MC CLURE, Respondent PIlOTEC1'ION FROM ABUSE NOTICI TO PBTITIONBR OR WITNBSSI IKKBDIATBLY CALL TUB POLICI (911) IF TUB RESPONDBNT VIOLATES THIS PROTBCTION ORDER. PROTBCTION OIlDER AND NOW/ this 11~~'day of June, 1996, after a hearing in this matter and upon finding that Petitioner has been abused within the meaning of the Protection From Abuse Aot and is in danger of further abuse from Respondent, the following Order is entered I 1. Respondent, ChatOs N. Mc Clure, date of birth July 29, 1971 and social security number 456-15-9197, is prohibited from approaching, abusing, harassing, or threatening Petitioner, or placing her in fear of abuse, eithnr ph~sically or verbally, wherever she may be. 2. Respondent is prohibited from entering, attempting to enter, or remaining in the premises at an undisclosed location, Harrisburg, possession and control of said premises being hereby doclared to be exclusively in Petitioner. Should Respondent enter, attempt to enter, or remain in the premises in violation of this Order, the Sheriff or local law enforcement ~ agenoy ahall forthwith eject him trom the promiaea and place him under arroat for indirect criminal contempt. Should Petitionor chooae to establiah another reaidence in the Commonwealth, Reapondent ahall alao be exclUded from that residence. 3. Respondent is prohibited frem having any contact with Petitioner, including entering or telephoning Petitioner's home, school o~ place of employment. Any contacts believed by Respondent to be neceaaary ahall be mado either through legal counael or by non-threatening mail addreasod to Petitioner' a home addresa. 4. Respondent ia prohibited from atalking Petitioner as that term ia defined in the crimea Code, 18 Pa. C.S. 62709. 5. Respondent is directed to ref.rain from all haraasing communication with PetJ.tioner'a relatives. 6. Reapondent is directed to allow Petitioner to peacefully retrieve her personal possessions with the aid of a police officer having appropriate jurisdiction, said polico assistance being deemed necessary and appropriate by the Court in order to prevent the possibility of further abusive conduct and otherwise to enforce the intent of this Protective Order. 7. Respondent is directed to enroll in a private or publicly funded professional psychological counselling program concerning domestic violence and Respondent's history of abusive conduct toward Petitioner within two (2) weeks of the entry date of this order1 Respondont shall remain in counselling until Reapondent's therapist has determined that no further benefit is , l~kely to result trom the oontinuation ot suoh oounselling. If it is determined that Respondent also has a drug or alcohol problem, Respondent is further directed to onroll and partioipate in a profeBsional treatment program for aloohol/Bubstanco abuse. Proof ot Reapondent'B compliance with these provisions shall be filed with the Court within thirty (30) days of the entry date ot this Order. Pursuant to 23 Po. C.S. ~6113(g), Reapondont is hereby notified that violations of thia Ordor will subject him to arrest under subsection ~ 6113 and/or contempt of oourt undor subsectiona ~6114 and ~6114.1. specifically, Respondent is notified that should he bogin living with Petitioner contrary to the provisions of this ordor, ho may be in indirect criminal contempt or civil contempt. Tha consent of Petitioner for Reapondent to visit or live with her ahall not invalidate this Order or otherwise make it unenforceable. Respondent shall seek modification or termination of this Order before commencing or resuming any cohabitation with Petitioner. This Order shall be enforced by any law enforcement agency in any county where a violation has occurred. An arrest for violation of this Order may be without warrant upon probable oause whether or not the violation is committed in the presenoe of a police officer. 23 Pa. C.S. 56113(a). Upon finding a violation ot a protection order or court-approved consent agreement under subsootion ~6113(o) and/or subsection ~6113.1, the court may hold Rospondont in indirect criminal contempt and punish Respondent in accordance with law. A sentence for indirect criminal contempt may include a fine of not less thmn $100, nor more than $1000.00, or up to six (6)I months imprisonment, or both, and may incll~de other reliet. Disposition ot a charqe ot indirect criminal contempt shall not preclude the prosection ot other criminal charqes associated with the inoident qivinq riae to the contempt. 23 Pa. C.S. 86114(d). Upon findinq 4 violation of any provisions ot a proteotion order or court-approved consent aqreement, the court, either pursuant to a petition for civil contempt or on its oWn accord, may hold Respondent in civil contempt and constrain Respondent in acoordance with law. A sentenoe tor civil contempt may inolude imprisonment of up to six (6) months until Respondent complies with the provisions in this order or consent aqreement or demonstrates the intent to do so. 23 Pa.
