3. The parties were married on June 25, 1993,
4. One child was born of the parties' marriage, namely,
Jennifer Lynn Smith, born December 13, 1993.
5. On July 17, 1996, while on vacation in the state of
Delaware, a disagreement ensued between the parties. As a result
of this disagreement, Mother contacted the Delaware State Police
since Father refused to allow Mother to see Jennifer
6, Upon the advice of the Delaware State Police, Mother
did not return to the house where the parties were staying in
Delaware on July 17, 1996, but stayed overnight in a local motel.

the custody of the child in this or another court.
PlailttHf has no information of a custody proceeding
concerning the child pending in a court of this Commonwealth.

D. Defendant shall have the right to partial oustody
from Tuesday, July 30, 1996 at 6100 p,m. to Friday, August 2,
1996 at 6100 p.m.
E. Plaintiff shall have the right to partial custody of
the ohild set forth in paragraph 2,B., from Friday through
sunday, then the Defendant shall have the right to partial
oustody of the child set forth in paragraph 2,C., etc.
3. The parties shall continue alternating the periods of
partial custody set forth in paragraphs 2.B. through 2.D. above
until the agreement of the parties is modified, in writing, by
another stipulation and/or Court Order.
4. The parties shall, at all times, foster a positive,
meaningful and loving relationship between the child and the other
parent, and neither parent Rhall say or do anything whioh would
cast the other parent in an unfavorable or negative light to the
child, it being specifically agr~ed that neither parent shall make
any detrimental or disparaging comments about the other parent to
the child or in the presence of the child that would in any way
denigrate the other parent.

Plaintiff, Cathy Crall Smith, who is represented by sandra L.
Meilton, Esquire, and the law firm of Hepford, Swartz & Morgan, and
the Defendant, Douglas L. Smith, who is represented by Gary L.
Rothschild, Esquire, and the law firm of Serratelli, Sohiffman,
Brown & Calhoon, P,c., and agree as followsl
1. The parties shall share legal custody of tho ohild,
Jennifer L. smith, born December 13, 1993.
2. The parties shall share physioal custody as set forth
below on a temp/')rary pasis until a permanent physioal custody
arrangement is arrived at via Conciliation or jUdicial
determination:
A. The Plaintiff shall have the right to partial custody
with the ohild from Monday, July 22, 1996 at 6:00 p.m. through
Friday, JUly 26, 1996 at 6:00 p.m.
D. The Oetendant shall have the right to partial oustody
with the ohild trom Friday, July 26, 1996 at 6100 p.m. through
sunday, July 28, 1996 at 6100 p.m.
c. Vlaintiff shall have the right to partial oustody of
the child from sunday, July 28, 1996 at 6100 p,m. through
Tuesday, July 30, 1996 at 6100 p,m.
D. Dofendant shall have the right to partial oustody
trom Tuesday, July 10, 1996 at 6100 p.m. to Friday, August 2,
1996 at 6100 p.m.
E. Plaintiff shall have the right to partial oustody of
the ohild sot forth in paragraph 2. B., from Friday through
Sunday, thon the Defendant shall have the right to partial
cu.tody of the child set forth in paragraph 2,C., eto.
3. The parties shall continue alternating the periods of

environment free from the use of alcohol, and tobacco products,
during their custodial periods.
B. Both parties shall keep the other informed of their
current telephone number and address,
9. Any major modifications to this stipulation shall be in
writing. Minor modifications or adjustments may be done orally by
the parties.
10. The parties agree that the transportation of the minor
child shall be shared with the transfer of the child to take place

of the Concllletor's Report, It appeerlng that tha parties have reachad en agreement
whIch Wes dictated In their presence and epproved by them and their counsel, It Is
hereby ordered and directed as follows:
1. All prior orders entered In this case ere vacatad.
2. The parties will share legel custody of Jennifer Lynn, DOB 13 December
1993,
3, Mother shall have primary physical custody of the minor child, subject to
porlods of partial oustody and visitation with father as follows:
A. On alternating weekends from Thursday at 5:00 p.m. until
Sunday at 6:00 p.m. This alternating weekend to begin on Thursday,
September 26, 1996.
B. Every Tuesday evening from 5:00 p.m, until Wednesday
morning at 7:00 a.m. Father will drop off the child at either mother's
house or the epproprlata dey cere provlner,
C, 011 Thursday evenings from S:OO p.m. until Friday at 7:00
a,m. Father will drop off the ohlld at either mother's house or the
appropriate day oore provider,
4, Tha parties will alternate the major holidays, those holidays being deflnad
liS Thenksglvlng, Easter, Memorial Day, Fourth of July, IInd LlIbor Day. Mothar will
begin this alternatIng holiday sohedule with Thanksgiving of 1 996.
S, The Chrlstmes holiday will be In accordance with the following !Sohedule:
A, Mother - Christmas Eve at noon until 11 :00 a,m, on
Chrlstmes Day;
,B, Father - 11 :00 a,m. Christmas Day until 2:00 p,m,
Chrlstmes Day;
C. Mother - 2:00 p.m. Chrlstmes Day until 6:00 Christmas Day;
D, Father - 6:00 p.m. Christmas Day until 6:00 p,m, on
Deoember 27th.
6. Both pllrtles will be entitled to four weeks of non-consecutive,
uninterrupted vacation with the child. Tha parties will provide each other with
thirty (30) days notice. The first perty to provide notice will be antltled to thet
specific week chosen,
7. Mother shell have the child on Mother's Day and the father shall have the
Child on Father's Day.
8. The parties agree that they will shere the child's blrthdey,
