1. ~he Plaintiff is Richard Russell Stone who resides at 2
Olive street, Wormleysburg, Cumberland County, Pennsylvania 17043.

Bosler Avenue, Lemoyne, Cumberland County, Pennsylvania 17043.
3. ~he Plaintiff and Defendant have been bona fide residents
of the Commonwealth of Pennsylvania for at least six months
immediately prior to tho filing of this Complaint.

1984 in Cumberland County, Pennsylvania.

THIS AGREEMENT made this y'i-\ay of (f) tl, , 1996,
and between Richard R. stone, (hereinafter referred to
"Husband,") and Leslie A. Stone, (hereinafter referred to
"Wife") .

WITNESSETH I
WHEREAS, the Husband and Wife were lawfully married on
December 23, 19831 and
WHEREAS, differences have arisen between Husband and Wife in
consequence of which they intend to live apart from each otherl and
WHEREAS, one child was born of this marriage, Adrienne Julia
Stono, born March 8, 19831 and
WHEREAS, HUsband and Wife desire to sottle and determine their
rights, obligations, support and custody of the childl and
NOW, THEREFORE, the parties intending to b'il legally bound
hereby do covenant and agree as followSI
1. SEPARATION
It shall be lawful for each party at all times hereafter
to live separate and apart from the other party at such place or
places 6S he or she may from time to time choose or deem fit. The
foregoing provisions shall not be taken as an admission on the part
of either party as to the lawfulness or unlawfulness of the causes
leading to their living aport.
2. INTERFERENCE
Each party shall be free from interference, authori.ty,
and contact by the other as fully as if he or she were single and
unmarried except as maybe necessary to carry out the provisions of
the agreement. Neither party shall molest the other or attempt to
endeavor to molest the other, nor compel the other to cohabit with
the other, or in any way harass or malign the other, nor in any way
interfere wJ.th the peaceful existence, separate and apart from the
other, and each of the parties hereto completely understand and
agree that neither shall do or say anything to the child of the
parties at any time which might in any way influence the child
adversely against the other party.
3. DIVISION or PERSONAL PROPERTY
'rhe parties have agreed to dtvide between them and
already have divided between them to their mutual satisfaction the
personal affects, household furntture and furnishings and all other
articles of personal property which hel'etofore have been used by
them in common. Neither party will make any claim to any such
items which are now in the possession or under the control of the
other.
4. AUTOMOBILES
The Wife is the owner of a 1984 Pontiac Bonneville. The
rights and title to the vehicle is to remain with Wife. Wife shall
maintain se~arate insurance on her vehicle and be responsible for
any and all loan payments related thereto. The Husband is the
owner of II 1989 Chsvy Corsica. The rights and title to the vehicle
is to remain with the Husband. Husband shall matntain separate
insurance on his vehicle and be responsible for any and all loan
payments related thereto.
5. DIVISION OF REAL PROPERTY
The real estate owned by the parties as tenants by the
entireties situated at 726 Bosler Avenue, Lemoyne, Cumberland
County, Pennsylvania shall be conveyed in fee simple to the W.l.fe.
Wife shall assume full responsibility for the payment of the
existing mortgages and notes. wife shall indemnify and save
husband harmless from any liability on the accompanying mortgages
and notes. Husband and Wife agree that Wife shall keep the home
until Adrienne graduates from high school. Wife shall not allow
any lien to be placed against the marital horne, other than the
current mortgage. Upon Adrienne's graduation from high school the
house shall be sold and Husband and Wife will equally split the
proceeds. Upon agreement of Husband and Wife they may sell the
marital home before Adrienne'S graduation and split the proceeds,
6. PENSION AND RETIREMENT ACCOUNTS
Husband and Wife shall maintain their separate pension
and/or retirement accounts. Husband relinquishes any and all
rights he may have in wife's pension or retirement accounts and
Wife relinquishes any and all rights she may have in Husband's
pension or rettrement accounts.
7. MARITAL DEBTS
Husband shall be responsible for the Personal Loan for
the Computer Loan through the NCFCU and NCFCU Visa account. Wife
shall be responsible for the Mortgage on the marital home, the loan
for the pontiac Bonneville and all her own credit cards. The

parties have a joint veterinary bill of approximately $700.00. The
parties aqree to equally sharo this obligation and shall each
contribute $50.aO/month until the balance is paid. Each party
shall indemnify and hold the other harmless for the debts
desiqnated in this Agreemont.
8. SHARlD CUSTODY
The parties agree that they shall share legal custody of
the child. This means that the parties shall consult with each
other regarding the major parenting decisions affecting the child's
health, education and welfare.
Primary Physical Custody shall be with Wife subject to
Temporary Partial Physical Custody to the Husband as the parties
may mutually agree. Neither party is to remove the child from the
Commonwealth of Pennsylvania for a period of 30 days without 60
dllYs written notice to the other. Such notice is to be by
certified mail, return receipt.
9. ALIMONY/CHILD SUPPORT
Husband agrees to pay Wife alimony in the amount of $100,00
per month for a period of 24 months. These alimony payments began
on March 1, 1996 and will continue until the last payment on
February 1, 1998.
Husband agrees to pay child support to Wife in the amount of
$500.00 or an amount determined to be appropriate by the Domestic
Relations Office or a court of competent jurisdiction, The support
payments will continue until the child becomes emanCipated, reaches
the age of 18 or graduates from high school. Father has
voluntarily agreed to include his step-son, Paul Joshua Goudy, in
the support determination. When Paul becomes emancipated, r.eaches
18 or graduates from h.igh school Father's support obl.igation will
be reduced to $250.00/month.
The parties agree that in the event of a material change
in the cost of living or the financial circumstances of either
party, or of a change in the custody arrangements set forth herein,
the amount of the support payments shall be subject to an
appropriate adjustment by agreement or, if the parties are unable
to agree, by the Domestic Relat.ions Office or Court of competent
jurisdiction.
10. FILING OF IRS RETURN
Husband and Wife agree to file a joint tax return for tax
year 1996 and separate tax returns for all subsequent years
thereafter.

18. BIIDIIG AFFECT
This agreement shall be binding upon the parties' heirs,
successors and assigns.
19. MODIFICATION AID WAIVER
Any modification or waiver of any of the provisions of
this agreement shall be effective only if made in writing and
executed with the same formalities as this agreement. The failure
of either party to insist IJpon strict performance of any of the
provisions of this agreement shall not be construed as a waiver of
any subsequent default of the s&ne or similar nature.
20. PRIOR AGREEMENTS
It is understood and agreed that any and all pdor
agreements which may have been made or executed or verbally
discussed prior to the date and time of this agreement ar.e null and
void and of no affect.
21. ENTIRE AGREEMENT
This agreemont contains the entire understanding of the
parties and there are no representations, warranties, covenants or
undertakings other than those expressly set forth herein.
22. DESCRIPTIVE HEADINGS
The descriptive headings \Ised herein are for convenience
only. They shall not have any binding affect whatsoever in
determining the rights or obligations of the parties.
23. APPLICABLE LAW
This agreement shall be construed under the laws of the
Commonwealth of Pennsylvania.
