COMPIAINT
1. Plaintiff, Juliana Marie Bence, is a resident of Cumberland County,
Pennsylvania.
2. Defendant, Unique Travel Services, rnc" is a corporation duly
incorporated under the laws of Florida State, with its principal place of
business at 7625 Estapona CirCle, Suite 201, Fern Park, Fl 32370,
Defendant conducts business in cumberland County, Pennsylvania and
satisfies the requirements for personal jurisdiction under 42 Fa. Cons,
stat, see, 5301, et aeq.

4, The offor came to tho attantion of plaintiff in Cumborland county,
Pennsylvania.
0, On or about March 3, 1990, plnintiff cnlled de fondant for information
on tho offer In Bahamas Cruiae Vacation Package).
6, On or about March 3, 1995, plaintiff or.dored the par,lkago from the
defendant at a total price of $299,00,
7. On or about March 4, 1995, a E'ederal Express package arrived at the
plaintiff' II home in cumberland County, Pennsylvania, with the travel
information Bnd reservation forms,
8. On or about March 4, 1995, plaintIff accepted the offer. by giving a
money or.der. in the amount of $299.00 to the Federal Expres6 agt1nt,
representative for the defendant.
9. On or about March 8, 1995, plaintiff signed and mailed the ActIvation
Warranty entitling plaintiff to the vacation package within 14 months
(prior to May 8, 1996) with an option to pay $75,00 and oxtend the time of
travel an additional 12 months (prior. to May 8, 1997),
10. The terms of the vacation package required returning the reservation
form with the requested vacation dates 60 days before the requested date of
t ravel. The requested date to be prior to May 8, 1996. In the
alternative, plaintiff could return the reservation form with a fee of
$75,00 requesting a 1 year extension in which to take the vacation provided
the extension was requested pr ior to May 8, 1996, In the event of an
extension, plaintiff was informed that a new reservation form would be sent
to plaintiff for use when the extension was approved,
11, On or about August 31, 1995, defendant mailed to plaintiff an
acknowledgment of plaintiff's vacation package indicating defendant had not
received the reservation form rp.questing a vacation date,
12, On or about February 1996, plaintiff repeatedly phoned defendant
requesting extension information. After repeated attempts, plaintiff was
finally able to talk with a representative of defendant who instructed her
to send a check or money order in the amount of $75,00 along with the
reservation form with the words EXTENSION written on the form to defendant,
The representative reaffirmed the terms of the package stating defendant
would send a new reservation form when the extension was approved for
plaintiff's use,
13, Approximately several days later, plaintiff called back and received
the same information about the new extension form and that the $75,00 and
old reservation form should be sent to defendant by regular mail,
14, On or about f'ebruary 23, 1996, plaintift poated by regular mail a
money order for ~75,00 and the reeervatlon form properly filled out
requesting an extension addreaaed to defendant,
15, On or about April 1, 1996, plaintiff attempted to contact defendant by
phone repeatedly, Plointiff left several measaqea which were never
returned,
16. On or about April 12, 1996, plaintiff requested that plaintiff'a
attorney att'~mpt to contact defendant concerning plaintJ.ff's vacation
package.
17, On or about April 12, 1996, plaintiff' a attorney contacted defendant
and spoke with SARITA who identified herself aa the manager of the
extension department, SARITA aasured plaintiff's attorney that a new
reservation would be aent out that day 130 plaintiff could requeat a travel
date,
18, On or about April 24, 1996,

Plaintiff's attorney spoke with SARITA who
handling this problem,
19, On or about April 24, 1996, plaintiff's attorney contacted defendant's
customer service. The customer service representative stated that the
package had already expired and that SARTTA was not the manager of the
extension department but had all the information and was handling the
problem, Plaintiff's attorney attempted to seek a refund to which
defendant's repreaentative stated she could not authorize a refund and that
a written requeat muat be submitted to Ms, Xynides for a refund.
20, On or about May 30, 1996, pla.lntiff's attorney sent a formal request
for a refund to Ms. Xynidea in the amount of $374,00,
21, On or about July 19, 1996, plaintiff's attorney submitted a praecipe
for Writ of Summons, The Wri t of Summona was issued by the P.rothonotary on
July 19, 1996,
22, On or about July 23, 1996, plaintiff's attorney mailed by certified
mail, restricted delivery, a true copy of the Writ of Summons to defendant
at defendant's principal place of business.
23, On or about July 26, 1996, defendant's agent accepted service of the
Wri t of Summons.
24, As of October 8, 1996, neHher plaintiff nor plaintiff's attorney has
received a new reservation form or a refund of any money.
