'ilt., ,,' (',-,,,,/ '-;'--1996 FLYING J INC., Defendant CIVI~ ACTION - LAW COMPLAINT AND NOH, comes Hartman and Associates, Inc./ by and throuqh its attorneys Saidis, Guido, Shuff & Masland, and respectfully avers the followingl 1. Plaintiff, Hartman and Associates, Inc. , is an engineering firm and Pennsylvania corporation with its principal place of business located at 2101 Orchard Road, Camp Hill, Cumberland County, Pennsylvania, 2. Defendant is Flying J Inc., a corporation doing business at P. O. Box 678, 50 West 900 South, Brigham City, UT 84302-0678. 3, On or about November 8, 1993, Plaintiff entered into an agreement with Defendant wheroby Plaintiff agreed to provide engineering services for certain projects in cumberland County, Pennsylvania. 4. Pursuant to the agreement, Plaintiff was to perform these services and Defendant was to pay the normal, customary and usual fees for these services, 5. Invoices were mailed to Defendant setting forth the services which had been rendered by Plaintiff on Defendant's behalf, the amount being charged for the services, and any outstanding balance due on prior invoices. 6. Although some of the invoices have been paid, there 3 remaine an outstanding balance of Thirteen Thousand Nine Hundred Forty-One and 34/100 Dollars ($13,941,34)/ due to additional work that was completed by Plaintiff Bnd requested by Defendant. A oopy of the latest invoice is attached hereto, made a part hereof and marked as Exhibi t "A", 7. Plaintiff has performed its s~rvices for the Defendant fully and satisfactorily, and conformed to and complied with all of the terms and conditions required of it "nder the agreement between Plaintiff and Defendant. 8. Despite Defendant's obligation to pay Plaintiff and despite repeated demands on Defendant to maka payment, Defendant has wrongfully failed and refused to pay Plaintiff the outstanding balance of Thirteen Thousand Nine Hundred Forty-One and 34/100 Dollars ($13,941.34).
