so within fifteen (15) days of the date of
thtl Court's Order, to enter an O!:"der of Sanctions, inclUding an
Order requiring Defendant to pay Plaintiff's attorneys' fees with
regard to this discovery proceeding in an amount of $l,OOO.~O.

7. Plaintiff'B counsel served the said Rule to Show Cause
upon the Defendant by mailing same with his letter of February 10,
1997 addressed to Defendant's general counsel at the addreBs of the
S.:lme as endorBed upon Defendant' B Answer,
8. Defendant has failed and refused to respond in any
fashion to the discovery requests and has made no effort to contact
Plaintiff's counsel to reque~t extension or to explain Defendant's
failures.
WHEREFORE, Plaintiff respectfully moves that the Rule entered
by this Honorable Court on January 31, ],997 be made absolute and
that an Order of Sanctions be entered against the Defendant,
including, but not necessarily limited to, the followingl
(a) An Order precluding the Defendant from
disputing any facts concerning the lease of the premises
at 1958 Spring Road, Carlisle, Cumberland County,
Pennsylvania or disputing the wrongfulness of the
Defendant's eviction of the Plaintiff from such premises
on or about February 28, 1995 and precluding the
Defendant from raising any defense to liability
whatsoever;
(b) Awarding Plaintiff itB reasonable attorneys'
fees of not less than $1,000.00 for the prosecution.of
the Motion to Compel and/or for Sanctionsl and

Demolition waa commenced on August 15, 1996. Charles Shutter identified
in No.4. above, had agreed to purchase and then lease back tho property tu the
Defendant after the completion of improvements. However, Charlea Shuttar died
unexpectedly on or about June 6, 1995. In order to pursue the projact, the
Defendant was required to internally el10cate funds for some and reachedule
the work.
