Slnco tho parties began their marriage, the Respondent has regularly used alcohol to tho
degroo of IIOvero Intoxication on a dally buls.

The parties have had ~everl\1 confrontations In the past wherein the Respondent
wu physically abusive to the Petitioner.

On or about July 20, 1996, the parties again had a confrontation, Including the following
. events:
a. The Respondent threatened to kill Petitioner and anyone he may be with;
b. The Respondent repeatedly hit the Petitioner with a telephone receiver;
c. These events all occurred In the presence of the parties' two youngest children;
d. The Respondent forced the Petitioner to leave the marital residence.

On or about Monday, July :22, 1996, the Respondent went to the Petitioner's place of
employment, auempted to argue with the Petitioner by yelling obscenities; the parties' two
youngest children were with the Respondent at this time and were very distressed.
8.
After the Respondent attempted to light with the Petitioner at his place ot' employment,
the Respondent called a mutual acquaintance and said "he 15 dead."
9.
Petitioner avers that he Is in fear of serious bodily injury by the Respondent to himself and
to anyone who may be with him.
