AND NOW, comes the Plaintift8, PAUL DeHART and MARIAN
DoHART/ his wife, by and through their. attorneys, MANCKE, WAGNER,
HERSHEY & TULLY, and files the following Complaint:
1. The Plaintiffs, PAUL DeHART and MARIAN DeHART, his
wits, ~re adult individuals currently residing at 641 Cedar Ridge
Lane, Hechanicsburg, Cumberland County, pennsylvania.
2. The Defendant, EWING ROOFING, INC., is a
Pennsylvania corporation having as an address 1425 Spanglers Hill
Road, Camp Hill, Cumberland County, Pennsylvania.
3. In July of 1994, Defendant installed a roof on
Plaintiffs' home.
4. During the winter of 1995-1996, Plaintiffs
sustained conBiderable water damage to the interior of their home
causing damage in the amount of $520.00 to the home in the form
ot ceiling tile and walls being destroyed by the penetrating
water.

the neqliqenoe and oarelessneas ot Defendant in installin9 the
root in thatl
(a) the roof was improperly attached at the eavesl
(b) the root was attached in such a way as to allow
water to penetrate the interior of the hOlUOI
(0) the root was not p~operly installed so as to
prevent water from penetrating into the interior
of the home.
6. As a result of the aforementioned negligence ot the
Dstendant/ Plaintitfs have sustained damage in the amount of
$520.00.
WHEREFORE, Plaintiffs pray this Court to grant judgment
in tavor ot Plaintiffs against Defendant in an amount requiring
arbitration.

AND NOW, comes the Defendant, Ewing Roofing, Ino. ("Ewingll),
by and through its attorneys, Saidis, Guido, Shuff and Masland, and
files the following Answer and New Matterl

4. Denied. After invelltigation, Ewing is without sufHcient
knowledge or belief to admit or deny the allegations of this
paragraph.
5. Denied. It is specifically denied that the alleged water
leakage was caused by Ewing'S carelessness or negligence. To the
contrary, Ewing avers that any water leakage was caused by the
build-up of ice and snow on Plaintiffs' roof during the severe
winter of 1996. In January, 1996, Ewing received hundreds of calls
per day from homeowners experiencing leaks because of the
accumulation of snow and ice on their roofs.
Furthermore,
Plaintiffs' roof has e collection box, instead of a gutter, where
water from the roof gathers before going into the downspout. Any
alleged damage to Plaintiffs' home was caused by leaves clogging
the collection box on the roof which forced water to leak into the
