AND NOW, comes the Defendants, Philip 1\. Recklilr and Larry S,
Snyder, by their attorneys, Broujos, Gilroy & Houston, ~.c., who
answer and aver as followSI
ANSWBR
1. Admitted in part and denied in part. It is admitted that both
Defendants were tenants of the Plaintiffs for the premises located
at 434 3rd Street, West Fairview, Pennsylvania (hereinafter "leased
premises"). After reasonable investigation Defendants are without
knowledge sufficient to form a belief as to the truth of the
remaining averments of Paragraph 1 and they are, therefore, deemed
to be denied.
2. Denied. It is specifically denied that the Defendants failed
to maintain the premises. By way of further answer the Defendants
did in fact maintain the premises in good repair and condition,
natural wear and tear excepted. It is, furthermore, specifically
denied that the premises were subleased. By way of further answer,
with the Plaintiffs consent 1 tenants to the premises were
substituted during the month to month tenancy. It is, furthermore,
specifically denied that Defendants were responsible for municipal
sewer and tralh b~lll in that Plaintiffs had waived any
requirements of the Defendants to pay said utilities.
3. After reasonable investigation the Defendants are without
knowledge sufficient to form a he lief as to the truth of the
averments of Paragraph 3 and they arlil, therefore, deemed to be
denied,
4. Admitted in part and denied in part. It is admitted that
Exhibit B is a copy of the lease agreement dated March 1, 1994
which is the original lease entered into between the parties. It
is specifically denied that Defendant Larry S. Snyder was a tenant
at the time of termination of the tenancy with Philip Rocker. It
is specifically denied that Defendants had a duty to surrender the
keys to the premises to Plaintiffs, beoause Plaintiffs had ohanged
the locks to the premises.
5. Denied. It is specifically denied that Defendants, at any
time, tampered with or otherwise damaged the hot water valve.
6. Denied. It is specifically denied that D~fendants tampered
with Qr otherwise damaged the hot water hearer. After reasonable
investigation, the Defendants are without knowledge sufficient to
form a belief as to the truth of the remaining averments of
Paragraph 6 and they are, therefore, deemed to be denied.
7. Denied. It is specifically denied that the washer and dryer
were damaged by the Defendants. By way of further answer, the
washer and dryer were fully functioning at the time of the
termination of the tenancy of Philip Recker.
8. After reasonable investigation, Pefendants are without
knowledge suffioient to form a belief as to the truth of the
avermsnte of Paragraph 8 and they are, therefore, deemed to be
denied.
9. After reasonable investigation, Defendants are without
knowledge suffioient to form a belief as to the truth of the
avermollte of Paragraph 9 and they are 1 therefore, deemed to be
denied.
10. After reasonable investigation, Defendants are without
knowledge sufficient to form a belief as to the truth of the
avermente of Paragraph 10 and they are, therefore, deemed to be
denied.
11. After reasonable investigation, Defendants are without
knowledge sufficient to form a belief as to the truth of the
averments of Paragraph 11 and they are, therefore, deemed to be
denied.
12. Denied. It is speoifioally denied that Defendants were
responeible for returning keys to the Plaintiffs.
13. After reasonable investigation 1 Defendante are without
knowledge sufficient to form a belief as to the truth of the
avermente of Paragraph 13 and they are, therefore, deemed to be
denied.
14. After reasonable investigation, Defendants are without
knowledge sufficient to form a belief as to the truth of the
avermente of Paragraph 14 and they are, therefore, deemed to be
denied.
15. After reasonable inveetigation, Defendant" are without
knowJ,edge euffioient to form a belief as to the truth of the
averments of Paragraph 15 and they are, therefore, deemed to be
denied.
16. After reasonable investigation, Defendants are without

It is speoifioally denied that Defendants are
responsible for Plaintiffs' attorneys fees.
WHBRBFORB, Defendants requelt this Honorable COUtt to enter
judgment in favor of the Defendantl and against the Plaintiffs.

21. Paragraph 1 through 20 of Defendants' Answer are incorporated
herein by referenoe al if set forth in their entirety.
22. On or about March 1, 1994, William Teets and the Defendante,
Philip Recker and Larry Snyder, e~tered into a leaee agreement with
Bdward H. Stoddart for the leued premiaes for a term of 3 months
at a rental of $500 per month.
23. On or about March 1, 1994, the Plaintiffs received a eecurity
deposit from Defendants in the sum of $500.
24. Upon conolusion of the term of the written lease agreement,
whioh is attaohed to Plaintiffs' Complaint and marked as Exhibit B,
a month to month tenanoy was created.
25. On or about early Fall 1995, Defendant Larry S. Snyder vacated
the lease premiaes whioh faot the Plaintiffs were aware of and
consented to.
26. On or about April 1996, Defendant Philip Recker reoeived an
eviction notioe giving Defendant Philip Recker until May 8, 1996
within whioh to vaoate the premises.
27. On or about May 6, 1996, the Plaintiffs changed the looks to
the leased premises.
28. Within thirty days of May 6, 1996, Attorney John Lyons
notified Attorney Jordan Cunningham, who represented the
Plaintiff., of the forwarding addre.. for Philip Recker.
29. Within thirty day. of Hay 6, 1996, the Plaintiff. mai11d a
letter to Defendant Philip Reoker whioh did not, however, include
any written li.t of any damage. to the lea.ehold premises.
30. At the time of Plaintiff.' termination of Defendant Philip
Reoker's oooupanoy of the premise., the premise. were in as good
repair and oondition as of the commenoement of the lease exoept for
normal wear and tear, a dent in an attio wall and a replaoement
door which Defendants had purohased, whioh had not yet been hung.
31. At the time of termination by Plail\tiffs of Defendant Philip
Reoker's oooupanoy of the leased pr~mises, the waeher and dryer
were fully funotional.
32. At no time during the original term of the loase or during the
month to month lease did either of the Dofendants tamper with or
otherwise oause any damage to the main hot water v~lve, hot water
heater, washer and dryer, and lawn and garden.
33. At the tim~ of the termination of Defendant Philip Reoker's
oooupanoy of the premises there was another tenant in the premises,
David Shutt, whose occupancy of the premises was consented to by
the Plaintiffs.
34. During the course of both Defendants' occupancy of the
premises the Plaintiffs regularly viewed the leased premises and
never made any objections to the manner in which the Defendant.

35. Not until approximately one month prior to the termination of

36. Plaintiffs' failure to provide to Defendants with. written
itemized list of dama'iJes to the leaeed premises within thirty day.

escrow, inoluding any unpaid interest thereon, or to bring .uit
against the Defendants for damages to the leasehold premise..
37. As a result of Plaintiffs' failure t,o comply with thIJ
requirements of 68 P.S. 250.512, the Defendants are released from
any liability for any damagas to the leasehold premises.
38. Plaintiffs' failure to notify Defendants in a timely fa.hion
with any sewer and trash bills for the leased pnmises renden the
Plaintiffs' guilty of laches and the Plaintiffs are further
e.topped from oolleoting any trash and sewer obligations from
Defendants which may have accrued durin'iJ the tenancy, either durin'iJ
the original term or the month to month tenancy.
39. The Plaintiffs have waived any responsibility that Defendants
may have had, if any, for payment of sewer and trash for the leued
premilles.
40. The tect that Plaintitfs changed the locks to the leaaehold
premiae. provided justifioation for Defendant Philip Reoker in not
returning to Plaintiffs any keYB to th~ leaBed premiseB.
41. The PlaintiffB have failed to apply Defendants Becurity
depoBit to any of PlaintiffB' lOBBeB, if any.
42. The Plaintiffs conBented to Larry S. Snyder vacating the
premieeB1 without making any olaim for any dal1lllges and he ie,
therefore, releaBed from any responsibilities, obligations, or
other dutieB to the PlaintiffB from any damages, if any.
WHEREFORE, DefendantB request thiB Honorable Court to enter
judgment ;,n favor of the Defendants and againBt the Plaintlfh.

44. PlaintiffB have failed to pay Defendants the security depoBit,
being $500, deposited with PlaintiffB, including any unpaid
intereBt thereon 1 within thirty days after termination of the lease
or surrender and acceptance by Plaintiffs of the leased premises.
45. In accordanoe with 68 P.S. 250.512(0) the Plaintiffs are
liable to double the amount of the seourity deposit, including any
unpaid interest thereon.
