COMPLAINT
1. Plaintiff, Calvin G. Grim, is an adult individual
residing at 560 criswell Drive, Boiling Springs, Cumberland County,
Pennsylvania.
2. Defendant, Claretha T. Grant, is an adult individual
residing at 128 North Third Street, Chambersburg, Cumberland
County, Pennsylvania.
). On July 21, 1994, Plaintiff, Calvin G. Grim, was fully
stopped at a red light northbound on Route 11 in a 1992 Toyota
pick-Up truck in Silver Spri.ng Township.
4. While stopped at the light, a 1987 Ford Taurus, driven by
the Defendant, Claretha T. Grant, slammed without warning into the
rear of the vehicle stopped behind the Plaintiff.
5. The stopped vehicle was forced to strike the rear of the
Plaintiff's vehicle which subsequently was forced into the rear of
the vehicle stopped directly ahead of the Plaintiff's vehicle.
6, Defendant owed a duty of care to Plaintiff t.o operate her
vehicle in a reasonable and safe manner and free from negligence.
7. Defendant breached this duty of care by committing the
acts of negligence more fully described in this complaint.
8. The accident resulted solely from Defendant's negligence
and recklessness as mor.e tully described herein, and wa~ not caused
by any act or failure to act on the part of the PlaintJ.ff.
9. This accident was due to Defendant's negligence in that~
(a) She failed to properly operate and control her vehicle;
(b) She tailed to maintain the proper lookout for other
vehioles;
(c) She violated the laws and the statutes of the
Commonwealth "f Pennsylvania and the cornman law regulating and
governing the operation of motor vehiclos on the streets and
highways including, but not limited to, 75 Pa.C.S 53361;
(d) She failed to have her motor vehicle under proper and
adequate control given the circumstances;
(el She failed to maintain an assured clear distl\nce between
her vehicle and Plaintiff's;
(f) She operated har vehicle in a reckless and careless
manner under the circumstances then present;
(g) She breached her duty of care to Plaintiff to operate the
vehicle in a safe manner; and,
(h) She operated her vehicle without regard for the right,
safety and position of Plaintiff.
10. As a direct and proximate result of the foregoing acts of
nllgligence and recklessness on the part of the Defendant, Plaintiff
was injured.
11. Plaintiff's body was severely jolted and shaken when his
vehicle was struck in the rear and the jolting and shaking of his
body was repeated when his vehicle was forcpd into the vehicle in
tront ot him.
12. Plaintitt suttsred and continues to sUfter trom injuries
sustained includinq, but not limited to, the following I
(e) A rotator cutt tear with resulting permanent impairment,
(b) Spasm in his neck,
(c) Large intrasubstance tear of the distal supraspinatus
tendon with a tull thickness distal tear ot the same tendon with
resultant myotendinous retraction,
(d) pllin in the lateral aspect ot his right hip over the
qreater trochanteric area radiating down the lateral aspect of his
right leg,
(e) Marked tenderness along the teres minor and infraspinatus
on the left,
(t) spasm in the left paralumbars and buttock, and,
(g) Tears of the tibialis anterior, gluteus maximus and
subsequently spasm of the hamstring.
WHEREFORE, Plaintiff prays tor judgment against Defendant in
the amount in excess of $20,000.00, plus interest and costs as the
law may allow.
