COMPLAINT
AND NOW, come the Plaintiffs, Vlrglnle Capriotti and Blair Capriotti, her
husband, by and through their attorneys, Hepford, Swartz & Morgan, and file the
within Complaint, and In support thereof ever as follows:
1. Plelntlff, Virginia Capriotti, Is an adult Indlvlduel residing at 2418 Wood
Avenue, Bristol, Pennsylvania 19007,
2. Plaintiff, Blair Capriotti, 15 an adult Individual residing at 2418 Wood
Avenue, Bristol, Pennsylvania 19007,
3. Defandant, Radlsson, Penn Harris Hotel & Convention Center, Is a
corporation existing under the laws of the state of Pennsylvania, with a principal
place of business at 1150 Camp HIli By-Pass, Camp HIli. Pennsylvania 17011-3734.
4. Defendant, Radlsson Hotels International, Incorporatad, 15 a corporation
existing under tha laws of the state of Minnesota. with a principal place of business
at Carlson Parkway, P,O. Box 59159, Minneapolis, Minnesota 55459-8204.

5. Defendant, Metro Hotals, Is 0 oorporotlon existing under the laws of the
state of Texas, with 0 principal placa of bualness at BOBO North Central Expressway,
Suite 1600 LB82, Dallas, Texas 75206.1819.
6. On July 30, 1994, Mrs. Capriotti was a guest at the Radlsson, Penn
Horrla Hotel attending a dance competition for her daughter, She wes registered In
Room 1110 of the hotel.
7. At approximately 10:00 p,m" Mrs, Capriotti exited her room and walked
towards her ven, which wes 111 the parking lot owned and operated by Defendants.
As Mrs. Capriotti stappad 011 the curb and onto the parking lot beside her ven, her
foot landed In a deep hole In the pllvement, causing her to fell,
8. At the aforementioned time and place, Defendant was nllgllgent,
corelesn and reckless as follows:
(a) Failing to provide a safa area for Ingress and egress tor
Plelntlff between her hotel room and her vehicle;
(bl Flllllng to repelr the dangerous condition created by the
hole In the parking lot pavement;
(cl Failing to warn Plaintiff of the dangerous condition creatad
by the hola;
(dl Failing to erect a barrl"r around the hole to prevent patrons
from stapplng In It;
(e) Allowing the dangerous condition created by the hole to
exist In an erea where business Invltees, such as Plaintiff, routinely
walk;

premises for the presence of dangerous conditions such as the one then
and there existing;
9. The above-described Incident wss caused solely by tha negllgenca,
ceraleunass, and rllcklessness of Defendants as etated herein. and was In no
mannar dua to any act or failure to act on the part of Plaintiffs.
10. As a direct foresaeable and proximate result of the Incident described
above, Plaintiff, Virginia Caprlolll, sustained savere and permanent Injurlc3s as more
fully described hereafter.

11. Paregraphs 1 through 10 of the within Complaint are Incorporated herein
by reference.
12. At the time of the Incident complained of, Plaintiff, Virginia Caprlolll,
was a business invitee, Dafendants owed Plaintiff a higher duty of care which
includes a duty to anticipate the existence of and Inspect for dangerous conditions
existing on the premises,
13. Defendants, through Its agents, ostensible agents, servants, workers,
and/or employees, either knew, or in the exercise of reasonable care should have
discovered, the dangerous condition then end there existing on Its property.

14. As a rasult of tha above Incident, Plaintiff sufferad numarous sevara and
perml!lnant In/urles, Including but notllmltad to the following.
(a) An avulsion fracture of the tip left fibular malleolus;
(b) Disruption of the anterior flbular-telar ligament and
disruption of the fibular collateral ligament on the left;
(01 Partial dlsrLlptlon of the posterior atar-talM ligament and
posterior half of the daltold ligament on the laft;
(d) Spasms of the lumbar region;
(a) Soft tissue Injuries to the low back;
(fl Physical pain and suffering; and
(g) Mental pain and suffering.
15. As a sole and proximate result of Defendants' negligence, carelessness,
and recklessness as aforesaid, Plaintiff, Virginia Capriotti, Incurred, and will continue
to Incur for an Indefinite time in the future, expenses for medlcol end surgical
procadures, hospitalization, medical suppllas, surgical appliances, medicines, and
attendant services,
16. As a sole and proximate result of Defendants' negligence, carelelisness,
and recklassness as aforesaid, Plaintiff, Virginia Capriotti, has suffered and continues
to suffer embarrassment, humiliation, pain and suffering, mental anguish, emotional
distress, and a loss of IIfa's pleasures generally.
17, As a sole and proximate result of Dafendants' negligence, carelessness,
and recklessness as afurasald, Plaintiff, Virginia Capriotti, has suffered, and may
continue to suffer, other financial losses beyond that which sha may otherwise be
entitled to recover,

18. As a sole and proximate result of Defendants' negllgenoe, oarelessness,
and reoklessness es aforesaid, Plaintiff, Virginia Capriotti's general haalth, strength,
and vitality have been Impaired, and may bo Impaired In tho futuro,
WHEREFORE, Plaintiff demondsjudgmont against Defendants In an amount In
axcess of the limits for compulsory arbitration, plus Intarest and costs of this

21. By reason of the negligent, careless and reckless conduct of
Defendants, as set forth above, Plalntlff, Blair Capriotti, has baen deprlvod of the
assistance, society I and services of his spouse, Virginia Capriotti, all of which have
been to his great loss and detriment.
22. By reason of the negllgent, llareless and reckless conduct of
Defendants, as set forth above, Plaintiff, Blair Capriotti, has Incurred, and will
continue to Incur, medical expenses for the treatment of the aforeseld Injuries
sustained by his wife, Virginia Capriotti.
